My Mother a farmer about 73 year old now, has diagnosed with with Parkinson now, We are Malaysian, we own the farm, and my mother was always the one spraying pesticide. If so, do we qualify?
I would like to know two things: 1. My father a farmer born in 1933, was diagnosed with Lewey Body Dementia with Parkinson thru the VA. He passed away in 2014. Therefore, do survivorship qualify? Also my husband Vietnam Veteran diagnosed with Agent Orange Parkinsons, was paraquat used in Agent Orange? If so, does he qualify?
Hi Debbie, sorry to say the loss of your father in 2014 does not qualify due to the statutes of limitation in most states requiring you to bring an action within 2 years of the death. And if anyone was exposed to agent orange in Vietnam, those cases are too difficult to meet the causation requirements. And the US government has a lot of defenses to those claims. I wish I could offer some legal assistance, but in both cases I don't think I can help. But you might check with a lawyer who handles Veterans claims.
