I have 2 big questions. Is it hard to go for product liability (airbag didn't deploy) almost 3 years later? Can I even sue for product liability when I've already sued the driver for my injuries?

Hey I was sideswiped on the highway (my vehicle was totaled). Defendant (no injuries) & their insurance company has made me see two different IME doctors and denies liability. There policy limit is 250/500k. The accident caused me to have a herniated disc in lumbar L5-S1, 1 epidural shot and percutaneous discectomy operation. 2 herniated discs in cervical spine, 3 epidural shots. Then last week my pain management doctor had me do a discogram procedure to help locate the exact damage discs. Come to find out I need 2 disc replacements at C4-5 & C5-6. The case is going on a year and half and insurance company still hasn’t offered a reasonable settlement amount & still not taking responsibility. Can I have my lawyer file a “bad faith” complaint against them for claiming I wasn’t really injured that severely and not offering me reasonable compensation. And if so, can I receive more than the 250k since medical expenses will exceed that??

Who was at fault? Do you have a copy of police report? Send all medical bills through your primary insurance, secondary then MEDPAY, File a UM claim also. Don't sign a medical release, only medicals records pertaining to case. You probably have a medical lien. Don't take the first, second, third offer, be patient, you want everything in writing. Get those medical bills reduced. be patient, request monthly updates, don't let your lawyers rush you Read Rule 68, Certificate of Service, Civile Action File, Settlement Demand. Don't stress about it, rehab, recover and get better, your health is your primary concern. File the lawsuit and be patient. First Step. I'll explain the next phase to you .
What about insurance company sending an email iostructing you to falsify the mileage on your car by claiming 50K more miles than ade actual in okrder to be compensated for their covered driver that was found at fault for running stop sign and totalling my car and leaving me with a spinal injury. I have dedicated my life to racing moyorcycles. Now with back injury I can barely walk. Riding a motorcycle us now out of question.

I got T-boned after passing over train tracks. Their insurance carrier kept blaming me for the accident, but she had even admitted to causing the accident to the police. Her company thought that because she broke federal law and hit my car I was at fault. My insurance carrier would do nothing for me because I only carried liability. Insurance companies are crap.

I had dental insurance for months that gave me documentation that clearly stated they cover 80% of medical costs for the services I received. I was clearly covered under the dates of service and they've dragged their feet for months and months. I was in a three way accident 2021 where I took the impact of the other two vehicles. Loomis is trying to settle, but im taking it to trail. Im fighting the case myself, due to another accident a year later and pre existing conditions, so it leaves me no other choice but to fight. Thank you for this video. Non of the accidents were my fault. Medi-cal paid all bill and my insurance, but medical liens need to be paid back. Im between a rock and a hard place.
