Thank you Sir, I am in the middle of a Declaration of Trust to primarily leave my present mortgaged home which was entered as a QuitClaimDeed to my 2 sons in case I should suffer another stroke and die. I am feeling very uneasy since the QCD was not explained to me before nor after the signing and recording. At this juncture even if I wish to sell and divide the proceeds I'm thinking that I've been left with a worthless deed which might create more problems when alive and when dead when my sons decide to sell. I reside in CA.

The contract is Amazing, however I'm in a different state (GA). How different are the state laws between the two? And will this confuse me while taking the exam? Thx.
Buyer: I don't want to give you the money until it gets recorded. Seller: I don't want to get it recorded until you pay me. Doesn't recording the deed transfer ownership, how can you trust the Buyer will pay you after it gets recorded?
Someone has to take a leap of faith, so to speak. If you turn your question around, how can a buyer trust that a seller will sign over ownership after they have paid? This is precisely why the business has evolved to include closing attorneys and/or title companies. They serve as a trusted middleman to handle the transaction. The seller gives the closing agent the signed deed and the buyer gives the closing agent the money. The closing agent makes sure that neither party is cheated.
I keep getting a question on the exam along the lines of “a wife owning a house and quitclaims it to her husband tells him but does not record it. When they divorce does the husband have any claims in the property ??? I’m very confused with this question

I do not know what the test is looking for but i have been in this exact situation and No the husband would not. He would have to take this to court and fight on the basis of how property should be split during marriage. The quitclaim deed is unenforceable if not recorded. Connor Act.
