That is because biological fathers who fought to pay no support often find it "most effective" to punish the mother by being cruel to the child. This is horribly horribly common. So the mother is actually looking out for the child's best interests. It would be far simpler to just agree to whatever visitation the father wants, and a whole whole lot cheaper. But if you care about your child, if you love your child, you will fight...., you will end up living a financially tough life, rather than let your child be subject to constant cruelty.

As someone who had a relative working in Child Protective Services in Texas, I can say that granting someone the responsibility for caring for a child should not be done with a cavalier attitude. The horrors my relative saw puts to rest any misconception that caring for a child is something anyone can do. The judge is correct in making sure the father is taking small steps.

@TexasVernon I adopted 2 kids from Texas foster care. The horrors for children in homes of some court vetted, trained foster care providers shouldn't be happening then. And that is the child's father who has every right to see him, raise him from day of birth. He is only be phased in because the mother prevented that.

How do you know that her parents are supporting them? When I lived with my mom I had to pay rent, provide my own food for myself and my daughter, buy diapers, etc. I didn’t get ANY help. My mom wouldn’t even help me with my child so I could work weekends. I asked her to watch her grand baby she claimed to love and I come home from work to find my child in her crib covered in poop and urine, poop all over the wall next to the crib. My child had been sitting like that all day! I had to leave my job because I couldn’t get any help and had to get gov’t assistance so I could keep paying my mom rent and providing groceries for me and my baby since her dad didn’t do sh**. If she lives with her parents, it doesn’t guarantee that they are providing for her and her child. I had to get support because my child’s deadbeat father wasn’t helping and we were struggling with NO help from ANYONE! And he still didn’t pay his low a$$ support order of $187 a month.

Yes they do ask the mother if she is the not the primary custodian (meaning in simple terms she does not have possession of the kid(s) before she turned up in court). The judge granted him visitation as well. If he wants to see his daughter and the mother decides to deny him visitation, he can call LE and show the court order, and then she would have to comply. This judge seems very fair in his rulings.

The judge did not believe anything about the living conditions. He simply structured the visitation to become more frequent so he can get used to caring for a very young child since he didn't have the child without being supervised up to that point. Once he completes the number of supervised visits successfully and moves to unsupervised, he can start filing for joint custody which would be good for a child once a parent is ready to care for them. I think this judge is really encouraging this guy to step up and giving him the tools to eventually see joint custody. The child support would be reduced or ended. I paid 900 a month just for childcare for one child. $600 is not much to care for a baby. They are the most expensive. Even if the girl stays at home for now, it would save money till the kid reaches 2. I hope he listens to what the judge is trying to tell him. When my friends or myself get to a joint custody agreement, it can be very beneficial to the kids knowing who they are and where they come from.

In my state that's the starting point is 50/50 timeshare and joint custody. Studies have shown that equal access to the parents is what's best for the kids. Plenty of Fathers I know were estatic that that is where the starting point is. My opinion as a mother that every state should be this way. That way that if either parent doesn't want the responsibility they can just take their visitation or no visitation at all. But I remember in the past when it was pretty much guaranteed 4 days a month visitation and 20 to 30% for child support. The way my state handles child support now is there has to be a significant difference and they will order child support for 15 days to whichever parent makes less. So for example if you both make minimum wage you won't pay any child support to the other but if Mom makes $3,000 a month and dad makes minimum wage mom will probably pay dad $200 a month instead of the normal $400. This at least gives both parents equal say. Mr Marshall is just as young as the mother and the mother had to learn from scratch so if he had been in the home and they were still together he would be keeping his daughter while the mother was busy.

When my son was 15 he asked me to reach out to him so he could at least find out who he was. This POS didn't answer for almost a year later. When my son turned 17 he wanted my husband to adopt him, but he said no cuz of all the child support he paid. Lmao. When he turned 18 he owed over $87 thousand. But he paid so much cs 🤬.
