Why isn't Maribella sueing the construction company for inadequate sound proofing? Seems like they hold the liability as well as authorizing parties who approved and finalized the construction signing off that it was sufficient.
Adding further. I am sure Shady Park can also file suit against the contractors and city for all of these headaches. A business should not have it's rights infringed upon due to inadequate construction. It's gonna be hard to prove that they new when they started business that this would be an issue. If the business does everything right by the laws then it sounds like laws may need to get revamped.
ASU was behind this. That's who should be sued - however owners might have done due diligence before putting almost a million dollars down on a place. And they complain about not being able to hire staff for $13/hr. Are they going to erect an adjoining tent city? BTW: ASU gets special tax breaks. This is just as much about class warfare.
Anyone driving by Mirabella between the hours of 11pm-4am should honk loudly and continuously. Shady Park has NEVER been issued a noise citation. Ever. This is ASU. Due diligence would've revealed this was in the middle of college nightlife before dropping nearly a million down payment on a condo. But wasn't being near a youthful college the reason for living in Tempe rather than Sun City? And ASU gets special tax breaks for trying to turn Tempe into a ghost town.
There are 'grandfathered' realities here: A mountain to the east, a river and flight paths to the north, a landfill and major airport to the west, and a university to the south. They've been there for more than 60 years.
