@@handlesaredumb1Not sure what you think happened here, but the man was not arrested. If you mean they should have cancelled the call, that would be ludicrous. A woman called and said her husband shot her in the head. The mistake the cops made is that they lied and said the man was not compliant and the video clearly shows that the cops did not see a weapon and took him down before giving him a chance to comply with any order.

The NYPD, an elderly gentleman was protesting... elderly gentleman was not a threat, he was talking to them... the one Thug with a badge, shoved him, and his Head...hit the concrete really hard... severely injured and bleeding... the other, cop... just leave him 😤. @shenmisheshou7002
@shenmisheshou7002 4 месяца назад
@@anthonyvoss9150 I cannot know for sure for this case, but this "License plate was stolen," or "I ran your plates and there is a problem with your registration" is a lie that I am seeing more and more. This lie is the basis for what is known as a "pretextual" stop. The cops can't just stop you without a reason, so they lie about a reason for the stop when what they really want is a "lawful" excuse to run your ID for warrants (and of course black and Hispanic people are the primary victims of pretextual stops) and to see if they can generate up some reason to do a car search (I smell marijuana). The problem is that during the stop, you can't prove that the cop lied about the reason for the stop. After the stop though, you can get the call log, dispatch log, computer system use, body camera footage, and anything else from that officer's actions and see if they reported the reason for the stop to dispatch, and if they had any system access usage that supports their claim, and even FOIA the record for your tag to see if there was an error. Of course the cops will say they made a mistake or something, but once you can support your case, you can sue and might even win, but most people will say that it was not worth it. At some point, the federal government will likely step in and limit this abuse as a federal judge recently did with the Kansas Two Step, but for now, I can only say that I have seen a dozen videos in recent months were the reason for the stop was a problem with the tags or registration, and in all cases, there seemed to be no validity, but in these cases, the people were clearly people that recorded their interaction and challenged the cops right on the spot (and none of them actually had problems with their registration or tag) and made a record for us to all see. Lawsuits will stop this kind of thing, but for that to happen, the public needs to learn what a pretextual stop is and how to gather the necessary evidence of wrongdoing.

While I too think this is a good idea, this is a state's rights issue, and the police in the state would paint this as "anti-Police" and would scare the citizens into thinking that it would make it more difficult to be tough on crime. Tell me how people running for state office would like to see commercials running on TV, paid for by police unions, that the candidate was not tough on crime, and that crime would go up if this were to happen. The funny thing is that they would probably be right, because as insurance rates went up, people would have to stop being cops and since there would probably be a very large deductible, there would still be money out of pocket. Even cities will have a $1 Million deductible.

Qualified Immunity has to be fixed. It's taxpayers that shoulder the burden for these abuses.
@shenmisheshou7002
@shenmisheshou7002 4 месяца назад
This has nothing to do with qualified immunity. The cops were sued successfully. There is no law that requires the city to pay on behalf of the cop but if they didn't no one would be a cop in their city and in larger cities, the union has it in their contract that the city will pay this kind of lawsuit. Qualified Immunity does not keep the cop from being sued or from having to pay the settlement, but cities, counties, and states virtually always pay settlements or they would not be able to get employees. Would you want to pay for a mistake you made on your job, even if you worked for Tesla or Google? OF course not. So, there is nothing to fix here. Qualified Immunity does not protect cops from being sued for excessive use of force or for violation of any clearly established right, and no law makes the city, county, or state pay on behalf of the officer, but if they want people to come to work as cops for them, they know that they have to pay the settlement.

I assure you, a lot of metropolitan police departments require college education now. The verbal interview portion to get into the academy is where they weed out the wrong personality types. Wrong as in the cops who will do the right thing. They want specific types of personalities, ones that follow orders, or have loyalty beyond normal, and aggressive tendencies. They probably even like some authoritarian attributes as well.

@@erich6860 I assure you, not in my neck of the woods. A few years ago the PD reduced the educational requirement to a GED, years ago it was 60 college credit hours. Ex military get an extra 10 points on the civil service exam so individuals who may actually become reasonable officers are excluded. The intellectually impaired Rambo's get hired. Police Officers don't become psychotic because they joined the PD, psychotic individuals choose to become police officers.

While I understand the police were responding to a call about a shooting what possible reason was there to throw the man down his steps face first onto concrete. Police always respond with way more force than required and always justify it by stating officer safety but seem to ignore citizen safety. All cops should be required to carry their own malpractice insurance policy so that the taxpayers aren't liable for these lawsuit payouts. (edited for spelling)

It is worse than that. There is a huge conflict of interest on multiple levels. If these cases eventually go through an "external" review process or the judicial system, they are most often heard in the communities where the excessive force occurred. If you are on a citizen review board or jury that decides if community funds will compensate a victim of excessive force, you have good reason NOT to find fault with the LEOs...because you're going to pay for their error from your own taxes.
