సర్, అపార్ట్మెంట్ డెవలప్మెంట్ అగ్రిమెంట్ లో పార్కింగ్ ల్యాండ్ ఓనర్సకు బిల్డర్ కార్ పార్కింగ్ కేటాయించారు, కానీ ఓనర్స్ ఇతరులకు వారికి కేటాయించిన ప్లాట్ అమ్మినప్పుడు మాత్రం సేల్ డీడ్ లో కార్ పార్కింగ్ అని ఎక్కడ రాయలేదు, కానీ లింక్ డాక్యుమెంట్ నెంబర్ ఉంది, ఇపుడు పార్కింగ్ లేదు అంటున్నారు, అపార్ట్మెంట్ ACT లో కార్ పార్కింగ్ ఉంటుందా, దానిని సెల్ డీడ్ లో తప్పకుండా carparking అని మెన్షన్ చేయాలా, లేదంటే ఎలా Citation తో క్లియర్ చెప్పగలరు. చాలా మంది ఈ సమస్య తో ఇబ్బందిగా ఉన్నారు.
Sir, If there is no point about parking in the sale deed, the purchaser cant seek the same. The purchaser can seek compensation against the owner in Consumer Court only if there is mentioned in sale deed but not provided. The purchaser can seek declaration in Civil Court about car parking basing on the link document only. There is differences about car parking between Associations and AP Apartment Act 1987. సార్, నేను plaintiff గా ఒక ప్రాపర్టీ ni court lo వేసేముందు court fee కట్టాలి కదా సార్? About 5% or 6% of the Govt. Value.. My question is defendant కూడా నేను ఎంత fee pay చేసానో వాళ్ళు కూడా court fee కట్టాల వద్దా? Pls answer my query sir.. Thanks..
Defendant need not to pay court fee sir. Court fee to be paid only by those who approached the Hon'ble Court seeking certain relief. If defendant loose the case and he wants to appeal the decree, then the defendant to pay the court fee as applellant in Appellate Court as it is the plaintiff paid in the lower court sir.
@@ravindranathadvocate625 Thanks sir for your reply. If defendant looses the case and does not appeal, then the fee paid by plantiff will get refunded (deducting some charges) as he won the case..
@@maheshreddy5261 Yes Sir. But that is the discretion of the court. For example, sometimes court decree the suit with costs and sometimes court will decree the suit without costs.

Not possible sir. You should definitely have title deed in your favour for your claim seeking declaration. If other side filed any title deed in their favour, then you will defeat in respect of your claim. You can defense your case around 3 years in a civil court.

My grand father has two wives, First wife has 1 son, 2 daughter s, Second wife has 1 son and 1 daughter. My grand father divided his self aquired property equally and shared to two sons with unregistered will ( forcely written) after 25 days again he did the 70% land given to his first wife son as a gift deed in sub registrar office. Untill my grand father died 10yrs later after giftdeed. This total incident happened before 25yrs. First son lives from 25yrs in that property Can Second son family file the partition suite??? What is the winning possibility to first son??
