Somewhat confrontational? He was hostile and belligerent. It's a well established fact through his own video recordings that decastro conducts himself in a most unhinged manner and that is going to get him painted as a hostile threat and an unknown by officers at the time of the interaction.

He has a tag on him to approach with caution. As a convicted felon, he likes to brag about pulling his 45 on a cleaning guy that came into his hotel room that chileeta was supposed to have already left. He has a conviction for having and distribution of GHB. He has multiple restraining orders against him, warrants out for his arrest including a possible vehicular manslaughter while driving without a license. Then there is the shotgun he was keeping in his van, driving while broadcasting, it is amazing that he has not killed anyone while doing that. Then there is the drugs he has admitted to using to keep his, " focus" his assault charges. Yeah, stand up guy.

She’s just following the script to be the defense side. And they are all wrong, the 21 foot rule has nothing to do with 1st amendment. City ordinances and state laws can define a distance from police during an investigation. Louisiana just passed a 25’ Foot law. Not sure what the 1st amendment would have with that. I suppose you could take it to the Supreme Court and lose because of the 10th amendment that gives powers of legislation to states. 😮😂😅. Chillie is in jail for a reason. It’s about time!!!!!

Trying to gain their attention in a aggressive manner and splitting their attention could do it. After all, the officer can only shoot in one direction.

What these people don’t understand is that Chille doesn’t actually have 500,000+ subscribers on his RU-vid channel, & it has been proven that he buys his subs. It shows clearly when you look at his video views, and the amount of people who attend his livestreams. When you have 500,000+ subs, and your livestreams only generate 40-50 viewers, you certainly don’t have 500,000+ subscribers. Chille is a cop-baiter, and a bully. He bullys people that aren’t supposed to defend themselves or fight back. He baits cops for negative interactions, and clicks & views. I believe 100% that if RU-vid didn’t monetize his page, or pages like his, he wouldn’t behave in this manner.

Either way it is how he makes a living. There is a whole genre of uniformed gullible sheep out there that support and follow these people. The frauditors constantly have to escalate their behavior to compete for the shock value to keep people clicking. Getting arrested gets the most views. If they get arrested there is a large enough audience to grift from and raise funds (scamming their audience) for lawyers fees etc. the judge knew this, which is why she is using Chillie as an example. But it amazes me how many gullible people there are that support these scam artists who are just using them to build an audience to make this type of content. .

Legally, there is a probably a case here in favour of the incarcerated but morally, this guy is beyond reprehensible. And if he wins his case, unfortunately, it will only make him worse and encourage others to follow.

His Attorney didn’t make it 1st Amendment case. The Officer did say he could record, but he wasn’t comfortable with how close DeCastro was. I’m content with the ruling. ✌️

Which is a really disingenuous build up to some of these guys have low bmi due to proclivities for recreational stimulant use. And some manage to be fat meth/coke heads. (Go ahead pro-frauditors, make your counter Rekata joke ...) Trying to steer back to "ineffective counsel"... Chili did that to himself by insisting that he would actually handle the representation and not prepping with his lawyer. However, the lawyer should have told Chili that the judge might not allow a sudden substitution/conversion of counsel motion right before trial....after the motions deadline.

His large audience includes paid for subscribers (look at subscribers vs views). Also he's not "performing a service", he purposely antagonizes. Actual 1A auditors (who actually ARE performing a service) don't involve themselves. Chillie is just looking for a payday through suing anyone he can.

His live postings are essentially infomercials for his legally flawed and historically inaccurate merch. It is sad that suckers send him money for any reason. He is a lifelong failure at whatever he has tried, and YT seems to be one of the avenues where losers can actually make money, at least for a short time, until their truth is revealed.

Why are people so stuck on the distance? It was the way he was acting, the way he clearly was trying to get a rise out of the cop, he drove up and got out with the intention of disrupting that officer. Whether you are two feet away or twenty, you can still obstruct and harass, chillies favourite pastime when it comes to cops.

Lisa says Decastro was “not prepared for the consequences” but ONJ posted a post-hearing Interview where Chille explicitly said he was willing to be locked up and go through imprisonment “for all of you” if that’s what it took. So he was aware of consequences, he just apparently didn’t think it would actually happen to him.

think they knew what sentence the prosecutor wanted if found guilty, so expected no time behind bars. As he found out, the judge doesn't have to agree with any prosecutors recommendations or even plea deals.

He could have taken a fine and no jail time from the beginning when they offered the plea deal, but he dragged this out with delay after delay - saying he was ill when he was actually doing livestreams, saying he was travelling on vacation when he wasn't... I think the trial 'tax' for wasting the court's time and thumbing his nose at the court's process is warranted. He had already caused unnecessary aggravation to the court before his trial even began.

Lawyers are post college grad liars. DeCastro wanted to be arrested because he thought the judge would be just like the liberal judges he has faced in the past and lackluster poor prosecutors. What he found was a real judge and a real prosecutor who gave him just what he deserved. He should be happy he faced that judge because if I could have sentenced him he would have gotten the most time I could have legally gave him.

I'm not trying to insult you all but you got quite a few things wrong with this case. To keep it short; He didn't get the max sentence, he got half the max. Second; DeCastro was offered by the prosecutor Anger management, a fine and a suspended sentence and he declined it, so to say the sentence was unreasonable in my opinion is not true.

Are you kidding me? You don't think the arrest should have occurred? Have you ever made a traffic stop? You ever worry about someone having a gun and shooting you? When someone distracts you, it creates a reactionary gap; you can't respond to two people at once. The arrest should not only have happened, it should have happened sooner.

@@1stamendmentauditorafraid is not the word I'd use. I would say aware of where possible threats can come from. When you have someone who is not involved in the traffic scene whatsoever walk towards the scene it draws the attention of the officer. I don't think Chilly or his followers realize how dangerous a traffic stop can be, to them it's a game for clicks and views on RU-vid. If he truly wants to hold the Police accountable don't interfere with the scene, stay out of the way and film. But he can't because it's all about the confrontation for RU-vid

Do any of you 1AA supporters watch any news where LEO are ambushed or attacked when their backs are turned or they are shot in their cars, you see these news stories on YT news from stations across the country FFS! That’s why LEO have to be aware of what’s going on around them and they can’t let their guard down when some idiot is bad mouthing & distracting them as they’re filming at close proximity. Film from a distance, that’s perfectly legal and safer for those involved. Most times it’s all common sense stuff, unless you haven’t got any!

According to the Judge, he did not receive the maximum sentence as he claims, she gave him half of what the law said he could have received; 6 months on each charge for a year total.

Whether Chille was ten feet away or two feet away is not the point. The point is that he began talking with the driver that the officer pulled over; that's called interference in a traffic stop. When the officer told Chille to stop talking to the driver and back away, he refused and became instantly obstinate and confrontational. That is why he was arrested. How is it that Lisa Szyc doesn't understand this?

He belongs under the jail. All of these idiots with cameras if they just kept their mouth shut and filmed the police and followed their instructions I would be on board. But even before the LEO says anything Chille starts berating the cop for no reason. He deserves a long long time out.

I totally disagree with what the panel is saying. Even if you take the stance that he is press, the press has certain limits. One is that they do not inject themselves to create content. The officer had no problems with him filming. He stated that a few times. It was him walking up towards the car to interact with the person. Before any thing happens , a public safety service provider (law, fire, EMS) has the right to direct people to make a scene safe area. Bandiero was wrong about saying that public safety should not be afraid of every thing. It is called situational awareness. It is what brings everyone home safe even Chilly. Chillys actions caused this. He prevented the officer from doing his job. That is clearly seen. I could go on but these 3 were not the right people discuss this. They did not even get that maximum length right. He was given 90 days out of 180 per charge. She gave him the middle to try to teach him that he does not have unlimited rights. She just stacked the times as punishment for his courtroom behavior. I wish I could have been the moderator and ask these people hard questions and not let them run on feeling.

There is speculation that he bought bots for most of his followers on RU-vid. His live streams have maybe 100-200 viewers, which is incredibly low for that size of a channel. He is as much a successful RU-vidr as he is a constitutional law scholar.

Just to put something in perspective, when _ONJ_ has a live stream or premiere on a popular case, _Law Talk With Mike_ has 5 to 20 times more people watching along on Mike's live reaction stream. Many of these are _ONJ_ subscribers. And Alex always gives Mike a heads up on when the video will drop. (Maybe RU-vid needs to look at how revenue is shared in such situations.) My point is that many of Chili's subscribers are watching his videos on commentary channels. He may very well have fake subs, but that is hard to substantiate.

@glynncordry5965 Is ONJ monetized? I’d imagine it should be, to cover expenses of doing this. If so, there is a way to file for partial monetization, where other RU-vidrs using your content (even in fair use situations) would share monetization. Don’t know how it’s done, but have heard other RU-vidrs complain that their monetization got shared for fair use.

Whether or not you knew Chilly Willy by reputation, having an obvious cop hater standing behind you what are you trying to make sure that the person you stop doesn't have a gun in their lap while you're writing a ticket only adds to the problem. The Castro's demeanor end proximity was obstruction, no not a physical act but a deterrent from the cop doing his job without having to have his neck on a swivel and losing sight of the person in the car.

Why doesn't the panel understand that Chille is allowed to film, but he is not allowed to shout out or to try to interact with the officer while the officer is dealing with a traffic stop that does not involve Chille. Anything that distracts the officer from dealing with the traffic stop counts as obstruction/interference. Obstruction does not have to involve physical contact. Anyone can look up the statute for their state, in some states they call it obstruction, in others interference and in others they have separate definitions for obstruction and interference. Does the panel really think that Chille actions did not distract the officer?

Actually, they’re probably more on top what’s going on in public than the people, such as you and I, who watch too much RU-vid. I live in large urban area on the East Coast of the United States and I have never once seen a First Amendment Auditor in the physical world. From their videos I’m aware that Long Island Audits (Sean Reyes) and Annapolis Audit have done near where I live, but I didn’t see it IRL.

@@ronintje7647 shark attacks really happen and are a danger to to safety of those attacked but the probability of me being attacked by a shark is extremely low. The probability of anyone I know, and I know people who regularly dive and/or often swim in the Pacific and Indian Oceans, being attacked by a shark is really low. For all the ruckus it causes when it does occur, it’s rare. The same is true of 1A auditors.

In Ohio deescalation is a tool not a law/policy. It will not work with frauditors . So why try. That is why "disorderly conduct" is still on most books.

Interesting discussion, I do not believe Chilli believes in what he is trying to sell, it’s more go away money I think he was after, he has become a legend in his own mind. Yes filming of police in the course of their duties, is holding them accountable but it’s the manner of ‘auditioning’ that takes away the officers attention from the traffic stop. This officer was on his own he did not know if Decastro had a gun or knife, in the UK he definitely would have been arrested, I saw in Cyprus recently a woman who was shouting at a police officer, sit down and shut up, in A&E, he had a prisoner who was being seen before her, she was if she had continued been arrested, police officers in the US put up with much more abusive language by people who are filming them in the course of their duties. Just because you have free speech, doesn’t mean you should be allowed to scream obscenities at police, Chilli pushed the envelope and he only had himself to blame due to his actions.

He’s made it pretty darn clear that he sues RU-vidrs as a way to harass and financially hurt them. I don't think he is fake in his opinion, the way he gets into a rage during it all i don't think can be faked. I know he's an actor, but i don't think he's that good an actor. To me that rage just looks genuine, the guy really hates cops and gets into a rage over nothing, probably also why he got several protection orders filed by former gf's and those orders are probably also what is feeding his hate for cops and justice. To me it makes sense that he isn't faking his crazyness considering the stories and reports we've seen from his past.

They might be in the JAVS, but the audio and video quality would be very poor. The JAVs equipment is focused on the judge, witness stand, and lawyer tables, so any footage would be "stuff in the background" quality. _ONJ_ probably doesn't have any more footage than was already released. They don't record during hearings they haven't requested access to. If the JAVS caught anything, you would have to request the footage of the hearing (s) before DeCastro's. In some JAVS releases on other channels, sometimes you'll see Blandino lurking in the gallery.

It’s two different scopes. Constitutionally, everyone has the right to publish, and it doesn’t make sense to be a “member”. It’s like saying, “I’m a member of Free Speech!” When we say “member of the Press” we are talking about accreditation by an organization or government that allows access in certain situations - those situations being where it is stipulated in rules that members of the Press have special access. Looking at a recorded image on a screen and judging distance after the fact accurately is nearly impossible. The context clues are distorted both by the recording device lenses and the display technology.

The narrative that DeCastro is just documenting, doing the journalist thing etc. That is really a stretch. DeCastro is a social media grifter who is living off of donations he gathers by posting provocative interactions prefereably with police. He is not on the creepiest end of these types, who sooner or later tend to want to "audit" places with children like libraries or schools. If you want to discuss the politics of this like whether this is an overreach of police or the underlying laws should be changed - you use this specific example or DeCastro's general behavior as a basis, that's not going to win public support. And personally I think someone directly inserting themselves into a traffic stop in this way that is really none of their business - going after the driver, and after the officer, addressing either of them directly while the stop is ongoing: I don't know where the line should be, but I have no issue that DeCastro's actions in this case are over the line and led to a conviction. Whether 6 Months is right ... I don't know - does feel like a lot. Give him 30 Days for Contempt and a couple months probation ...

I'm a rather small, and amateur fencer, who among other weapons practices long knife and rapier and dagger. With pied-ferro (that is one foot planted and non-moving) I can strike with either the rapier (lead foot lunge, trailing foot planted) or dagger (lead foot planted, trailing foot passing, weapon in the offhand) to a distance of 9ft with no distinct effort. This is a single movement of my hand and a single footfall. So 10ft behind a single police officer - a belligerent interference is clearly a potential threat. He was asked to move backwards, from a distance 'estimated' to be maybe 10ft. This could easily be from 8-10ft, people are poor at estimation. The training exercise uses 21ft for an alert but empty handed officer to respond to a rushing attacker. He wasn't given a specific distance, but was asked to move backwards - he took a 'half step' then halted and refused to move a second time. DeCastro interfered with the stop - his presence made the officer's job unsafe and his talking to the driver interfered with the ability to continue the stop without interference and obstruction. The minor stop was abandoned - we don't know if the stop was concluded or abandoned for being too unimportant for the increased risk. DeCastro has a habit of obstructionism, interference and he did resist the detention and arrest. He further continued to demonstrate the nature and degree of his obstruction and resistance with his remarks and physical resistance to the removal of his phone in court. This is not 'resist with violence', but it easily rises to resist without violence. He also indicated a willingness and intent to be arrested with a nod and a thumbs up to the judge, immediately before her passing sentence on the conviction. He was rewarded in the manner he seemed to desire. His conviction was 50% of the maximum imposable for the charge.

You guys got what seem to my non-lawyer ears a few things wrong by 13:21 . 1) SCOTUS has already said that a RU-vidr is not defacto “media” because everyone on the site viewer and creative are given a channel and since all you need is a sign one that is (as I understand it) way to vague. 2. You can pay for subs. You can buy them by the thousands and millions on RU-vid. 3. A Sub to RU-vid works differently then to a news paper so comparing them is nonsense. 4. Once you have committed a violation the cops have till the statute of limitations to stop investigations. The cop was mid investigation and several times stopped and ultimate he fought the cop. 5. First amendment auditors and cop watchers are different things. Also, people recording an incident is different too. First amendment auditors on YT are instigators trying to cause reactions not respectfully recording. Those that do the later are almost invisible so they are incentivized to cause havoc. 6. Causing a public disturbance for profit is against the law I thought. And since so many of this group have records including SA, DA and CA there demands are I record and stalk victims seems a bit … inappropriate! 7. These persons are helping those that want to destroy our right to record gain support for grossly limiting that right. 8. You can be a jerk and a scum bag but the moment you do there can be no law that says those with discretionary ability will not then return the favor. Insert the Golden Rule here. 9. This was a case where even at the time the cop said he had the right to recorded but he was to close and this happened because DeCastero was applying a law from another state even when told repeated he was wrong. (The 20 foot rule comes from the idea that a person can cross 20 feet to stab you before you can react. I don’t buy that but there is a reason) 10. There is no right to record or do anything in another persons property. Public or no there is no right. They say they want you to wear shoes, shirt and a mask then you must. The only rational law that applies is the traditional public venue. You don’t get to go into an art gallery and start clicking. Same with a theater. I assume you know this. Not a lawyer and this is all IMHO but yeah I was out at 13:21 since I felt maybe I was getting it a lot better before hand.

1) No, it hasnt. There was a case a couple years ago in the Washington State Surpreme Court that ruled at an indivudual isn't a "media entity" for purposes of a particular type of records request. The ruling was that "entity" meant "corporation" . Neither random RU-vidr, nor Lois Lane could request that particular type of record. A RU-vidr with a corporation, like _Our Nevada Judges_ , could request the records, but Alex could not in a personal capacity. The request would have to come from _ONJ LLC_ . Lois Lane would have to have _The Daily Planet's_ legal department submit the request. The ruling didn't determine who "press was", only applied to that particular form, and is only relavent in Washington State.

José may have 500k subscribers, but the real measure of a channel’s reach is the views per video. The majority of his videos have 5,000, or fewer, views. A few hundred videos have 10-99k views, and only a meager 27 videos have over 100k views. Those are not good statistics for a channel. These numbers make it understandable why many have questioned whether subscribers were purchased. It’s highly likely that the channel numbers will continue to trend in an unfavorable direction as long as José remains incarcerated. It will be interesting to see if Jose’s incarceration will change his future interactions with law enforcement.

The most part of DeCastros 500‘000 Subs are bought and are one timers that just sub him and never watch. A RU-vid channel has always (of course there are exceptions) more viewers that watch the videos that subscribers. DeCastro has an average of 10‘000 viewers. There are five videos that have more than 100‘000 viewers and one video with about 500‘000 viewers. If he didn‘t buy at least 300‘000 subs, he must get a special channel award from RU-vid!

Lisa is wrong. This was not a maximum sentence for the misdemeanours. He was allowed 6 months on each, and was given 3 plus 3 to serve consecutive - she could have given up to 6 plus 6. This is a 50% sentence. Without his court-room antics this may have been concurrent. He demonstrated 'live' the nature of his interactions with police to the personal protection officer of the court, barely a few weeks after a Judge was assaulted over the bench.

It is my stance that 1a odditers film for money on their monetized youtube channels. That means that these people are making money off of other people's images without their permission. Thats why people like chilly does this, for money. It's not about our rights, its about his right to make money off of harassment.

Definition in Nevada. Obstruction is Deliberately hindering a public officer from carrying out their duties. This lady is a fool if she thinks Chille did not do this. How disgusting to sit there and watch an obvious crime and ignore what you see. She’s the reason people hate attorneys.

It’s literally the reason he does what he does. His intention is to interfere, IMO. DeCastro wants to distract them, get under their skin and make them wonder if he is a physical threat. He typically attacks them verbally with the most vile hate speech. They don’t know anything about him . Does he have anything on him that can harm them? Is he using street drugs? Is he having a mental health crisis? He’s not just filming and he’s not just asking questions. He’s interfering.

ANYONE can be “press”. The constitution protects us all. Having said that, being a member of the press doesn’t give a person any special rights or privileges that the rest of us don’t have. So saying “I’m a member of the press!” isn’t all that impressive.

10 feet is to close. Police are trained in the 21 foot rule. A person can stab you from 21 feet before you can react with a firearm.

I'm not in LE and never have been. I totally understand Officer Bourque's position of wanting a person 21 feet back to give him time to react. DeCastro says he's a member of the press but was unknown to Officer Bourque. Had DeCastro backed up 20 feet, he could still film, and Officer Bourque would have been happy. DeCastro is looking to get into situations where he can file a Federal Civil Lawsuit, which DeCastro has already done over the arrest. When he gets out, he will be suing the judge and the A.D.A., the City of Las Vegas, Clark County, and anyone else he thinks have done him wrong. DeCastro may believe in what he's doing, but it comes down to money, and DeCastro wants fame and has been talking about running for governor of an unamed state. Many people believe that DeCastro buys followers (i have no idea how to do that). DeCastro is suing people who are opposed to have DeCastro acts and point out what's illegal (look in the Santa Monica court in California for those cases). It will be interesting to see how close DeCastro gets to the action. I could stand 20 feet back and zoom in a little and get the same video. The winner in this was the lady Officer Bourque had stopped. The lady initially stopped was kicked loose with no ticket..

I wouldn’t place too much emphasis on the quantity of subscribers he has. Look at his views; they are nowhere near the number of subscribers he supposedly has, and I would venture a guess that there are a good portion of those views that are curiousity views only.

It would take someone that DEFENDS CRIMINALS for a living to think that Chli DeCastro wasn't obstructing the police officer from effectively and efficiently performing his duty. Seasoned public defenders develop a warped sense of reality, right/wrong, and legal/illegal BECAUSE OF what they do for a living. They're mind is conditioned to find a way of justifying the unjustifiable because, well, it's what they do. DeCastro was 100% in the wrong for interfering with the officers ability to concentrate on the task at hand during the traffic stop. There's absolutely NOTHING wrong with filming the police during the execution of their duty. But that's not all that DeCastro was doing. He deserved to be arrested for his purposeful actions.

I think one overlooked fact with him is that we "know" that he's harmless. But now imagine you're the cop in the situation and have no idea if the guy is going to pull a knife or attack you. He totally overdid it and I think the sentence is justified. He should get some extra for his courtroom behavior.

You need to watch the video Again- the judge told him to give the bailiff and he would not - he instead tried to give it to the prosecution- and the officer grabbed it out of his hand. When the officer did de Castro called him a pig. de Castro demonstrated his behavior and actually obstructed the court by not following the judge’s instructions. When he was challenged by the judge he said the officer had given him an “unlawful “ order by telling him to get his feet off the bench de Castro was sitting on . The judge indicated that she had seen his videos, she also was aware of the body camera videos of the issue at hand. Compound those facts and how he behaved in court were demonstrative de Castro was not contrite and had a propensity to repeat the behavior.

At least some of his subscribers are from the antifrauditor community. I appreciate the viewpoints, but I agree with the police trainer. None of this is about principle for DeCastro. Its about money. Listen to his jail calls. DeCastro is probably going to try to get this video into appeal evidence, with very cherry-picked excerpts.

did you watch both police bodycam and the footage chille took? he has already lost one appeal... there is NO issue when you stand there and just record... but once you start yelling at the cop while he/she conducts a stop then your interfearing with the stop... a cop should be focused on the person being stopped not splitting his attention with the driver and moron with a camera... once attention is split it takes longer for the cop to deal with the stop... chille intentionally obstructs traffic stops, the time he did an illegal utrun to film a cop... you wonder why he got cited for it.. then you have the frauditors that intentionally split apart to split the attention of a cop three or more ways... there are many frauditors out there that just want a confrontation with cops to draw attention for youtube clicks and views... chille is just one of them but his claim to fame is his so called constitutional law scholar which he doesnt understand the basics of law...

I've been a bit confused about this point too... But it seems he lost 2 bail pending appeal motions, one before Zimmerman and one "on the papers" before Levitte. The appeal is still ongoing, which was the point of the last posted hearing where Oram was asking for extra pages in the brief. At least one of the related civil suits has been dismissed.

I don't know the particulars of his situation. I can offer that 1)if there are medical or fitness issues, a recruit can be recycled through basic training. 2) sometimes there is a delay between basic training and specialty schools. The marine would just have basic duties while awaiting the school slot to become available. 3) if there is an injury, there may be time given for treatment and rehabilitation. If they come to the conclusion that the injury can't be remediated, then discharge occurs. 4)any accumulated leave is taken before discharge. These factors might stack up to 4 years in service without completing the specialty school, depending on the timing of the injury.
