People don't realize you can sue for false claims. Section 512(f) also allows recooperation of legal costs. I used it and settled with Nexstar (NBC) when they unlawfully copyright striked my channel. More youtubers need to k ow and use it.

As a software engineer, I watched this guy for a *short* time. Then he said some stuff that seriously put me off, and then he made the video about his wife leaving him, I was like, "I know why." That was the last I paid attention to him until I saw these recent videos reacting to stuff he's been up to.

I used to work on YT’s copyright team and let me tell you, people like him abuse the copyright system all the time. We would send out at least 10X more fraudulent takedown notices or fair use notices than actually taking down videos. With copyright (more specifically fair use), it doesn’t matter what a person says in their critique of copyrighted material, it only matters if that person transformed their content enough to be considered new copyrightable content. If it is slanderous, then contact the critic with a cease and desist for slander, don’t bother the copyright team.

@@blazaybla22 We weren’t “laissez faire” about fair use and we would communicate with lawyers all the time. My point was that people would file copyright claims for issues that don’t involve copyright at all, in this case it would be slander which is not a copyright issue.

All RU-vid needs to do is add an option for when you're refuting a claim. "Suspected Copyright Abuse." and make the other side prove they're legit. But they won't.
They won't because that's not how the DMCA works. RU-vid isn't the mediator for copyright issues, they're the messenger. Courts decide who's in the right or wrong, and it's on the people making or receiving complaints to hash it out.
@matts.1352 that also isn't how DMCA works, youtubes policy is to just immediately pull a video and strike a channel when a claim is made. It's not required by law to remove the material prior to going to court, plenty of people file claims on actual fair use material, and let's not begin on the SoundCloud rappers filing claims on things like nintendo game soundtracks, something easily verifiable as not coming from the actual copyright owner. Plenty of other sites refuse illegitimate claims and keep content up and tell the claimant to go to court then.
I remember seeing something like this on a MMORPG. They claimed I broke the rules, I said prove it... and the system sent the typo that it thought was a swear, but in context was price, without the e... but the context showed I clearly meant price. Talked to a real person and cleared the record. There should require proof... you know... like the Copyright number printed on your copyright certificate and any legal copyright owner has access to and can be looked up by youtube for verification.
What is false about the claim though? Why are record labels able to copyright claim a video if even 10 seconds of music is used in a video? You need permission (as per the law) to use someone's work for commercial purposes.
@@matten_zero Your mixing up DMCA and youtube policy/procedures. At the end of the day, it is (Google)RU-vid's platform, and they can allow or not allow anything they want. They come to agreements with the record companies to allow that type of flagging, it is not a DMCA take-down request, it is an internal thing.
@@snarkywombat155 fair use is pretty clear non-commercial at minimum. News organization ask for permission use clips all the time. Artists are suing for just TRAINING AI models. Hell you can't even use unlicensed stock images without risking infringement on copyright. Most of the confusion is because of a TRADITION of not suing each other. Some big artists are ok with react content, but they would be in their rights to shutdown every channel that uses their work for non-commercial uses (and have the capital to do it, hence why RU-vid is very quick to take down anyone uploading even a few seconds of music).

I remember seeing a video a few years back about TechLead intentionally rejecting a subordinate's work when he was a Lead at Google. Every time his subordinate made a pull request, TechLead would reject it and it cost that person their job because none of their work was making it to the final product.
