The Federalist Society's Capitol Hill Chapter and the Regulatory Transparency Project event featured a panel of experts discussing the U.S. Supreme Court’s upcoming administrative law decisions in Loper Bright v. Raimondo, Jarkesy v. SEC, and Consumer Financial Protection Bureau v. Community Financial Services Association of America.
The outcome of these cases could change how decisions are made in Washington. Once the opinions are handed down, how might Congress’s approach to delegation of legislative power change? How will the expectations for congressional oversight evolve? Are there historical precedents that provide insight into potential changes in Congress’s approach to legislative delegation?
All this and more were discussed by a panel of experts including William Yeatman, the Senior Legal Fellow at the Pacific Legal Foundation, and Professor Kimberly Wehle from the University of Baltimore School of Law. Judge Trevor McFadden of the United States District Court for the District of Columbia will moderate this event.
Featuring:
Kimberly Wehle, Professor, University of Baltimore School of Law
Will Yeatman, Senior Legal Fellow, Pacific Legal Foundation
Moderator: Hon. Trevor McFadden, Judge, United States District Court, District of Columbia

"May, not shall implement" neither specifies time nor asserts present tense verb sufficient to eliminate 'shall/will' less desirous. [Agency does by expertise pertinent revise prior to my sending the comment..] great 'sledge' assert on "dichotomy/binary dangers. 😊

Merit of measures and strict permits and limits of solitarily, least tethered 'Agency' on order and errand. Means of sourcing ? I'm implying priority of contingency to extinguish rise of crisis in critical structure, bureaucracy, ..,( ie. a stop of hypocrisy to extinguish threats of Autocracy) What rarity Agency privilege and errand? unpopular.?

No one is challenging Congress's power. The challenge is to the Executive branch's power to legislate. Frankly, if Obama can make a rule with force of law and Trump can undo it, then it is, in effect, legislating.
