Laws about consent exist because people cannot exercise their best judgment when they are drunk, which is why having sex when you and/or your partner is intoxicated is not a good idea. We often hear that if you have sex with someone who is drunk that's rape. What's closer to the truth is this: If you have sex with a drunk person, in a court of law you cannot say this person consented to sex because an intoxicated person cannot consent to sex. If two drunk people have sex and accuse each other of rape, an investigation would have to happen to figure out who should be charged. It's possible the person who is determined to have initiated sex may be charged with sexual assault.

The only way to know for sure if you can kiss your partner or engage in other sexual behaviors with them is to ask them each and every time. This is called getting their consent. It is very common to think that your partner may be into kissing or another sexual behavior by the way they are acting, but just because someone is acting a certain way, it doesn’t necessarily mean they want to engage in a behavior.

People like "Amaze" want you to think that you have to explicitly ask a woman for a kiss before giving her one. This rarely happens in the real world. Most people just feel the moment is right and kiss each other. Many women do not want to be asked, likewise men don't always want to ask. It ruins the romance of the moment. Feminists/Mysandrists jump at the chance to sue men based on this. Haven't you seen the famous Rubiales incident?

i agree with the other guy though, why do you not have personal responsibility for your actions when drunk? you face consequences for any other thing you did while drunk. you put your self in that state.
