Sir, In my ongoing case opp party is not bringing his evidence from last 6 months. Consumer commssion gave him last opportunity to file evidence. In next date opp party only brought affidavit (साक्ष शपथपत्र) and requested consumer forum to give him next date to submit evidence. On next date opp party was absent. I requested consumer forum to close the opportunity of filing evidence of opp party. The consumer forum ordered me to submit Written Argument, but the opportunity to file evidence of opp party has not been closed. Order sheet में लिखा कि अगर opp party evidence जमा करना चाहे तो आगे कि proceeding में जमा कर सकती है. अगर में अपना written argument जमा कर देता हूँ, उसके बाद opp party अगर evidence लाती है, तब तो मेरा written argument ख़राब हो जायेगा.. ऐसे क्या किया जा सकता है, कृपया मार्गदर्शन करें..

Mera 1 consumer case mai district forum mai final hearing 1st date 8 December, 2023 tha usme bench absent fir next date 13 march, 2024 tha bench absent fir next date 12 July, 2024 tha bench busy on others work fir next date 16 July, 2024 opposite party absent fir abhi next date 28 October, 2024 consumer k liye consumer forum bana hai fir consumer ko hi sabse jyada harassment kyu ?

This is clearly either an error by the company or an intentional attempt to deceive the customer. Sir purchased an inverter and battery, was having an issue then filed a complaint to the company than i came to know that i was sold truck battery for house use which as per the company is not right snd they cannot provide the service as its not house inverter, and when i asked to retun the inverter for he says he will refund after deducting the GST i feel this is not right, what can be done?

@@akashchanda6889 No, they needed to adjust the GST for the new house battery because it was their fault for delivering the wrong battery. You should email their higher authority to raise this issue. If it is not resolved, you may send a legal notice as a consumer.

@@Rana__646 You have several options to deal with this situation. First, you may need to file a complaint with the online website that is allowing such a seller. Then, raise a complaint directly with the seller via email or any written communication. If they still don’t return your money, you may file a criminal complaint online through the police portal and also you may file a consumer case against the company and the seller as opposite party.

Discuss with the Employer First, try to resolve the issue with your employer by discussing it directly with the HR or management. 2. File a Complaint with the EPFO EPFO Grievance Portal: File a complaint on the EPFO Grievance Management System (EPFiGMS) online platform. Here’s the process: Visit EPFiGMS portal. Select “Register Grievance” and provide details such as your UAN and grievance type. You will receive an acknowledgment and a tracking number for your complaint. EPFO Office: You can also file a complaint physically by visiting the nearest EPFO Regional Office and submitting a complaint in writing. 3. Approach the Labour Commissioner If no action is taken after filing the complaint with the EPFO, you can approach the Labour Commissioner in your jurisdiction. The Labour Commissioner can take up the matter with the employer and take necessary legal action. 4. File a Case in Court If the issue persists, you may file a case in the Labour Court or Industrial Tribunal. Under Section 7A of the Employees’ Provident Funds & Miscellaneous Provisions Act, 1952, failure to contribute to the EPF is a violation, and the employer may face penalties, fines, or imprisonment. 5. @@maliktachvideo2443 You may have the option to send a legal notice to the customer requesting the return of the money, as the account where the funds were credited belongs to the customer and not to you. Also, you have all the evidence to prove that money was debited from your account and credited to customer account.

This will give you idea about consumer case in general. For example, you have purchased watch price of Rs.2000 from an online e-commerce website but they delivered you defective watch and they are not willing to accept return/refund you within warranty. First you need to email your concern/complaint to the company and if issue not resolved, then you may send “Legal Notice” to their office address via India Speedpost as a consumer. Sending the complaint/Legal Notice as consumer via email or speed post will be used as evidence that you complained about an issue which ultimately build your case against them, you may attach copies of email, invoices, photos, legal notice as supporting evidence with your consumer case. As example, Compensation valuation for consumer case, (A) Rs. 2,000 price of product; (B) Rs. 20,000 for causing mental agony, pain and suffering;(depends upon case by case) (C) Rs. 30,000 for litigation expenses for this consumer case.(Case may take years) Note: Above Values depend upon case by case. Total compensation value will be : (A) + (B) + (C) = 52,000 Recently in consumer case of Aashna Roy vs Yogesh Deveshwar, ITC (2021) national consumer commission awarded two crore as compensation to complainant for bad hair cut and medical negligence in hair treatment by Saloon. However, it’s always best to consult with an expert or lawyer to ensure compliance with current regulations.

Please search on google by typing “company name + grievance” you will find and send them email along with all evidence you have.

However, if their official website claims that they deliver to every pin code, you may have grounds for a complaint if they do not deliver to your area or pin code. I hope this clarifies the issue.

Consumer Definition: “A person who buys any goods or services for a consideration, which has been paid or promised or partly paid and partly promised, or under any system of deferred payment also includes the user with approval of such goods or beneficiary of services.” STEP NO. 1 : Email your complaint or grievance with payment proof to their customer care or company official email id or you may send written grievance via Speed-Post. Wait for Reply: If you already emailed your concern to the company and issue not resolved or they didn’t reply you or denied to Refund. Next step will be “LEGAL NOTICE AGAINST SUCH COMPANY OR FIRM. STEP NO. 2: You may send “Legal Notice” to their office address mentioned on their website via India Speed-Post or if you don’t have their address email them as a consumer. Note: Why you need to send written Complaint/Notice ? Thanks for comment If a company sends your product to the wrong location and you ultimately don’t receive the item, but the company’s records indicate that you did, this constitutes a deficiency in service and you may complaint. However, if you eventually receive the product, you typically wouldn’t have grounds for a complaint unless you suffered a loss due to the delay in delivery.
