I was convicted for trafficking stolen firearms at the age of 19 and now I’m 34 and can’t even defend myself. No more hunting, no more going out on the range and shooting for fun..it’s sad cause we’re talking 15 years ago and I’m still dealing with the consequences of my 19 year old actions

That FWC officer gave the female multiple opportunities to claim the gun which would have cleared the guy and the most that would have happened after that is they both would have gotten a ticket for fishing with a rod and reel without a fishing license. After everything, even the officer telling her a couple of times that it was legal to have a gun while fishing the officer still walked back up to her and said, "Are you sure that isn't your gun", and she still didn't catch on to what the officer was trying to do. That officer was trying his hardest to help them out of a bad situation.

The cop gave them a lifeline and they weren't smart enough to use it. A felon can be around a gun, but the problem arises when the cops make a "constructive possession" claim; meaning is it reasonable to assume the felon is able to gain possession of the firearm. For example, a married couple where the wife is a felon, but the guns are in a safe she doesn't have access to versus a couple with the husband as a felon and the wife keeps a .38 under her pillow. The former example the felon would be OK, whereas the second example the husband has constructive possession with it being readily accessible being under an unsecured pillow. Still, it is never a good idea for a felon to be near someone with a firearm. Personally, if a person has done their time and they aren't a career criminal, for example someone who made a mistake at 18 and now they're 40 years old that was their only offense, they should have their rights automatically restored. Obviously murder and violent felonies should probably be excluded in that, but someone who stole a truck to go on a joyride shouldn't lose their rights for life. If you are too dangerous to have access to ALL rights, you should be in prison for life. Anyway, just my two cents, I feel bad for the guy.
