Last week NYPD officials arrested a postal worker after the postal worker had yelled at the cops for almost running into his mail truck with their car. The cops arrested him, and now are facing consequences. Cenk Uygur, Ana Kasparian, Jamie Kennedy, and Francesca Fiorentini, hosts of The Young Turks, break it down. "Earlier this week, Police Commissioner Bill Bratton said he had “strong concerns” about the officers’ actions.
Machado and his team - Police Officers Lazo Lluka, Miguel Rodriguez and David Savella - were immediately pulled from the elite conditions unit they were assigned to, Bratton said.
“I am very interested in the charge that was made against this individual, what he was arrested for and the validity of that,” Bratton said Tuesday. “Based on what I witnessed on the various videos I've reviewed I have strong concerns about the charge against that individual."
Grays, whose fiancee is a city cop, told the News Wednesday that he wants an apology from the officers.
He agrees that they should be disciplined, but they should not lose their jobs, he said.”*

the business handler Yeah man anybody who is honestly convinced that the NYPD is a regime of white supremacists or something, or somehow equivalent to the SS, might be overlooking the fact that the NYPD is filled with minorities who are passionate about keeping crime out of their already messed up communities. You could literally put your hands behind your back, somehow handcuff yourself, walk yourself to their car and put yourself in the backseat and American cops will charge you with resisting arrest. Also, how is a charge of resisting arrest allowed to even be made when there is no other charges? If the police had no reason to arrest you then the resisting arrest charge is bogus and should immediately be dropped unless there was actual violence against the officer that can be proved outside of the word of the officer.

Odd law about postal employees and post office in general. It is a federal offense to impede their duties. He was on duty, this became a federal problem.

To "resist arrest" you have to have been charged with a crime worth being arrested for. How can you resist arrest.. When there was no warranted arrest.

+The Bunny Suit Killer It is possible to have a lawful arrest when no crime has been committed. Probable cause is all you need. "Probable cause" is a vague term on purpose. I'm not saying that is true for this case, but you don't have an absolute right to resist.

Bingo... That is the charge and they can think of some add-ons later. Example: While going about a plainclothes patrol down ____ street, we encountered a male who began yelling profanity at us and motioning violently as we passed by. Upon exiting the vehicle the male continued to yell at us and began creating a public disturbance... You get it. With 4 cops, it's even easier to get the charges to stick.

Same way as they can charge you with roadside refusal, and not give you a fair trial. I'm out 5k right now because the cop never even took me to the station like he was supposed to when I got pulled over. Even when he said that I was going to jail that night, then dropped me off at home... It's their easy way just to charge you when you haven't done anything wrong.

thats what was my main concern. the security of the mail. if that was me i would be yelling at them lock the van lock the van the mail is in there before anything else. i wouldnt have peace of mind knowing all my mail is left unlocked with no one to watch it. if anybody prevented a mailman from securing his mail and something happened to it. guess how much trouble that person would be in? this is the equivalent of that but because they had badges it was somehow irrelevant? they unlawfully kidnapped a federal employee AND delayed the mail from been delivered in a timely manner. 2 MAJOR CRIMES IN THE POSTAL WORLD..... no one goes home after that. these cops got lucky they had badges. im more disappointed in the postal union and postal inspectors for not stepping in more and making major noise. they act like big influences in the postal workforce but outside of it in the public they dont make any fuzz for their workers. we pay our monthly dues for allegiance to them and i hardly saw them standing up for the guy.

A) It's not a ranking system. States have jurisdiction over state crimes and perform state functions. Cities and Counties likewise. USPS is Federal because they handle mail across state lines. A postal worker, however, doesn't have arrest powers. On the other hand, a Federal Postal Inspector could technically detain a reckless or drunk driver until a city cop, county deputy or state trooper showed up. ICE can send a detainer request to a city police station or county jail for an undocumented arrestee, but the city or county doesn't have to hold that person for ICE. This is where the "Sanctuary City" debate comes up. If the local cops held every undocumented minor offender for ICE, they'd never get any victim/witness cooperation in Latino or Arabic communities B)There's no such phrase as "must of"...it's "must've" which is a contraction for "must have".

It's a total bullshit charge. There should be a law that states that to be charged with resisting arrest, there has to be an arrestable charge made prior to the resistance of arrest charge. Right now, police are using it on people to get their quotas when they don't have a reason to arrest them.

How could this be going on so long? All the Judges that see cases where the only charge is resisting arrest should get penalized as well. What arrest? Articulate that for me. What arrest is the person resisting? It's all about revenue. I'd love to see a class action suit over this. The cops need arrest numbers for their monthly review, there is a clear motive to set people up. They are not about reducing crime, they escalate situations so they can arrest people. Sorry...... I had to get that out my system.

Resisting arrest cannot be a singular reason for arrest. You can't arrest some one for resisting arrest, can't walk through a door without opening it first.

Cops are trained to yell "STOP RESISTING" every time they are placing a person in custody so bystanders hear them and testify in court that they heard cops yelling these words making the person in custody sound guilty even if he was not resisting. The best way to stop these cops from using this strategy is through video recording showing clearly that the person was never resisting.

Uncorrupt cops would know that they should say "it's gonna be fine" and/or "we promise we won't hurt you"...See the difference? These new sentences actually try to de-escalate the situation by trying to gain the suspect's favor, instead of commanding submission. How would you write a message to President Trump, asking him to write a bill to be passed to the Supreme Court, forcing all states to abolish charges that promote police dominance? How would you justify the abolition of these charges?

Obstruction of justice is another catch all offense that's used very often. It's no longer used for what it was meant for but just to give cops a reason to arrest where none existed.

Hey greetings from Germany. I think we don't have charges like "resisting arrest" here and the cops still do their job. And to add, even prison break isn't illegal in Germany. There was a German supreme court that ruled, that you can't make prison breaks illegal, as the urge to freedom is so substantial, that you can't make it illegal. What a different world you have over there.

And on that note, although not directly relevant, I'd like to point out another one of their ridiculous repetitive habits. Ever notice how often we see when cops will tase someone, they will start yelling at them, saying, "Put your hands behind your back, stop resisting"! They will repeat this over and over as they are holding down the trigger on the Taser gun. Like, is it not obvious that while someone is being tased, they are completely paralyzed and unable to follow these commands being shouted at them? So what's the result? Tase then again and repeat the whole process! Pathetic, for lack of a better word!

How stupid for a cop to mess with a federal employee while working on job. 🙄 Postal inspector are above regular street cop and if you mess with the mail or its employees and hold up federal mail. You are going to feel the wrath of god.. Mail must be sorted and delivered. Post are given special protection from them being stored for simple infractions or messes with because they are a delivering federal mail.

It was not a police cruiser, as you state, it was an unmarked car and the cops were not in uniform. These cops need to be prosecuted by the USDOJ for the various federal crimes they committed, including 18 U.S. Code § 1708 - Theft or receipt of stolen mail matter gen­erally and 18 U.S. Code § 1701 - Obstruction of mails generally. They committed federal crimes while on duty and administrative punishment is not enough. Like the rest of us who commit crimes, they need to face the criminal justice system.

It is for the prosecutor to decide if there is evidence to fo to trial. For example it may be revealed that the guy is actually innocent. Under your system they'd have to charge him anyway.

I think what they mean is not never as that's an absolute but highly unlikely for the average person. Yes it's legal but bad cops (notice not all cops) do so much illegal crap everyday it becomes the norm and generally accepted. I'm still wondering how NY gets away with their "stop and frisk" policy which is blatantly against our protection from unreasonable search and seizure. Somehow they have though and it's just business as usual in the city. When properly applied laws work, unfortunately they rarely are.

You're extremely dishonest. The case you cite was an incident in 1893 in which a cop beat and shot a suspect without telling the suspect he was under arrest. Then the suspect shot and killed the cop during the scuffle. The suspect was charged with manslaughter but was acquitted, and now cops have to make sure they tell suspects that they're being arrested.

Those policeman should face federal criminal charges for their interference of the mail. That worker is a representative of the Post-Master General and as such obligated by contract to complete his assigned route regardless of rain, snow , sleet and hail. The unauthorized stoppage and falsified arrest now makes the officers involved in that false arrest liable for every piece of mail left unsecured on his truck. The officers also forced the postal service to re-route other carriers some on paid over-time to assist in the completing the remainder of the route affected by his false arrest. The officers involved with the false arrest each would have had to complete a "Use Of Force Report" as well as an "Officer's Report" which would explain their actions in the apprehension and since already know that the arrest was false and its arrest report a complete fabrication; then in accordance with what a prudent could conclude from this incident, then that means the "Use Of Force Reports" were also fabrications because they must reflect all pertinent psychical action prior to the point of detainment. Which strikes at the very core of the most damming issue for each and every policeman involved in that arrest and that being "Truthfulness At All Times", which every officer who wears the badge must adhere to in the performance of duty. The truthfulness if violated is punishable by termination from the department. Based on that finding every officer who wrote their report in support of the arrest is now subject to being terminated for fabricating their reports in accordance with policy and procedures of the department.

How can resisting arrest be the only charge? Don't the police have to be arresting you for something, in order for you to resist? Do they just walk up to people and say, you're under arrest for resisting arrest? The fact that they didn't have an initial charge should have been proof he was arrested unjustly. They were just trying to make his day tough , as the police say when they arrest someone and know the charges won't stick, it's all about the ride. It's all about taking people in, getting their picture and prints on file and just inconveniencing them for a few hours. This was a clear case of police egos out of control, they're just street thugs with badges.

First, you have to be under arrest for SOMETHING to be resisting arrest. Resisting arrest is a SECONDARY charge, not a primary charge. Screw the union and benevolent associations. The Post Master General of the United States needs to start a postal investigation on all 4 cops. They interfered with the delivery of the US Mail. All 4 need to spend time in a Federal Pen. Period.

+jmtnvalley While I agree with ur sentiment overall, In this case I think the mailman was offering some resistance to arrest, although slight, and only because he truly felt like he committed no crime, which he didnt. In the overwhelming majority of instances, say, for an average citizen, resisting even slightly will evoke an instant cry of "STOP RESISTING" , and once they say that, and have hold of you, they know they can make it seem as if you are resisting with all your might........ My advice for all people is to save the fight for court (which sucks but better than a bunk resisting charge).
