Great video, thank you so much for posting, i am about to bring my claim to a Final Hearing (in UK) in just a few weeks time ! Q :: Am i allowed to ask questions of their witnesses about things that aren't mentioned in any witness statement? ... Reason for my question; i have to exchange witness statements before final hearing, and don't want to tip them off about my strategy in trying to get them to admit to something vitally important.
Watch my other video on witnesses there's some great tips in there about exchange day. No you can ask them anything but remember if you chose not to query something in their witness statement that you disagree with, that tells the judge you don't disagree or have a problem with that bit, so make sure you check the whole statement when you get it and are ready to query anything in there that is wrong. My manager has purposefully left out major events in his witness statement. Can I still ask questions based on documents in the bundle, but that have been left out of his witness statement? Sorry for so many questions 🙋♀️
Of course you can. You generally follow the statement but you can ask anything you like. What you cant do is re-examine your own witnesses after they've been examined and ask them about something the other side didn't ask. Please do let me know how you get on!
Hi 👋. You'd need to make sure the versions you have are included in the bundle. The judge will then see both and you can add the details about why you believe their document is falsified in your own witness statement.

I’m back watching again, but was wondering, do you question them from their witness statements as well as the bundle? Also do their solicitors question them, other than to re-examine?
So to start with you question them, then they can be reexamined. That's it. You question them on their witness statement, not the bundle. But you (and they) can refer to any items in the bundle and you can ask them things that aren't mentioned in their statement, however unless you ask them about something else they can't start bringing up things not in their statement and any Re-examination can only cover topics YOU raised, not anything else (even if it's in their witness statement)
If it is your witness, you ask them to write a statement which is then submitted to the otherside by the agreed date. If it is a witness from the other side, you get the witness statement from the respondent at the agreed date. The agreed date comes from the tribunal. Good luck!!

How many questions should be in cross examination? A 3 pages of witness statement came up like 156 questions!? Is that a lot? Because you have to break questions into small questions?
Its easy to gey bogged down in details and dwel on all the wrong things. You want to keep cross examination efficient and to the point. The panel don't care much about the ins and outs or proving people wrong about minor points. Focus on A) what you need to get them to say and B) how to get them to say it. If cross examination goes on too long you might lose the panels attention (if it gets boring!) Or worse, run out of time and go "part heard" having to wait possibly months to pick it all back up again.
@Been There Done That do the other side ask questions on every paragraph on the witness statement? Possibly few hours questioning in constructive unfair dismissal and discrimination?
They will cross examine for a long time as the claimant is the main witness. They will ask questions to clarify, challenge and sometimes to just annoy! But they don't necessarily cover every paragraph and they might also ask about things you didn't put in your statement
@Been There Done That right, what about things is not in the statement, such ? But It must be relevant to the case only, isn't it? Also, I guess you have to spot your own objection and object it isn't it ?
They can ask anything they think is relevant. If you are unsure whether they were allowed to ask something just ask the judge before you answer. So just say "excuse me Sir/Madam is this line of questioning allowed?" If you ever feel uncomfortable with what they are asking you
While the content is good, I find the editing style of these videos difficult. It's a sensory attack to have random club music transitions and layers of mostly purposeless animated images appearing as you speak. It would be better if you had bullet point text overlays of the key points you're making in each section.
