Only just come across this video and wish I knew the little tip about exchanging statements a few years ago. The other side had my statement for weeks before giving us their witness statements!!!
Great video. very informative.. I have a question. what if I have obtained excellent witness statements from the grievance process. The names of the witnesses have been blanked out. Will there be a need to call upon them as a witness in the tribunal process? I have tye evidence i need on those documents.
It's up to you who you want to present as a witness but if you plan to rely heavily on their pre existing statements it would be handy to have them be part of the tribunal if they are willing to be
Hello Dear, can I ask you if you know if for example after the whole case ended, is there any trigger point that for example the other side might try to sue you for example suing you for I don't know, like for bringing a case against them, disclosing information about them and came to public like the final hearing it is for the public to see and so on.. I mean, do you know if there is anything they could come back to you as, let's say, reverenge or vingance? Xxx
What if there was covert call recordings from witness statements from employees who have left? Could I still use as evidence if they don’t want to attend?
Covert recordings are a bad idea. It demonstrates a wish to obtain information unfairly and it doesn't reflect well on your character. The truth is your best weapon so get as much evidence as you can without relying on these sorts of things
Are there any issues if an employee has no witness? To be witnesses not willing to attend because they still work there. However, they're interviewed by the employer during the grievance investigation, so they said I could present answers they gave when they were interviewed. The thing is, in the respondent's statement of resistance, there are many misrepresented facts I need witnesses to back me up as I dispute those untrue points in ETA3 during the hearing
