Exactly. Her argument is ridiculous. I am not sure how insurance works in the US, but the driver is usually insured, not the vehicle. Therefore, would she have even been covered by his policy. Sorry, thinking out loud here.

@@Reizermo Insurance follows the vehicle in the states.. If the policy doesn't allow for permissive use. And she is not on the policy the claim can be denied. Most good insurance companies allow it.. Cut rate companies don't. -- Sincerely, a guy that works in insurance.

Calling the Police might work in the short term but believe it or not, I think there's a good chance she has a better legal claim to the vehicle than Larry! The primary requirements to satisfy a judicially enforceable gift are (especially straightforward in a unconditional gift situation like here): 1. Intention of donor to give the gift to the donee. 2. Delivery of gift to donee. 3. Acceptance of gift by donee. See: en.wikipedia.org/wiki/Gift_(law) It's pretty clear everything required is satisfied here. Larry regretting his decision doesn't mean that she couldn't enforce her equitable claim to it in court if required and force the transference of the vehicle's legal title to her.

Larry gave his car to his employee with good intention not knowing that just 15 minutes later she would carelessly wreck it. If it had happened a week later she might have a case. Of course the Judge's job is to interpret the letter of the law so you are probably correct.

What you sold the car for would only come into it if you sold it for more than $28,500, then you'd need to declare capital gains - ie, you couldn't sell the car to a friend for $5 and declare only $5 income. The ultimate tax paid would depend on your income tax bracket.
