It seems my ebike isnt listed as either I, II or III. My ebike is pedal assist AND has a throttle AND does 28 mph. With class III being 28 mph and pedal assist only what would my bike be classified as?

Is your bike an after market bike? Or was it purchased 2nd hand? It sound like you have a Class II bike. However, clever people out there can “unlock” the MPH limiting safety cutoff features of a class II and make a class II throttle travel up to 28mph like a class III. If that’s the case, you will have to stick to on street bike lanes or shared bikeways. You can’t ride your bike on a separated bike path. If you do you will risk getting penalized
