Cyclist - v - Motorists, an impasse.
All has now become clear, not disclosed in the original Documents: -
The cyclist clearly informed TVP, of a ‘close pass’ by the white van driver but not the black car driver.
However, TVP said: - “ In order to bring a prosecution for any offence in the Magistrates’ Court there has to be sufficient evidence to provide a realistic prospect of a conviction, the evidence burden of proof being beyond doubt ‘On this occasion that standard is not met”.
I cannot see how evidence of the measured distance can ever be provided, with all accusations based upon subjective opinions. In the judgment of the white van driver, there was sufficient passing distance.
It is no longer possible for cyclists and motorists to share the UK highways (carriageway) with the new Highway Code (211 - 215 - ‘passing cyclists’). It is not possible to pass cyclists with at least 1.5 metres distance (30 MPH) when cyclists (single or two abreast) can position themselves anywhere on the carriageway.
It will also be necessary for vehicles to stop if they are approaching cyclists from the opposite, direction on ‘B’ Class and minor roads, where 1.5+ metres of space is not possible.
“leave at least 1.5 metres when overtaking cyclists at speeds of up to 30mph, and give them more space when overtaking at higher speeds”
Is this the new passing cyclists’ Code?: - 1 metre at 20 MPH; 1.50 metres at 30 MPH; 2.00 metres at 40 MPH; 2.50 metres at 50 MPH and 3.00 metres at 60 MPH (National Speed limit).
