I was on a jury one time. Lady judge said “We are leaving today at 4:30.” She repeated herself about 3x. So I’m bored to tears and I see the clock says 4:30. The plaintiffs lawyer is talking and talking and talking. I’m thinking to myself this ain’t good. All of a sudden the lawyer pauses mid sentence and the judge jumps up “Court is adjourned see u tomorrow” And walks out. I almost died
Back in the early days of twitter you could actually send a text to a number which would send that text out as a tweet. But that was years ago. Like around 2009. There’s absolutely no way anyone could mistake a text as a tweet these days.
The lady obviously has something wrong with her throat, I have bad allergies every Spring and I can barely talk at all, it's sad that people have to pick on others over something so trivial and they have no idea what she is going through. What if she had surgery done on her vocal cords and they're in the process of healing? geez, give her a break.

I was born in the 1960's--- I'm reading these comments like it's a third language-- I understand much of it-- except for some major words I have only a vague understanding of-- tweets, twitters, DM, Instagram, texts, etc..... WOW! I know about texts. Back in the day we'd use paper, pen, and postage stamps. STILL--. in courtrooms neiterthe DA ,bor pretty much ANYONE would be whipping out pen& paper-- or really ANY method of communication cycle extraneous to that SINGLE cycle that IS happening up front, that IS "court in session.". Furthermore we did not read novels in church, etc, MANNERS, ETIQUETTE , SOCIAL GRACES. --and, in court we add what one gentleman asserted in earlier comment: MORALÐICAL OBLIGATION TO PAY UNDIVIDED ATTENTION
That's not what the DA said. He said something to the effect of, "I got a Twitter notification but mistook it for a Twitter DM or SMS notification and responded to it as such."
In 26 years of practice I never felt it that pressing to text during court. It is contempt. It shows disrespect for the client and the other participants in the pending matter. Ego takes over.
I can't believe the judge bought his excuse that he was sending a text. Who was his intended target of the text? Sending a text vs sending a tweet look completely different so it's impossible to confuse the two. It sounds like the judge doesn't text or tweet.
That was the most lame excuse I ever heard, honestly he probably didn't want to stir up more trouble and just let him get away with it just once since in the grand scheme of things sometimes it's best to let things go when you have bigger fish to fry.
PS just a moron of a judge to believe what the DA said. The DA tried to influence the minds of the jury. Which is highly unethical and borderline criminal. Everyone who knows how twitter works knows what the DA said doesn’t make a lick of sense. You’d have to be blind in one eye to not notice you’re tweeting compared to “texting.” The screens don’t even remotely look the same. Even if it was a DM. The format of how a tweet is published isn’t remotely similar to a texting format. Though it’s probably not provable it’s Atleast grounds to be highly suspicious of misconduct.

Defense does not need to go on for 20 minutes sounding like they are on the brink of tears (for whatever reason that is irrelevant to the discussion). All they have to say is "Judge- prosecution violated an order" and that is it.

Have to agree. The DA's job is to try the case not playing with phone. Note that while the judge is giving his ruling there two people typing on their laptops instead of listening to the judge.
In the US, there was a case where a judge cited the entire courtroom for contempt of court, because someone's phone kept ringing and no one would fess up that it was them. So, one of the lawyers present created the android/ios app "locale" that lets you change settings based on (among other things) your GPS location. That way, he could always ensure that he wouldn't be the one getting in trouble, what with how often he went to the courthouse.
"I received a text via direct message." He literally excuses himself of not being on social media by using terms for Twitters message and saying he was viewing and responding to that message. I have never heard of a person refer to texts as "by direct message". Like the fuck.

It seemed funny until I read the description and figured out which case it was about. Could you imagine the public uproar if the Aurora shooter got acquitted on a technicality because of a prosecutor not paying attention to the rules? This time it's just a text/tweet but the general attitude of indifference to the rules could have serious repercussions.
My nephew was one of the EMTs who responded to the scene. I'm sure he'd be pissed seeing how the DA is so focused on the trial. At work, even though I have my phone I don't respond to telephone calls, voicemails, emails., texts, twitters, pigeons, smoke signals, or morse code. I'm at work for one reason.
Just the fact that the Judge even had to tell the attorneys not to Tweet during a major trial like this shows how lacking in common sense and decency our society has become.
The judge must not know how things work. You can't think you are sending a private text on a phone and it accidentally goes to twitter. He knew what he was doing.
It's really sad time in our lives that ppl want attention SOOOOOO bad that they'll risk it all in order to get it. He got more than what he asked for as far as attention goes.

Council needs to be confident in their words when they are speaking before the court- especially as the judge said, when each side has FIVE of them present. There is a standard of conduct in court- this is not a witness recalling the death of a loved one, this is an attorney talking about a tweet that was sent out.

A lot of people talking crap about this lady when they're sitting at home with no degree, no life, and no ability to comprehend the importance of paying attention when court is in session. These same people would be the ones to tweet during court proceedings if they could even possibly make it through law school.
Imagine a force so great it can cause the most professional of men to intentionally break the rules in an attempt to get attention and validation from a mindless public.. That force is social media. Doctors, lawyers, judges, dentists, police, scientists, politicians, directors, teachers, musicians and so on. None seem to be free from this menacing force, constantly pressuring them to reveal even the most sacred things. Look what only fans has done to women, Turned them into a subscription service... Social media has the potential do serve humanity in great ways. But as long as immorality is rewarded it cannot. It can only accelerate the destruction and degradation of society. As it has. The decline in morality matches the advance in public technology.. Man really loves the darkness doesn't he..? Everything is a tool for filth.
That force is "emotion and desire", and it guides our thoughts, actions, behaviour, beliefs; basically everything we are and do and why and how. You can't be free of emotion OR have complete control over your emotions, and it's dangerous to seriously attain that, wish for it or view people in this way. You shouldn't want anyone to be free from emotion and i always avoid using the word "should" but in this case i absolutely will. Emotions are not switches we can flick on or off, it's doesn't work that way and it would be immoral to intentionally make yourself joyless, reckless, uncaring, dispassionate, non-responsive to emotion ect. It's not the fault of how social media or technology is used, it just shows what human beings are vulnerable to. I personally think "the manipulation of people emotions to intentionally create/encourage a desired behaviour" can be unethical and egregious, and for that reason i hate it so i side with you, but i don't hate what it's like to be a human being; the manifold of Human experience. I suggest you try not to harbour negativity or hate, disgust, denial, aversion towards the very things that make human beings what they are, lest you risk develop those beliefs and make decisions based on them. You mentioned "the sacred, immorality, morality" which seems to me like you have some kind of religious rule based perspective about human behaviour, rather than observational.
