A police officer arrested two innocent children at gunpoint. Now they are asking the Supreme Court to hold the officer accountable.
A court said the Fourth Amendment’s protection against unwarranted arrests is “hazy.” Now, with IJ’s help, a family is asking the U.S. Supreme Court to clear the haze and rein in police’s ability to arrest someone for no reason.

Rarely a day goes by that Americans don’t hear news of police wrongfully arresting someone. In many ways, Americans have grown numb to the fact that police and other government officials routinely violate our Fourth Amendment rights. But today, an Arkansas family working with the Institute for Justice (IJ), a nonprofit public interest law firm, has asked the United States Supreme Court to reaffirm one of this country’s most important founding principles: that when government officials violate our constitutional rights, citizens can hold them accountable in court.
The case started in January 2018, when Haden and Weston Young-two boys, aged 12 and 14-were heading home from their grandparents’ house after a family dinner. As they approached their home, a police car came around the corner with its lights on. The car stopped and the officer emerged with his gun drawn. He had no reason to believe that two boys who were walking calmly toward his car posed any threat. And yet, within moments, the officer-who was looking for two grown men who’d fled from police earlier-shouted “get on the ground,” handcuffed the boys, and held them at gunpoint.
The boys’ mom, Casondra “Cassi” Pollreis, watched the scene unfold from her front yard. She rushed to the scene and pleaded with the officer, “They are my boys!” The officer ignored her pleas, pointed his Taser at her and shouted to get back inside. For six terrifying minutes the boys lay face down on a sidewalk while the officer paced around them with his gun pointed at their backs. Eventually the officer’s sergeant arrived, assessed the scene, immediately realized a mistake had been made and let the boys go. The officer got back in his car, closed the door, and said to himself “duuummb.” He knew that what he did was wrong.
The incident didn’t end that night. Cassi and the boys talked with a lawyer and decided to file a federal civil rights lawsuit against the officer for making a wrongful arrest. The district court agreed and found that the officer had violated the boys’ Fourth Amendment rights, writing that “handcuffing two boys laying facedown on the ground, at gunpoint,” was “more intrusive than necessary.” But the 8th U.S. Circuit Court of Appeals, in a divided opinion, found that the boys had never been “arrested” at all. Instead, it said that what constitutes an arrest “can be hazy,” and that the officer’s conduct did not violate the Fourth Amendment.
Now, with the help of IJ, Cassi and her boys have asked the United States Supreme Court to take up their case. Today they filed a Petition for Certiorari asking the Court to rein in the ever-expanding doctrine of “stop and frisk” and make clear that the Fourth Amendment protects citizens from being arrested without probable cause.
“Through silence and inaction, the Supreme Court has allowed the doctrine of ‘stop and frisk’ to morph into ‘stop, drop, handcuff, and hold at gunpoint,’” said IJ Senior Attorney Robert McNamara. “As the number of involuntary encounters between citizens and government officials has soared in recent decades, the rules protecting citizens from abuse in those encounters have withered. The Fourth Amendment is not ‘hazy’ when it comes to our basic right to go about our business without being assaulted by government agents who’ve lost their cool.”
At issue in the case is what is called a “Terry stop,” which is named after a 1968 Supreme Court case called Terry v. Ohio. In Terry, the Supreme Court held that police officers had a “narrow authority” to briefly detain someone without probable cause and pat them down to ensure they aren’t carrying any weapons-but that’s all. Since then, many federal courts-like the Eighth Circuit in this case-have broadened Terry’s authority to include highly intrusive, sometimes violent law enforcement conduct as constitutionally permissible. At the same time, other courts have reined in the practice.
Today’s petition is part of the Institute for Justice’s mission to fight on behalf of those individuals who are denied their rights and to hold government officials accountable for their unconstitutional actions. IJ stands up for ordinary American’s Fourth Amendment rights to be secure in their both their property and persons. Most recently, IJ filed a lawsuit in Ohio to stop “whenever, wherever” business inspections. IJ has also filed lawsuits across the country standing up for tenants’ right to be free from warrantless home inspections.

Sucks none of them had a gun to legally shoot the cop. Supreme court ruled it's legal to resist false arrest, here are also some current events. "Citizens may resist unlawful arrest to the point of taking an arresting officer's life if necessary.” Plummer v. State, 136 Ind. 306. This premise was upheld by the Supreme Court of the United States in the case: John Bad Elk v. U.S.,177 U.S. 529. The Court stated: “Where the officer is killed in the course of the disorder which naturally accompanies an attempted arrest that is resisted, the law looks with very different eyes upon the transaction, when the officer had the right to make the arrest, from what it does if the officer had no right. What may be murder in the first case might be nothing more than manslaughter in the other, or the facts might show that no offense had been committed.” Ray Rosas a hispanic man shot 3 of them, legally. "CORPUS CHRISTI, Texas - A Nueces County jury that acquitted a man who shot Corpus Christi police officers executing a raid on his home said a “botched” operation and contradicting testimony led to their decision." Henry Magee killed one as well. "DALLAS - A Central Texas man who shot and killed a sheriff's deputy entering his home will not be charged with capital murder, attorneys said Thursday. A local grand jury declined Wednesday to indict Henry Goedrich Magee for the Dec. 19 death of Burleson County Sgt. Adam Sowders, who was part of a group of investigators executing a search warrant for Magee's rural home." Jessie Murray a black man also has killed one... "Murray’s account of what happened during a 2014 bar fight was that Forest Park police Officer Nathan Adams jumped Murray and Murray accidentally shot and killed Adams. " Unnamed man shoots two cops. "Two Maryland police officers were shot while serving a drug-related search warrant at the wrong apartment late Wednesday, according to law enforcement officials. The resident shot the officers as soon as they opened the door, thinking they were home invaders, authorities said. It’s a total vindication," said DeRossett’s Orlando-based attorney, Michael Panella."

@@commenter7893 Thanks, hope no one who reads my comment above ever has to use it, as while legal, doesn't always mean you will win, like the Tuttle couple who legally shot at cops who illegally raided their home, but ended up being killed, while the cops are going to jail for it, the couple still isnt alive.

This happened to a friend and I in the early 90s, we were 16. Walked out of a store and was met with a city cop pointing his handgun at us, while screaming like a crazy person. He checked our school IDs and let us go, no explanation. Zero trust since then.

Yup. Same shit here. 96, i think, coming out of 711, had a cop with his gun out pointing at us as we walked out of the store and forced us on the ground. Apparently they were looking for some mid-30 year olds, both with short brown hair and we were 15 and 16 at the time, i was bald and my buddy had super long grunge hair, so clearly we fit the description. I was with the same buddy and we were walking in an area that we didnt live in, i forgot how we ended up there. But it was a fairly rich area. One of the people who owned a house, walked out and screamed that we don't belong there and needed to leave and we ignored them. Public sidewalks are just that, public. But i guess he called the cops and the cops came, threw us in his car and then dropped us off downtown. He didnt even ask us questions or anything like whats in this video. He just stopped his car, opened the back door, grabbed both of us threw us in. That was the extent of our stop. On the way downtown he just kept saying we didnt belong there and could not be there, if we went back, we'd be arrested.

Something similar happened to me in the early 90s. There was no gun pulled on me, but as I was walking through a parking lot where I worked to get to my vehicle, a car approached from behind me, got about 3 feet to my left and then locked down the brakes and skidded to a stop. Obviously startled by this I quickly moved to my right, looked to my left and saw that it was a cop. He got out of his car and detained me because I looked startled and moved like I was trying to avoid him just because he was a cop. There’s no doubt that he did what he did just to get a reaction out of me simply to justify detaining a teenager. I sometimes think the late 80s and early 90s were where cops started being rogue agents of the state, but it’s probably more likely that it was before then and I just simply started noticing because I was a teenager and an easy target for police to bully. Until then I had no experience with police.

I had that happen to me once too but I gave him my ID and he took off looking f ran escapee that I saw on TV news later that day. He thought I looked just like the guy and I could tell he was ready to attack me but he asked for ID instead. I just gave it to him easy. I am not so sure I would do that now,

Cops are out of control, I'm 60 now but will always remember my first encounter with them. I was just a kid and this happened in the mid 70's, had 2 paper routes and was making my own money, bought my mom a cookie jar for Christmas along with a model for myself. Got half way home, just up the street from my house when they jacked me up, told me to drop the bag and demanded to see receipts for the stuff in the bag or he would take it as stolen and run me in. I'll remember the words forever..."Stop kid, you better show me the receipts for that stuff or I'm arresting you for stolen property", I was 14 years old.

The cop is also a fool. If these people were such a threat, then he should have never gotten out of his police car. Just stay in the car and follow them from a safe distance. Just take it slow until he has more information and/or backup arrives so he can act politely and rationally instead of being so afraid that he ends up assaulting a couple kids and their mother.

If you're talking about law enforcement employees individually than thousands of times per day is way over the top. An individual police officer probably doesn't violate people's rights more than a thousand times a month. If you're talking about law enforcement employees as a whole, there are over 800,000 law enforcement employees in the USA. If each one violate somebody's rights an average of once a day, which would probably be a huge underestimation, that would be hundreds of thousands of violations per day. Police training is terrible to be sure but the bigger problem is the initial screening process. Good people with poor training is much better than good training with bad people. Too often today we have bad people being poorly trained. The blue line of douchebaggery earning the hate everyday.

The SP accepts 100 to 150 of the 7000 cases they are asked to hear each year. thats roughly 1.5 to 2 %. The federal courts have repeatedly let us down by refusing to hold Police accountable, and sadly have permitted further erosion of rights.

@JasonRector-nd4li pulled me and two friends over. Helicopter, closed street, guns, and lights pointed at us. They were looking for three people in a blue minivan who robbed a liquor store. We were laid flat in the middle of a blvd and rushed by several cops with knees on my back. They eventually let us go once we were checked out. This was only one event.

This family never was and never will be on the cop's side... Suing them over a simple mistake? Na, this family is just has the "sue everybody" mentality when something slightly goes wrong. It was at night and there was a call about some criminals on foot in the neighborhood... Of course the family and the two young men didn't know that but the cops acted in the right here considering what was going on.

I could not sit still in my seat watching those kids get treated that way. And when he told the mother to leave her children alone in the dark with him my stomach just rolled. That this mother held her composure is quite to her credit. What a violation of rights, and of trust in the authorities, this is! May this family prevail mightily.

My boyfrind and I were once pulled over while coming out of McDonald's drive thru. They said they "smell marijuana" and wanted to perform a search. Well they tore apart my car and dunked both our cell phones in our fountain drink cups. Never trusted cops ever since.

I’m not pro riot, but nothing has been done without them. When I was a teen I had two officers kidnap me and two of my friends. We were just walking from our neighborhood to a friends house. They held us for over an hour until we were past curfew. Then unlawfully charged us. They also harrassed us during the unwarranted kidnapping. Sadly many cops are just dirty and or power hungry. I've also had two officers mouth off to me at a check point because I had a nice vehicle and was young. I told them both off within reason. The one officer threatened to murder me and pointed to the alleyway across the street. The way many officers act are horrible. They are not all bad but it only takes one to kill you and get away with it.

Just remember once the gun is pointed, you are literally one breath away from a lethal outcome. And in today's climate there would be almost no accountability. Man in a hotel hallway was on his stomach, unarmed. He was ordered to crawl towards the officers. As he attempted to comply his shorts began to slide off his body. While sobbing for the officers not to shoot him, he reaches back to pull his shorts up. The officers sprayed an unarmed man with several rounds killing him. There was no accountability.

Qualified Immunity has trumped the Constitution. The USSC has said that cops are immune from personally being liable unless "they know what they are doing is in violation of the law." Now on it's face, you'd think that would be more than enough. But you'd be wrong, because what the court has also said that "the cops don't have to rely on the law or even their own understanding of the law, but only the law AS ADJUDICATED and survived the appeals process" (paraphrasing/summarizing cases) is what matters. Furthermore the USSC has repeatedly denied these cases because (and I kid you not) "the exact circumstances of this case has never been properly adjudicated before, so we can't hold the police to the standard." It's a catch 22. They will never take a case to establish the "case" because there has never been a case like it before. If you don't believe me, watch Steve Lehto's videos on this. He has a lot and it explains it very well.

It is estimated that by the end of next legislation session New Mexico will reinstate qualified immunity and it has been stated that if and when Jared Polis’s term has ended in Colorado it will be overturned and lifted and reinstated there as well. And no, there is far more at hands than only knowing what they do is a violation of the law to retract QI privileges from any government official. You’re yet another person who has no clue what qualified immunity is which most of the general public do not. You’re repeating the same garble that has been uttered a thousand times before thats still incorrect. Yeah of all the idiots that this bad information has passed through those idiots are proven to be dumb figuring of all the thousands of idiots it’s passed through it still hasn’t been corrected by any of them. 🥴 Both Trump AND Joe Biden, Republican and Democrat thoroughly explained qualified immunity and both of them uttered the same words in regards to it. It is not a mysterious free-for-all cloak that shields police from whatever they want to do and never has been. Too many law enforcement officers are not qualified to be in their position, I have personally experienced the rights violators multiple times since I was a 12 year old in Texas, if a person isn't intelligent enough to determine the difference between children and adults, they should be terminated from employment as they are a Danger to the public at large.

Cops have been killed by 12/14 year olds. How many school shootings were done by kids that young? There is an ongoing case down here in FL where a 14 year old stabbed a 13 year old 114 times, and when she realized her little cretin did it tried to help him by washing the 13 year old girls blood out of his jeans. So parents can't be trusted either, to do the right thing. Now I would want to know what the persons did that the police were looking for them. Were they looking for kids or young adults? That officer was concentrating on his "possible" threat in front of him and the Mother is coming up from behind him. Parents have attacked police when attempting to arrest their kids, wives have jumped police when they try to arrest their husbands for pummeling them, etc... From what I can see in the video it appears these boys appear bigger than most 12/14 year olds, coupled with it being at night, wearing bulky jackets, etc.

I was with 2 other friends once walking home about 1 mile from a party. We were all intoxicated, I had a full bottle of liquor with me in my hand (I think it had already been cracked open too). One of the friends had no ID on him, the other did but was under 21. We were stopped by a squad car because there had been reports of a small group trying to break into cars into the area. None of us were handcuffed or felt threatened in any way. No guns or tasers were drawn, they just asked us some questions and got a feel for what the situation we were in rather than the situation they were looking for. They asked us how the party was, were asking me where I got my tattoo done and how far we were going. Every single person on the scene was relaxed and forthcoming (hence why I knew what they were actually looking for) and we parted ways and I will always remember the last thing that officer said to me.. "Enjoy the rum" It's been over 10 years and I still remember nearly every part of the encounter because it stood out to me... It was good police work.

Turning away a case is a decision in itself. Its not feasible, or even desirable, for every case to be heard by a higher court. Otherwise, why wouldn't everyone just appeal every case all the way up to SCOTUS? Even something even as trivial as a $10 fine all the way to the supreme court?

The supreme court was originally set up to make sure the constitution was the guide lines in which all government agencies adhered to but all that change when America became a federal corporation after the first world war.

How does “what are you guys doing” even begin to go with “turn away from me”? The COWARDICE displayed by today’s law enforcement is absurd. Training cops to believe that ‘every citizen is a threat/want to kill cops’ is the root of the problem. That and the insane ego most cops have. Where not either instantly responding (because you’ve done nothing wrong so you are confused) or instantly turning around (again... ‘is the cop even talking to me?’), is perceived as a threat or failure to follow commands. Which typically makes the cowardly ego driven cop MORE hostile. I blame the academy and the unions. They are the ones promoting this animosity towards citizens.

This sort of thing comes from the "us versus them" mentality. When I was a child my mother was stopped by an officer for having a taillight out. The officer was courteous and when my mom asked if she could look at the light the officer replied "certainly, ma'am" when she opened the door he held it for her, she looked at the light, told the officer that she would tell my dad when she got home and he held the door for her to get back in the car told her thank you and then used his cruiser to block traffic briefly so she could pull into traffic safely and waved as we left. What happened to calm, cool, collected, professional police officers?

This is terrifying to know that I am held to a higher standard on a battlefield where I know everyone hates me and my team and I have to remain calm, not point my weapon at anyone (unless actually threatened) and idiots like this guy is ready to kill an innocent young boy. Let b me explain... Any time that weapon is in your hands it has the potential to go off, either deliberate or accidental. This cop is obvious nervous, by the sound of his voice and actions. He didn't observe, or wait for backup, in fact probably didn't do so until after he had them on the ground. He gets out as soon as he sees the boys, draws his gun and points at them. He then yells, and that is dangerous. By placing stress on one part of your body it puts more stres somewhere else on the body. When a gun is held out away from your body and you yell that stress moves from you head to your hands. And that is where a higher chance of his gun going off happens. I wonder if those boys started running if he would have fired, either deliberately accidentally it doesn't matter the results are the same. Two innocent boys, scared by an ill trained cop, runs, and gets shot in the back. Yes, the supreme court needs to revisit the Terry Stop, and police chiefs/academies across the nation need to rethink their training. In fact get a seasoned infantry NCO/Officer to teach the proper way of handling a situation without escalation.

Well written! I don't so much have an issue with Terry, as much as I do with tge lack of proper training and mental health awareness of the officers who use them. Obviously this cop was both nervous and pumped on adrenaline, and he also went for his weapon dispite being a terry stop, not an arrest , and the boys were complying. A proper trained officer would have done far better and would have not drawn a weapon on children who were complying at all times without the firearm or threats.

Even if they were men, this would still be wrong. Odds are that among a pair of any two random guys, one would be taller than the other. Is the cop going to stop all pairs of guys of different heights at gunpoint until he finds his true suspects? Completely ridiculous.

I finally got my learning permit to drive at 15 and 6 month so I would be ready to get my drivers license at 16 here in Ohio. My dad found me an old rusty S10 pickup 5 speed. My first time driving the truck I stayed off the main roads as I was still figuring out how to take off without stalling or rolling backwards. So about 20 minutes driving around I happen to notice a cop at the intersection I'm passing. Dad says don't work about him keep driving We wasn't speeding I used blinkers every turn etc Went a few blocks then turned and noticed 2 more cops but kept driving wondering why the heck all these cops are around. Next intersection 2 more cops. Next intersection 3 cops and they box me in and jump out guns pointed at me. A 15 year old on his first drive of his manual transmission truck. A cop nearly ended up on my hood as I was trying to stop and in the instant I still wasn't sure how to turn off the truck without it moving as until that point I've only stalled the truck. I had about 8 guns pointed at me. They yanked us out cuffed us and started asking about hand grenades and bazookas I think trying to make light of the situation clearly we wasn't some terrorist. My dad is being shoved against my truck even tho its clear this was a witch hunt. He slips on some ice and they start screaming like he is resisting when he is surrounded by a dozen cops. I'm crying and the chief is holding my arm and he turns to me and asks why I'm crying and he yells something and we are let go and they vanish. 1 cop follows us home about 5 blocks away. That was around 2000. I wish I knew I had a lawsuit.

In about 2010-2011 me and my friend (we were 14 or 15 years old at the time) were snuck up on by a Parker county, Texas Sheriff in plain clothes with his gun pointed at us... all because we were shooting a bb gun into a 100+ acre pasture away from any houses. It was very obviously a toy gun and he could clearly see it was as he approached us from our side. He had a good 250 yards with a completely unobstructed line of sight as he walked down the street to us from his house. His justification was that his 5 year old daughter playing in the front yard (250ish yards away) said someone was holding a gun down the street. He then continued to hold us at gunpoint and harassed us for 15 minutes about how we were breaking the law and that he could arrest us if we didn't go back inside our house. I still get furious thinking back to that happening to me and wish I knew what I know now and didn't just let his behavior go without any consequence.

Happened to my brother and myself in 70’s after police were looking for 2 individuals who had assaulted a State Trooper… to put it mildly it was interesting and intense. But while we were being questioned, a radio transmission came across and said the individuals were in custody. No apologies, just cut us loose with a little bit of arrogance and went on their way.

Supreme court ruled it's legal to resist false arrest, here are also some current events. What may be murder in the first case might be nothing more than manslaughter in the other, or the facts might show that no offense had been committed.” Ray Rosas a hispanic man shot 3 of them, legally. "CORPUS CHRISTI, Texas - A Nueces County jury that acquitted a man who shot Corpus Christi police officers executing a raid on his home said a “botched” operation and contradicting testimony led to their decision." Henry Magee killed one as well. "DALLAS - A Central Texas man who shot and killed a sheriff's deputy entering his home will not be charged with capital murder, attorneys said Thursday. A local grand jury declined Wednesday to indict Henry Goedrich Magee for the Dec. 19 death of Burleson County Sgt. Adam Sowders, who was part of a group of investigators executing a search warrant for Magee's rural home." Jessie Murray a black man also has killed one... "Murray’s account of what happened during a 2014 bar fight was that Forest Park police Officer Nathan Adams jumped Murray and Murray accidentally shot and killed Adams. " Unnamed man shoots two cops. "Two Maryland police officers were shot while serving a drug-related search warrant at the wrong apartment late Wednesday, according to law enforcement officials. The resident shot the officers as soon as they opened the door, thinking they were home invaders, authorities said. Daniel Michael Szabo, 41, was facing a possible life prison sentence for charges of trying to kill a Coast Guard officer during a boarding and using a firearm while committing a violent crime. But jurors on April 6 only found Szabo guilty of failing to stop his vessel when ordered to do so by the Coast Guard." "A Buffalo man(Marcus Prewitt) who was accused of dragging two police officers in a car following a traffic stop was acquitted of assault charges earlier this month using a rare defense: He said he was scared for his life." Ray Shetler Jr legally shoots cop who shot at him first. "In February, Ray Shetler Jr. was found not guilty on charges of first- and third-degree murder, terroristic threats and simple assault in the death of Officer Lloyd Reed. During the trial, witnesses testified that Officer Reed ordered Shetler to drop a rifle and the officer opened fire when Shetler did not comply. Shetler returned fire, striking Reed outside the officer’s bulletproof vest." John DeRossett shoot at cops striking one in the abdomen. "John DeRossett will not face further prosecution in the shooting of a Brevard County Sheriff's Deputy, an appellate court has ruled. The decision - issued Wednesday - ends the prosecution of John DeRossett, 60, on the attempted premeditated first-degree murder of a law enforcement officer while discharging a firearm. DeRossett spent nearly five years at the Brevard County Jail Complex in Sharpes as he awaited a trial. He was allowed to leave on bond in March. You're right. It is ridiculous. If an officer is fearful for their safety around an individual, it would make sense for the officer to leave. Instead, they initiate the encounter and go fishing. These Terry stops are 4th Amendment violations.

@@theundead1600 as someone who was a police patrolman i know exactly what his job is and how he should have handled it. when your first reaction is to pull a weapon when no other weapons are evident then you escalate the encounter, cops are supposedly supposed to de escalate, gather evidence, and protect the scene, not threaten children and citizens because the cop is scared.
