@@chitlitlah Steve can provide more information here, but in my limited opinion, in a civil case such as this, the preponderance of evidence should not be difficult to prove. I would think that the dealer who sold the car to their buyer would be responsible for some "damages" as this is no longer a new car. That's assuming that the actual owner even wants to accept delivery of the "used" car. I think, at a minimum, the actual owner should be able to get back the "profit" that the second dealer made over and above what the cost of the car should have been to a stocking dealer. I think I could overlook a few hundred miles for multiple thousands of dollars being returned to me.

I used to do dealer transfers. Each vehicle has a manila envelope the size of a large hard cover novel. It has all the information of that vehicle. That envelope is religiously inspected for each vehicle upon arrival and departure. This car was not sold by mistake.

The dealership should lose their license for selling a car that's already sold, the salesman and finance manager fired and both brought up on charges of fraud. I would not want a car sold to me as new when someone else had been driving it around and racked up who knows how many miles and wear and tear on it, even if that owner is totally innocent in this issue. Have the manufacturer send me a new car again.

Not necessarily, what they did was definitely wrong. But if the customer doesn’t know anything about the certificate of origin, then they won’t know to look for it. And they could’ve given the customer some BS story about the title so no need to really falsify any documents.

The actual owner had a brand new C8 drop shipped to a dealer in Huston, and this dealer gave possession of this C8 to someone else, recovered this C8 and finally 'delivered' it to the rightful owner. Surely this C8 was then a second hand vehicle, and not what the rightful purchaser ordered. So yes, the Huston dealer should have to pay generous compensation to the purchaser.

@@roberthudson1959 here in nh new is never titled AND below a certain mileage. Test drive cars above a certain mileage get a special name which I forget but it's not new and needs to be declared.

@@williscurry6557 GM never gets involved. They always say your dispute is with the dealer. GM despises its customers. Even if the dealer voids your warranty notifying GM because you don't change the rear axle fluid on a front-wheel-drive car every 3000miles. There were a lot of similar things like repack front wheel bearings (Sealed for life) on that front WD car.)

They sold her car, and then bought it back and sold it to her.... It is a used car when she got it, sold as new. That should be a HUGE discount, and a Fraud charge.

I don't know about fraud. It's not like they tricked her into buying a used car thinking it was new. It was actually new when she bought it. It should be conversion or something like that. I agree that the dealership should have to pay her for reduced value though, in addition to whatever criminal charges.

The fraud charge, yes, but not for the "sale" to the rightful owner, rather for the fraudulent sale to the other "buyer". As their normal business is car sales, any excuse along the lines of "we didn't know we couldn't sell that car" would likely be treated as an admission of wilful negligence, in my opinion.

In Texas you can register a vehicle without title. In other words you can register get plates and not transfer title from another state or MSO.

Steve, I think you got this one wrong. Under the laws of my state, physical possession of the car is irrelevant to ownership. If the title is in your name, the car belongs to you. If the certificate of origin was endorsed in her name, she owned the car. I suspect the laws are similar in Texas, and from the moment it was driven off the Houston dealer's lot it was a stolen car.

Yeah, physical possession isn't necessary for ownership. She paid for the car. The documents were in her name. The car was hers. The fact that it was converted to someone else via fraud does not change the fact that it was still stolen. If someone sends you a package and the ups guy just steals it from the truck, it is still theft.

I have a friend who bought a car. Picked it up, drove it for a couple of weeks. He travels a lot for his job and had already put a several thousand miles on it. A couple of weeks after buying it, the dealership called him. Turns out they had given him the wrong car, meaning the VIN number was wrong for his paperwork vs his car. The dealership gave him his car, which was brand new with no miles. In this case, the dealer did the right thing.

I agree with all these comments. I have worked for dealers. The keys are never put on the board if the car comes in sold. They are put in a file cabinet with the packet Steve talked about. It would be a locked cabinet for a car like that and a manager would have the key. They knew exactly what they were doing and they knew it was wrong. The baffling part of this is that they thought a lady that had the money to buy a car like that wouldn't have an attorney on hand. The dealership should pay up and clean house of their underhanded/ borderline criminal sales people.

How about they replace it with a new one? After all, it now has x miles on it and it may well have been registered. When this highly collectible car is resold a few years down the road it will NOT be one owner. And a vin check will likely show that. Let the dealership find that car, unmolested in another dealers lot and buy it, ship it and deliver it. Oh? That option pack is not available and GM is not making more? So sorry, that will be $250k.

20 or so years ago, a dealership sold my Grand Am. I was car shopping at the dealership, and left my car in customer parking. Never purchased a car there, or traded in the vehicle. Dealership never had the title for the car, but sold it anyway while I was car shopping. Had to report it stolen, by the dealership, they wouldn't cooperate with me. It was eventually recovered. An investigation by some DMV licensing investigator later shutdown the dealership. Apparently there was a litany of issues with the dealership.

@@BusArch42 Presumably the had a locksmith on site. 20 years ago the only security that car would have has is the lock cylinder so pick it replace it and you're set.

Some are, I was searching for a truck a few years back, well I wondered in to a few new car dealers and noticed vastly different pricing. A GMC Sierra 1500 with 305 air, cruse, tilt, SAT Radio, power windows locks etc same package $7250 difference in price 50 miles apart. One was produced one day apart! The cheaper one was even offering free Michelin winter IceX tires on Aluminum rims, 5 years of Satilite radio and 5 years of free onstar!

Back in the 80's a friend of my father's was at a dealership trading in his truck for some other car. Before the deal was finalized and signed the dealership was already selling the trade in - the friend found out when he stepped outside and saw the activity around his truck. He spoke to the interested party and asked how much they were asking for the truck and he made a deal with the guy splitting the trade in amount and the sale amount - win/win for both parties. He then went to another dealership to buy his vehicle.

An old salesman's trick was to have the sales manager take the trade-in vehicle for a long test drive, sort of hide it from the owner, then the owner would feel pressured to buy a vehicle because he would feel stuck without his vehicle there to leave in.

A friend had a lifted truck, big tires, stereo the works. He went to trade it in (for a new truck) & the dealer went on and on about how it's a niche vehicle, hard to sell etc. So they came to an agreement, and he signed the papers on a Friday, to return on Monday morning where his shiny new truck would be ready. Monday comes along, my friend shows up & the dealer says that's not the truck, friend says sure it is, check the vin. We took everything off over the weekend, (it was a long weekend for us lol) and replaced it with all stock/original equipment. After much crying, B*T*Hn & whining by the dealer, the deal got done (they didnt have a leg to stand on as the contract was signed for that specific truck not the parts on it), my friend got his new truck (couldnt put any of the old stuff on, it was a model change - he sold the parts incl stereo for more than what he would have got from the deal on trade). DEALERS are SHIFTY as F***. We both knew that the dealer was going to easily add $10+Gs to the bottom line as a mark up & sell it as LOADED TRUCK with EXTRAS and up sell it. Too many people fall for their line of BS. remember it's not your problem that they have HIGH Overhead etc, but most people are born suckers, they just have to have that NEW SHINY X without thinking about the costs involved. Dealers are not there for you, they are there to line their pocket book at your expense.

The salesman couldn’t have sold the vehicle without the managements cooperation...the manager basically said screw the owner, let’s sell it and just give her the money she’s put into it. I’ve worked for dealerships and I’ll tell you right now that they have less morals than drug dealers.

This exact same thing happened to me back in 1980. I factory ordered and paid for a 1980 Chevy Silverado 2whl drive short box in dark brown with tan interior. The truck carrier arrived at the dealership and my truck was still on it. I’m o one side of the carrier and saw a salesman walk up on the other side with a customer who said “that’s exactly what I’m looking for” and walked away. After the truck was off the trailer, I saw that customer sitting in my truck and the salesman had papers in his hands. I walked up to them and asked what they were doing and was told by the salesman that he was in the process of selling my truck. I told them to get away from my truck as I already owned my factory ordered truck but the customer was not relenting. I got my salesman, the sales manager and the dealer principal involved (I knew the dealer principle) and finally took possession of my truck. Back earlier, I bought a 1971 Mercury Capri 4 cyl standard. When I heard they were coming out with the 2.8 V6, I searched around for a dealership that knew about them as it was quite early and not many knew about them. I factory ordered a 1972 Mercury Capri V6 standard. I got a fantastic deal on it as they weren’t sure what the sticker was going to be on them, so they got some info from Mercury and did the deal. It was the first one ordered and the first one delivered. I took it in for its first check up and when I arrived to pick it up, it wasn’t there. An f**king salesman took it out for some reason and they couldn’t get ahold of him. I had to wait at the dealership for 2 hours until the a**hole got it back. HE TOOK SOMEBODY OUT FOR A TEST DRIVE THEN WENT FOR DINNER. I think I invented some new swear words at that time. I made him fill the gas tank before I went home.

I'm in Houston.. the Dealer is Sterling McCall... been a Toyota dealer in houston forever... but a chevy house not so long.. it's no mistake... that car had to be brought into inventory to be sold.. like you said.. at some point before the client took delivery, the dealership knew damn well that wasn't their car.. when a car is taken into inventory, the MSO is either put in a safe (self floored) or transferred to the institution that the inventory was floorplanned with.. in the sales process, things would have got weird when the car didn't have a stock number assigned when its brought into inventory... then again when the stock number and vin weren't in the computer when the new buyer was in the F&I office.. this was a calculated move by the dealer... probably hoping to stall the actual buyer until they could obtain a replacement vette... maybe they had one incoming soon that was equipped the same or close... greed was the motivation here... wouldn't be surprised to find the "buyer" has some "relationship" with Sterling McCall or someone there... i was in the car business for several years before starting my Tech Business.. We've seen it all, I once sold a car that disn't exist.. interesting story... for another time.. Merry Christmas Steve... and all the viewers as well.. hope you all have safe and joyous holidays...

@@jacoby1234ification technically its new until the MSO is traded for a title.. so im assuming the MSO was in california, so its still a new car until titled in the 1st owners name... you can drive a car years and thousands of miles... but until its titled, its considered new.. like a demonstrator, we used to drive new cars 4 or 5k miles then sell them.. they were new cars with some miles on them... thats technically, but once someone takes delivery and drives it a while.. the general consensus is that its been used so it is used.. on paper, its new... but has miles.. personally, if i ordered a new c8, i would want to take delivery with very few miles.. like under 5 miles.. typically cars come in with under 2 miles or so on them.. typical movement and moving around dealers lots and test drives etc.. not uncommon for new cars to have 10-20 miles on them... it varies.. if its on the MSO, its new...

Pay her car off! That would be far cheaper than the pending hit to their reputation. Who would ever deal with such a crooked a dealership? 🤨

@@vincentshelpfulhints4085 The rightful owner doesn't have an obligation to sell their vehicle to be made whole. It's the dealership, having made the mistake, which needs to make her whole. And no, her now having the car doesn't change the fact that the value was diminished by the dealership having made this a 2-owner vehicle instead of the 1-owner it should've been.

Here's what I'd be worried about if I was her (the "Rightful Owner")... The guy/gal that bought the car from the dealer in Texas, finds out that they have to give the car back. Now, you would hope they are nice sports about it, but what if they don't take it so well? What if they drive it horribly for a day or a few days, tearing up the suspension, transmission, engine. What if they "sabotage" the vehicle in some way, like adding stuff to the engine oil, transmission fluid, or gas tank. How could you ever be confident that they didn't do any of these things, or similar things? It would always be a nagging worry.

@@vincentshelpfulhints4085 - The problem with that, you (we) don't know what kind of premium she paid for the car when she purchased it new in California. It could be that she paid so much that she'd never be able to recover it by reselling it now that it is a "used car". Then, she still has to get back in line to order a new one again, perhaps pay even more of a premium, and wait for it to be delivered again. Sadly, all in all, this might be her best option especially of she is hesitant to keep someone elses used car. She'll probably have to take the hit and hope the Texas dealership compensates her for it all.

I think this is a Houston thing. I bought a Corvette from a "reputable" Houston dealership. Several months later, Houston police showed up at my workplace and informed me that I had bought a stolen car. They took the car. When I got to court, the judge said this happens all the time. I was fortunate to hire a good attorney and got a new Corvette at a huge discount out of the deal.

I am so glad the C8 is tempting you Steve. That was my hope when I sent you that beautiful Accelerate Yellow model. I love seeing it every day on your set. Maybe one day you will have one parked next to your Viper. This story did get a lot of play on the Corvette forums. Most people buying the C8 have actually ordered it with their preference of options. To have one just show up at a dealership without them ordering it should have been a huge red flag for them. In my opinion there was no mistake made when they sold it. They did it for greed sake alone. And in doing so, it was no longer a new car for the original lady who ordered it. It is now a used car. But in the current C8 market, used ones are going for more than new ones because the demand is so much more than the supply of them. So she should come out of this with no additional money loss with respect to the current market value. I hope she enjoys her new C8. Merry Christmas, Steve. You are a master story teller.

It's a common saying how a new car depreciates in value when you drive it off the lot. Make the dealership pay that depreciation. Plus extra for the trouble

Vindictive, my eye. She should immediately file a suit and demand preservation of all and any documents relating to this vehicle so they don't accidentally destroy or make them disappear. She should also file a complaint with this overseeing agency that you mention. The fact that nobody would talk to her when she inquired leads me to believe that a they knew what they did and they were now trying to fix it. Or be they were hoping to just make her go away. If they would have just spoken to her or called her right back and said oopsie sorry oh, that would have gone a long way. Finally I've heard that once you drive a new car off the lot it depreciates about 20% so she should get a refund from this dealer equivalent it to 20% of her purchase price. the fun thing about those documents is they aren't the type that you can just "make disappear" - like the "police book". Dealer be like "oh sorry I can't find that must have lost it sorry!" (state offices step in... "you lost WHAT?") They'd get hit a lot harder than the full price of the car for losing that. Also, the person that bought the car would have a copy of some of those things, and when *both* copies of some documents magically got lost at the same time, the judge is going to raise the bar on the burden of proof for that claim to astronomical heights.

Vindictive.... It already lost 20 to 30% before you drive it off the lot. It lost that value the second you signed the paperwork. Say you buy a car, sign the paperwork, and a meteor falls on it before you even get to drive it. The insurance company will treat it like a used car. You will never get full replacement cost

When a car arrives at a dealership it has to be processed and assigned a stock number. I worked at a Honda dealer. When a car carrier arrived I had to check the VIN number of every car and match it to the invoices. I then had to check and assure that the car had all of the optional equipment that it was supposed to have by checking the order forms.

I work at a Honda dealership now. Granted I work as a technician, but I've done enough pre-delivery inspections on new cars to know that everything has to match, otherwise there are some problems.

I went with my buddy in the army to trade in his Mazda 626 on a new 280 Z. We went on the test drive and the dealer let him drive it home to show his girlfriend. We went back to the dealer and they were going back and forth and my buddy’s parents (who were going to co-sign) started to get upset at the deal. His parents convinced him it was a bad deal and to leave. That’s when we went to the parking lot and he couldn’t find his car and forgot they still had his keys from the trade-in inspection. Turns out they sold his car to another soldier and didn’t want to call him back in. We called the JAG (military lawyers) and told them what was up. The dealer all of a sudden was able to be reasonable with the trade-in price and came worked a better deal on the new car. And they found him a bank to loan him the money with no co-signer.

I'd say the dealership owes her for the automatic depreciation that occurs when it's driven off the lot, as well as per mileage for the miles put on the car. I'd also ask the unfortunate soul that thought they were getting the C8 but had to give it back if they did anything crazy in it like burnouts, etc. and add it to the dealership's reparations to the actual owner if possible.

Similar situation happened often with an old friend of mine. He worked for Chevrolet and would process his own sales orders through the corporation. Then he would pick a dealer for his new Corvette to be delivered to, all without ever making contact with the dealer. He knew when it arrived, and he would go pick it up, leaving a dealership really puzzled where this car came from and how they have nothing involved on it. He usually picked a different dealer each time to keep from any one dealer getting the short end of prep work without any commission.

Here is a story for you!! Back in the 80s I leased a Ford from a dealer in San Antonio. Six weeks after the deal i was called and told to make a pen in ink change to my VIN on the contract. I did not because I knew it was illegal. Well a couple of months goes by and still no payment book to show where to send payments. I call dealer, they say, Oh we don't have that contract, that salesman was fired. We need you to come fill out a new contract. We went to SA and filled out a new contract. Well we hit hard times and did a volunteer repo. When they started to hound about payments, I found out 1. The car we were driving was VIN #1 2. The car on contract was VIN #2 3. The car we had insured was VIN#3 4. They had no proof of us even buying a vehicle from them.

My wife was executor of her uncle's estate. During the estate auction one of my wife's aunts walked over to the auction with her lawn chair to sit and watch the auction. The aunt got up and went into the house briefly and when she returned her lawn chair was gone. The auctioneer had sold it. It was the auctioneer's job to sell anything that wasn't nailed down, and he did his job well.

As soon as you drive off the lot, you lose 20-40% on a car like this. The buyer should be demanding either a new car plus damages or a significant price refund plus damages. This dealership needs to be taught a lesson.

The car doesn't really loose value after driving it off the lot. It looses value when you sell it. Only from an insurance standpoint might it loose value that quickly. But most insurances i know, here in the Netherlands atleast, have a full value coverage for at least 1 year. Sometimes up to 3 years even.

Main problem I would have with the car used by some unknown person is what he/she did with it. Check the tires for evidence of burnouts for instance. How good were they on the clutch etc. It could be a nightmare.

They are still in business. A "chat bot" showed up for dealership. I asked if they had any stolen C8's they wanted to sell cheap (since dealership never paid chevy for car). Bot immediately replied "I can help you with that".

About 21-22 years ago I was in the market for a new to me car, and was at a local dealership looking at two choices. While I was test driving and comparing the two vehicles I was interested in, I had given my keys to a manager to have my car appraised for trade in value. By the time I had driven both of the vehicles I was interested in and made the choice which car I wanted (mind you I had decided but not communicated it to the sales person nor had I signed any paperwork) I looked outside and my car was being loaded onto a car hauler. Apparently the sales manager had "sold" my car to a buyer overseas while I was on two test drives. This occurred in 99, my trade was a mid '90's LT-1 Caprice Classic. The Caprice was/is very popular in several mid-east countries. Before I had gone to that dealership I had already spoken to a broker about selling my car direct to someone in Dubai and knew what they were willing to pay. I owned the car outright and had the title in hand. The dealership had a "wish list" of cars and the Caprice was on there, so an overzealous sales manager made a deal for my Caprice before I had sold it to them. Since I had already gotten a quote from a broker I pretty much knew how much they had sold the car for, and was able to "negotiate" a very nice deal on the car I wanted.

I ordered 300$ worth of ammo a year ago, paid for it ahead of time and was waiting for it to come in to my locally owned ammo shop. Well, couple weeks went by and I was starting to wonder when it was going to come in, so I called them. They straight up just said "oh, we sold that to somebody else" i paid for that. I was sooooo pissed. Had to wait another week and a half for them to get my ammo to me. No apologies, no nothing. The guy even had an attitude about it. Never shop at sharpshooters in spokane. Of course, nothing like a c8, but I definitely understand that anger. I wish everytime a story like this happens, people would name the place and location so others can avoid it. Im sure Steve just doesn't want to get sued or demobitized, etc. But how else are we going to hold crooks like this accountable?

I had that with a trade in... went to a dealer that was know for high pressure sales Tactics, that don't work on me..at the end of the Negotiations they told me their business office was closed and I would need to come back Monday to signed the finle sales contract... then pulled the mini van i was going to buy complete with the car seats from my futcher trade in....i told them i wasent taking Possession of a car that I did not have the final sales contract on and please bring back my trade in... They told.me they already possessed it and it was locked in the garage and of course they didn't have the keys to the garage.....they didn't Appreciate my deadpan suggestion of using a brick to brake the window in order to Retrieve my vehicle...after several more minutes of arguing about why they couldn't return my car to me and me refusing to sing any Documents..i finally asked to use their phone...pre cell phone days...they asked if i was calling for a taxi...i said no im calling the police to report my car stolen...they said no i could not use the phone... i said no problem i would just walk across the street to the gas station and use their phone instead..... at this point someone Miraculously found the keys to the garage and return my car..... theirs sales department had the balls to call me monday to ask when i would.be in to pick up my.van.... yea NO SALE

I looked at a car once. I would have bought it outright, but the dealership insisted on evaluating my trade. Which I was curious about as I'd swapped in a later model drivetrain with about 40% higher HP and I wanted to see what they'd value it at. They "lost" the key. I handed them a business card and told them to mail me the key as I pulled my spare key out of the pocket of my jeans and started walking to my car. And, no I did not buy the car I was looking at.

Let me list the crimes: Fraudulent misrepresetation to the "buyer" of the car by the salesman and the dealership. Theft of the car from the actual owner of the car by the salesman and the dealership. It doesn't matter if she never physically possessed the car. She has legal title to the car and that is what matters. Theft of a parcel by a postman is still theft and this is an exactly analagous situation. Depending on how they handled the money from the transaction possibly money laundering and/or wire fraud. Fraudulent misrepresentation by the dealership to the California dealership. Then there's the breach of contract, violations of consumer protection laws and other torts on the non-criminal side. Yes she should be vindictive. This dealership deserves to be shut down for its practices. The staff members involved need to be in jail. An example needs to be made of them. She also deserves tens of thousands of dollars in damages for distress, inconvenience and actual losses in the value of the car.

After a review of the law, it appears that it "might" qualify as a theft from interstate shipment, but the FBI/US Attorney are unlikely to pursue this as there is a civil remedy.

Thomas Bonse You are correct, but after working with the USAO they are not likely to entertain a case where the victim has been made "basically" whole. The dealership was definitely in the wrong and possibly criminal, but this is small potatoes and she can sue for the damages. In my city, cases involving bank fraud were automatically declined if the customer had worked out a restitution plan with the bank.

A dealer in California tried to sell my mom a car as "new" but it had 36K miles on it. Their explanation: the dealership owner's wife drove the car as her daily ride for a year, and because it only had "dealer" plates on it it was never registered and therefore was new. They're out of business now, but not nearly soon enough for me.

Not a car story but had a similar experience with an apartment. My wife and I went looking for places to live in preparation for a job related move. Found a unit we liked, signed a lease for that exact unit, put down a deposit. When we moved we found out we got a different, much less desirable unit that actually rented for much less per month. I complained to the manager and she said that the sales person who had showed us the unit and we signed the lease with had decided that she wanted it for herself so she moved in after we left. The crazy thing is they still insisted on charging us for the original rent because her argument was that we had signed a lease and it didn’t matter which unit we got. Fortunately it was a corporate relocation and when I threatened to go to my employer and get them involved they agreed to lower the rent to the market rate. But we didn’t stay for more than a year because we didn’t end up getting what we originally wanted.

There was a similar case in New Orleans back in the 70's. In this case the car was in for service and got sold, and like the Vet was not the dealer's to sell. You would have thought something was wrong when the salesman could not find the papers when writing up the sale. In the case I remember, the car had been put in the Used car lot section because of a lack of room in the service area to park it. But then it had a service number hanging from the rear view mirror.

Once I had my new VW Caddy outside the local dealership after picking it up the day before (I had to service a machine there) it had no sign writing or anything and when I walked through the show room I realised that there was some sort of panic going on. Bunch of flustered sales people and admin so I just noped out of the show room to my van. Two random people standing at my van when I walked up, unlocked it and threw my gear in who looked quite shocked at how unprofessionally I treated the vehicle. Brief conversation I discovered that they wanted to buy it, but no one knew where the keys or paper work were and the vehicle was still showing on their stock sheet and key board. No one thought to check the computer! As the dealership had really helped me in the past I let them use it for a demo as there were none in stock lol. This was an honest dealership obviously but I am glad I didn't leave the key in like I did half the time 🤦‍♂️🤦‍♂️

Love the T-Shirt! I'm from So Dak. lol Many years ago I bought a new Jeep Wrangler. Traded in a 4 year old Geo Metro. The deal was a 6 hour arm wrestle and they blinked first. I got home with the Jeep and had an answering machine message stating they could not sell me the Jeep, that I just drove home an hour, stating there was a financing problem with it but they could sell me a Geo Tracker. They had 3 Wranglers and 50 Trackers on the lot. I told them I did not want the Tracker. They insisted that Financing would not pay for the Jeep. I knew it was blatant lies as I financed through my bank and they already cut the check for the Dealer. I told the Dealer that I would be back on their lot in an hour and to have my trade in ready as I considered the deal null and void. They back pedaled and said they found a way to work out the financing problem. Given how popular the Metros were with college students and school getting ready to start in 4 months I was sure they already sold my trade. lol

I used to work for what was (and still is) the largest Ford dealership in the world (Galpin Ford). On 3-day sales/lease weekends, we would DELIVER over 350 cars to customers. We were also the only Southern California dealership at the time to sell the Saleen Mustang and from 1986 on, the AC (Autokraft) Cobra. And I GUARANTEE that EVERYBODY from sales to new car prep to wash rack and detailers knew when a specialty car was scheduled to arrive. And there is no way this dealership didn't know that this sale wasn't legal, they were just hoping that they could get the quick cash from the woman's car and clean up the mess after. Had a coworker whose car was serviced without his knowledge. Shipped it by train cross-country when he moved, and took it in for service several months later for a problem presumably under warranty, and they said they couldn't because it had unauthorized work done on it. Turned out the rail company had damaged it, and replaced the transmission with a transmission for a different vehicle. Whoever did the work wrote the date on the transmission, however, and the coworker wound up suing the freight company.

Something similar happened to me when I bought my new car in 2018 and traded in my old one. 3 months later I get a call asking me if I left the trade in with them when I got my car or if I took it home and intended to deliver it later. Evidently they lost it. I told them I left it there and it was not my problem.

Most owners don't know they haven't received a title for a very long time because they are financing it and the title goes to the finance company. Depending on the finance company, they may not keep a close track that it doesn't arrive from the state.

Watching Steve's videos has only served to convince me further that there are very few people left who are honest, have integrity, and act above board. Lawyers, cops, people in general, dealers etc... so many are abhorrently dishonest.

Where I live, when you go through the sales process, the title has to be signed over. So, even in normal circumstances, it'd be quite obvious. No chance, with the C8 in such demand, anyone in that dealership did not know who owned that car.

If I were her I’d definitely look into suing them for lost value of the car, There’s gotta be a case there she signed a contract agreeing she would receive a new car and the car was not delivered in that condition.

I would like to here the other side of the story from the guy who bought it from the dealer. I bet is that it was a friend or relative of someone that works at the dealer, or a customer with deep pockets that buys a lot of fleet vehicles from them. chances are that the dealer thought that the car was misdelivered, and quickly sold it for with a big markup, only to discover that they didn't have the MSO and were going to try to get the MSO from the other dealer since they already sold it, dealers trade car inventory all the time. they were going to try an shaft the the California dealer out of a hard to get, high dollar car, only to discover that the car was already sold. at which point they probably talked with their lawyer or the other dealer lawyer and were probably informed them how screwed they would be if they didn't get the car back for the rightful owner.

If I was her I'd pulled up with the police the DOT inspections and my lawyer in hand and that car would be one end to the other computer in and out I would know every detail to make sure someone had to swap motors

it's not a rent, there's a popular saying / accepted truth that a new car loses xxx % of its value the instant it's drive off the lot. That applies here. Try to return a car after buying it and that's the case the dealer will make when they offer to take it back for 70% of what you paid for it a week ago. It works both ways, and there's likely enough precedence in the state's legal cases to establish a number. And with a car that valuable, it's going to be one very uncomfortable multiplier for the dealership. If they're smart they'll just offer to settle with the true owner for that number just to save themselves the continuing bad press. (they don't care about the attorney fees, they have someone on retainer and it'd be peanuts compared to the amount they're having to pay out anyway)

When I sold cars years ago in Washington State, the dealership I worked at once sold a car that someone traded in before the trade in deal was financed. Turns out that the loan for the customer that traded the car in was denied. When they brought the car that they thought they had bought back to the dealership to pickup their trade in car, they were told that their had been sold and that the dealership was still trying to get it back but the customer that bought it, didn't want to bring it back

oh, I been there... I ordered a Y2K VW Turbo Beatle, and being Navy I had to go out for the month the car was coming in I was going out for a few weeks. I paid for the car in full before I left because the dealer was all like 'well if its not paid for, and someone wants it, we're selling it' on account it was highly sought after at the time... so I paid in full, came back, and the dealer demanded an extra $20,000 on it. I just pulled out my bill of sale, stamped 'PAID IN FULL' and said, 'bring it around now I gotta get back to the hanger'. Boy, where they pissed. They didn't do shit until I said "Do I have to call the cops?" then it was like I waved a magic wand.
