The plaintiff hired the defendant to build a deck on her house. She says she paid the deposit, but then was not able to get money to build the deck. She’s suing for her money back. The defendant argues the lumber yard charged him a restocking fee and he offered her a way to get out of her contract. He’s countersuing for lost work, lost profits, and restocking fees.

I’m a bad person. I so very much enjoy when someone tries to sue someone and inadvertently ends up owing them money. Those are my favorite episodes 🤣🤣🤣

The defendent seems like a genuine guy. All of his evidence was organized, he stuck with facts of what he did/what occurred and didn't get emotional, and he even gave her a contact at the lumberyard he used to show he wasn't being shady. Wish I could hire him.

Yes he sounds like a great contractor, as opposed to many other ones. This guy was the most reasonable contractor I've ever heard of. This decision was very well deserved.

i think the plaintiff's main mistake is that she did not realize or know that she could be counter sued . alot of people out there think that if they lose a lawsuit against somebody then they just dont get any money but they never think about the chance that they may have to pay money or pay more money if they lose .

I learned a long time ago that if u sue someone then they can also counter sue u and if u dont really believe u have a really good case then dont do it becuz u can end up not only losing the lawsuit itself but u can also end up owing the person money if the judge gives them a judgement against u .

Yes. She made multiple men be out of work for that day. She's lucky they're not suing her for their wages for that day. You don't make a contract for something, and then try to figure out if you can get the money for it. That's the most ridiculous thing I've ever heard.

You signed a contract, he and his workers were out a lot of money and you should have paid the restocking and cancellation fee. This is what happens when you don’t want to hand over a penny even though you have made a contractual agreement.

Hell, there wasn't a cancellation fee. There was no room in the contract for her to cancel. He was being nice to her and allowing her to cancel. All he expected was the restocking fee and paying for his work. And not much for that at all. I'm sure that he probably could have insisted she pay the whole amount that was in the contract.

At first I thought she wasn't thinking. She was able to rationalize the fact that it wasn't in the contract really made me look at her different. She knew exactly what she was doing. Either way she owe the money. She doesn't have a attorney. She was bold in that text.

That's clear. If she talked to an attorney, she would have taken his first steel which was incredibly reasonable. She actually thought he shouldn't get paid for the work that he did, and his costs. She's lucky that the Lumberyard even allowed him to return most of the supplies.

I am sure she would be livid is someone came in and said they wanted to rent the whole salon and have 20 sets of nails done. They sign a contract and pay a deposit and then right before the big day they cancel and demand a refund. I am sure she would be fine with losing business, nail techs losing money and would happily give them a refund. By the way what legitimate business owner signs a contract BEFORE they have funding for a renovation?

The plaintiff is totally wrong! When you break a contract, then there is a price to pay. My main question is " Why would you enter into & sign a contract, without having the finances to do so"? Then when the defendant try to give her a break , and was only asking for the money he was out of, she was so crazy to not take it ? No , she got exactly what she deserved!

The market must be very different where they are than where I am. No chance you get a decking contractor who is able to start a job within a couple of weeks of first contact where I am. More like 4-6 months.

I worked at a construction company right out of college as a production manager. The hardest part of the job was when the weather was iffy. We were located in Chicago so weather was impossible to predict. I mean some days we had all 4 seasons I kids u not. If I called the job off on account of rain, I had to live with having our crews sit at home and not make money. If we called them out and we have to stop work on account of weather, it would be a waste of time. I couldn't win. I am so happy for the defendant bc this plaintiff doesn't understand that people count of these jobs to make a living. You don't get to cancel last minute and get off Scott free. The defendant was too nice willing to let the lady off with just a restocking fee.

Judge nailed this one. She seems slippery. She said she was there to educate people? No- she was there to win and get her money back. Big ego and entitled pride. SHE WAS WRONG. She plays a really good victim but she seems to be a shark. She was out to throw this guy under the bus big time but it backfired on her. I think they call this Karma. These traits are probably why her credit wasn't good enough to get that small loan.

This lady was delusional. You cant stiff a company that you signed a contract with 3-4 days before the job is due to start and expect to get out of that without as a minimum being responsible for costs already accrued. As the judge stated he was being insanely generous to have offered her that cheap way out. I bet he updated his contract template after this palaver even though he did not strictly need to.

I am still gobsmacked by how many people show up to a court without being prepared. Even in real court I have seen this, but it usually happens infrequently because people have solicitors whose whole job is to be prepared.

she's still doesn't get it she walked out of there saying that she learned the lesson that you should read the contract before signing, it had nothing to do with reading it had to do with her signing it and not fulfilling her duties. She should have said I learned that I needed to get financing before starting and signing a contract for a job!!!

Her mission is to let people know don't sign something you don't read. Her mission should have been to get financing before signing a purchase contract, or sometimes compromise with people and work things out.

The nerve. AND she's a "business woman!" Contracts mean something. What genius signs a contract to complete this grand of a project without having the funds? I understand getting estimates in order to plan accordingly but actually signing the contract? I wish the defendant won a larger award, the plaintiff not only affected the defendant but also the subcontractors who anticipated working on this project. Her attitude towards the defendant (who was extremely reasonable and patient) was just arrogant and entitled. But then again anyone who just ASSUMES they'll be approved for a $17,000 loan without taking the necessary steps to be sure is a very entitled and pompous person! I couldn't even stand to hear her final thoughts out in the hallway, I had to stop the video right after the decision 😩😂

I'm own a small construction business and a lady wanted her roof done so I wrote up a contract for $8500 with $4250 upon starting.. She gave me a deposit of $1250 the day of the signing leaving a $3000 balance on a starting date the next week..I ordered the materials for a deivery the next week..I always check weather and start tearing off 2 days prior than delivery.. The morning of I go there and we get the tarps out, tear off shovels, my dump truck setup, ect. The homeowner comes pulling up @7am & says don't start that she has a problem.. Well long story short she couldn't get the $ wanted $750 of the $1250 back.. I told her no way that I'm gonna be out over $2200 so we ended up going to court she tried to sue and I countersued & won a judgement for $$4500🤷

After signing a contract I schedule the work and don't bid other jobs for that block of time. When customers back out my employees and I don't make any money. I try to work with people as much as possible.

A contract generally stipulates what is expected to be done, how it is to be done, when it is to be completed, and how much it costs. There doesn’t need to be a cancellation stipulation in a contract. The consensus is that the one who cancels faces the appropriate penalties as the US law deems.

True, but I bet this guy went right out and had a lawyer amend his contract to put in cancelation clauses. Its great to win, but if you have to go to court it still costs you something. Better to take any question off the table.

Once you sign that contract, you're obligated to follow through. Unless stated otherwise, but there will be consequences.

"I didn't know" isn't an excuse in an attempt to collect money. I'm so glad the defendant won. Judge MM's father was a contractor, sooooo don't think you can get away with trying to play the ignorance card and win....

People flake on contracts all the time, but the most shocking part here is that she thinks she can sue him for it! He offered her $653 for him to F off and rather than take that, or even just flake again and pay him nothing, she sues him! Outrageous behavior.

Especially after he gave her a good deal the first time, cuz she had no right to cancel at all, and then it doesn't look like he was going to sue her for the money he was out, so she had a chance again. Fool. She deserved everything she got.

How do you wanna enforce or use loopholes on a contract you’re in breach of? Then was nasty/ snarky about it cus she felt she was in the right. She got what she deserved. It’s not abt READING (although you always should) it’s abt being held accountable. I enjoyed this one.
