I re-watched this episode again today. When I was a kid the Apple River was much more of a family-type event. We went tubing with Parents, Aunts and Uncles, and Cousins. When I was in College it was turning into more of a young Adult with some light drinking no drugs. Now, I have not been there in 30 years, but it seems much more that it is a hard party place and not safe to just interact with strangers.

Alcohol. That one word is the root cause of this entire thing. I went to the same river 10+ times as a young adult. Everyone is lying about how much alcohol was consumed. The river is known as the place to go get wasted and party. Its not a family friendly place. Even the adults get outta hand. I've witnessed some horrendous beatings on the river or in the campgrounds. Never any stabbings but group attacks on multiple occasions. Men groping women or just being way to pushy toward them. I would never knowingly let my children go there.

My husband carries a knife all the time. Just a little pocket knife. And people do ask him for his knife regularly to open packages, cut things, etc. It is NOT a weapon to him. He is 39 and a big guy. If he got attacked by a group of teens being violent he would probably use it if he remembered it…because I don’t think it would be his first thought…because he doesn’t carry it for self defence. This witness was persuasive and if I were on the jury certain biases that the state are presenting would hurt their case to me. If they are starting from a perspective that a pocket knife if a weapon brought for self defence and that young men are LESS dangerous because of their youth that would not endear their position to me personally. I’m still undecided about whether it was self defence because I haven’t watched enough but them trying to present the idea that the idea of him having reason to fear “young boys” is disingenuous. A young boy is like 12/13 at most. These were older boys at best but more like young men.
@esthersmith3341
@esthersmith3341 6 месяцев назад
Most of the 'men' who served in WWII were 16 years old. No birth certificate because they were born at home. No one cared, they joined. These young men had no reason to verbally assult the man. 17 year olds are men, not boys. R***r and pedo*****!!! They have half the blame here.

@@jimbobbyrnes they are not kids! WWII soldiers in combat were younger than that. My father was 16 as was my best friends father. Those men should have been raised better. They started the entire thing. If the man had no knife he would have been the dead body possibly.
@sallycinnamon5370
@sallycinnamon5370 6 месяцев назад
@@jimbobbyrnes The defence proposed is self defence. The “victims” will be scrutinized…and they should be. If they stand up under scrutiny then he’ll be convicted. If they don’t then he’ll be acquitted. But if the jury thinks they instigated this fight and he just happened to defend himself with a weapon he had on him…he’s absolutely not guilty. The fact that he won the fight doesn’t mean he gets punished. And the fact that they lost doesn’t make them any less guilty of assault. But the prosecutor presenting the presence of a knife as evidence of guilt is not persuasive to me. And when people try to present a nothing like a smoking gun or make a mountain out of a molehill it makes me doubt their judgement and leaves me with the impression they are trying to railroad someone. I don’t believe that he went back to get a knife then reapproached with the intention of stabbing anyone…which seem to be what they are trying to imply. At the very least there is a legitimate argument that a single man surrounded by drunk and high young adults that are physically and verbally threatening him and then assaulting him could be fear of his life. These kids were undeniably acting stupid and overly aggressive.
@sallycinnamon5370
@sallycinnamon5370 6 месяцев назад
@@jimbobbyrnes LOL. Not how it works. From what I understand there the defendant was definitely being physically assaulted prior to the stabbing. And getting away from a group drug fuelled young men isn’t actually as easy as you seem to like to think. Had they backed off from the fight once the knife was out then not more than one of them likely would have been injured if that. Just because he had a knife doesn’t make him automatically the one that started the fight. If they started the fight then it’s their own fault that he defended himself. With that many assailants, death was an undeniable possibility. You seem to be under the impression that because he had a knife he had to allow himself to be beat up or potentially killed. That makes 0 sense. Assault with hand and feet can absolutely kill someone…especially in water. Also seems like in that state he didn’t have a duty to retreat. If they started the fight and he finished it. Then they were stupid to start a fight and they lost their lives for it. Parents should have raised them better.

He actually left the boys alone and went back to his group TWICE during the altercation - the last time he went back was to get his knife. @@denised.9500from what I saw in the video it's because the only area that they left open for him to leave the area was into deeper water in the middle of the river. Would you go deeper into water when you're surrounded by a dozen angry people accusing you of horrible crimes and screaming at you? Maybe he could have walked further downstream but that would mean he's further away from his friend group and walking directly in the path that this gang of drunken hooligans was headed. So he was bound to meet up with them again if he went in that direction. Sure, it's easy for us to extrapolate what he should or shouldn't have done, but in the moment it seems they left him little choice but to stand there and take their abusive shouts in his face. And there's no proof that he.punched the woman. Did he push her away? Did his hand hit her in the face accidentally? Maybe. I originally thought this guy was guilty and the younger people were innocent victims. Having seen the video, it's a totally different scenario. He should have been charged with a crime (leaving scene of crime?, destroying evidence?, unintentional manslaughter/ accidental death?) but definitely not 1st degree murder.

I didn't see her whole testimony, but what I saw here didn't seem very truthful. The guy that actually took the phone video of the incident, IMO, actually instigated and continued the bullying of Mr. Miu. He seems like one of those guys who just likes to call people names and humiliate people. It was fun for him till he realized how horrible it all went. To me, the last guy on this video with the horrendous scar seemed like an incredible witness. Despite how terrified he was on the stand, he kept his cool, didn't allow the defense to twist his words, and stuck to his story. He came off as very capable and believable. I agree with others, that Miu could have just walked away. He was the adult in the pool, so to speak. I don't know if he really said anything about looking for little girls, or not. I wouldn't be surprised if the video taker made that up just for kicks. But Miu let it be the catalyst for attacking the group. That smile he made before he pulled out the knife said it all to me. You also can't claim self defense if you're the initial physical aggressor in the situation. It's ridiculous. Also the fact none of those stabbed had any signs of defensive cuts... Telling me that they were shocked that he did what he did. Then how he just walks off calmly after stabbing 5...killing 1....floats down to exit... Puts on shirt.. Hat.. Sunglasses.. Trying to leave.. But cops approached him, and he says I have no idea what you're talking about..you have the wrong guy... I wasn't involved in anything. An odd thing to say for someone claiming they were just in fear of life... And had to use lethal force to defend themselves.... Shows me he knew what he did... He knew he fkd up... He knew he was gonna be on trouble.. And wanted to flea the entire river area... and would have if a cop hadn't already been given a photo of the man from one of the teens video... And if that hadn't happened who knows if this man would have ever been caught. I'd expect if he actually was in such fear he would have just ran away immediately.... And floated down river... But even if that didn't happen I'd def expect him to run to the cops immediately after floating down river while screaming and waving for help. But again that didn't happen. He did the opposite. And I'm not saying the teens acted mature. They were being dumb. They were drunk yes. But words do not give you the green light to punch anyone. Let alone a female... And especially don't the give you the right to use lethal force with a knife, just because others hit you and pushed you back off the girl you made first contact with. This jury won't take long imo.
