Roger- You did your best and saved your client many more years in prison. The stress of seeing a person go to prison is very real and tpufgh to deal,with but the facts were really against you especially with the numerous calls by the client and the injuries to the victim. He was facing 6-10 years in DOC and he will do only 30 months. Good job and that’s a “win” in my book. You have to work with the facts you have. Public Defenders who have to deal with many terrible fact cases will see many of their c,Kent’s go to prison not because they’re bad attorneys but because of BAD FACTS AND BAD CASES. It’s part of the job and it’s what I experienced for 40 years as a public defender. Your feelings show your compassion. It’s not about keeping a win-loss record it’s just about DOING YOUR BEST FOR YOUR CLIENTS AND JUST CARING! You obviously care so congratulations on that. Keep the faith buddy.👍🏻😊🌈

Need more lawyers like you. I am going through mt own case now that is a mess for me and I have to get the public defender and they have done nothing in over 900 days and then the county fired him in January and now the guy I have is saying better take this plea or worse will happen. I have done alot of my own case work and he has done nothing and in the end I am screwed. Your honesty and compassion is the best thing u have heard in a long time 🙏❤
It's really quite simple- what we need to do with the state public defender system is what the federal government did with theirs- impose a certain number of public defender cases on every attorney as a condition of good standing before the court. The federal district courts automatically disbar attorneys that don't do the specified number of public defender cases.

I am a retired defense Attorney. I remember one case years ago when I was a young lawyer, I had some major dirt on both the Judge and the prosecutor, so I used that to my advantage and held that over their heads unless they cooperated with me. Well needless to say I won that case and ever since then I've used that tactic to defend my clients.

The ”trial penalty” should be declared unconstitutional. A guilty person should be punished for what he or she did, not punished for going to trial. Pleas can cause innocent people to go to prison or get a heavier sentence, yet allow a guilty defendant to get a lighter sentence than an innocent person who went to trial.
"aggravated stalking" your wife. Thats so frivolous and outmost rediculous. That dude probably seen his whole life crumbling around him, his freedom disaprearing and all he wanted was his family. Drugs and jelousy are deadly combinations. No man should batter a woman but the fact that a woman can commit open adultry via social media and drive someone to complete insanity blows my mind. I was with a woman for 7 years. We didnt work out so i got with another woman. I was friends with this woman for 2 years prior. Before i knew it i was drunk and we were fighting about other men she was involved with behind my back. It was almost a daiy job of making sure she wasnt screwing around behind my back. The jelousy and alcohol was a horrible situation. I look back years now and cannot beleive the monster she created in me. That simpily isnt who i am, but she made me that way. I never layed a hand on her but im sure if i would of been with her for years something domestic may have arose. Jelousy can turn a man into someone hes never imagined. im now happy with the woman i was prevously with for 7 years. Weve never had anything even close the the magnitude of me and the other girl. Just goes to show.
Here's the thing- I'd have moved to dismiss on the basis that the state attorney as well as law enforcement engaged in unconstitutional discrimination based upon sex and malicious prosecution. It would also stand that malicious prosecution could be brought as a 42 USC 1983 action against law enforcement regardless of the outcome of the criminal case, because we need not disturb a criminal verdict to convict law enforcement as well as the state prosecutor of a fourteenth amendment discrimination charge at a federal civil jury trial. Therefore, I'd have reflexively filed the federal civil complaint for enough money to start repossessing houses and cars and then told the state prosecutor "You drop yours and I drop mine, otherwise let's boogie at federal jury trial". (its a little-known fact that sovereign immunity flat out doesn't apply to a fourteenth amendment equal protection violation because of the fact that prosecutorial discretion is an executive action not a "judicial" one, therefore, depriving a state prosecutor of sovereign immunity under the circumstances.) This is also why I find plea agreements repugnant- as they appear to be a device to unlawfully intimidate one to waive the constitutional right to a jury trial. Rather, it is clear from the facts that law enforcement overcharged based upon the fact that the Defendant was a heterosexual male where the state elected to prosecute due to a matter of politics- where the U.S. supreme court has held that for purposes of the fourteenth amendment there is no distinguishment between sex and sexual preference, and it is unlawful to bring criminal charges out of a political motive, even if said charges are true.
To play devils advocate: The state of Florida went out of there way to charge him for ever single mistake made under duress and a passion inflicted state of mind. I’m not condoning his actions. I’m not condoning the wife’s either because women push buttons and the courts have a male bias it just is that way until we advocate to change it. The state overcharged him in the beginning and how do I know it? They agreed to dismiss 3/4 counts. State prosecutors are obligated to uphold public trust and security NOT SEEK CONVICTIONS. Unfortunately for every US corporation citizen under the null 14th, we are stock in the nation states warehouse and private prisons are the evidence of such an allegation. American needs to do better. And Americans need to educate themselves on the difference between one vs a United States citizen. We aren’t winning like this and it’s a generational curse

I heard public defenders have upwards of 100 cases thats terrifying. Im poor and know if i got in trouble for something i didnt do im wondering if the pd is not gonna have time to look into it and make me take a plea. How often does that happen?
Its individualistic. You have good lawyers, great lawyers and hacks. You have to talk with your public defender to determine their abilities. I have met public defenders that could crush me in a courtroom and I have met others that I wonder how they became an attorney. It's up to individual pride and work ethic and of course, your fact pattern.
So, despite all of the violence that he did to her, you still feel that 3 yrs was too long? You wanted to prevent him from going to jail for his violence and stalking?? How did you feel looking at the pictures of the injuries the victim sustained from your client's violence???? Did you feel sorry for the child having to witness these events?? You got him off light for his actions, so that is a win. To think it could have been 30-60 yrs. Having served as a Prison Chaplain, I met many men who actually did do the heinous crimes they were imprisoned for, who would have loved to have you as their lawyer.

Lets just say our attorney burned us out with our money by delaying my husband dui case.without informing us his rights to a speedy trial..just a Hot ass mess..Refused to give his files when requested. 7months of delayed yet he got 1 incident but in 2 different counties(she was informed during consultationsn n given her the police reports). 7mo into my case n never discovered my warrant out frm the other county in regards to the same case being active at the other county..smh claimed it was not in the system(PO clerk informed my husband about it during his appt after 7mo) also she failed to request to combined both cases at 1 county. I read alot about attorney duties, clients rights, dui laws, talked to severals legal advice, etc. at the same time while my husband on trial, so I.can have a better understanding with how the laws worked. Boy I was surprised by the lack of info's his lawyer left out n not informed us by it. Smh Well, she wants to cont. the case at the other county now after we found out about the warrant there, Rejected due to more delayed n us looking for a new attorney. To our surprised, he showed up at court different county 2nd time n his case case got dismissed n finally he can serve his time. Smh .Her service was about $$ not helping him out. File for requests, approved order without his consents, eg: PR, duties, etc.. Ended up 2nd county case dismissed without combining it n 1/2 of the money was refunded back to us due to incorrect invoices. Request being denied by her..Wont allowed us to meet her at her office, Refused to give his file, Nada...Educate y'all self about the laws n your rights as a client. Too many screwed up n were doomed.
