Your attorney may have good reasons to say just wait (for example, there could be potential bars or issues that would lead you to a referral, or something else that makes that attorney believe waiting is better - we cannot give advice when we are not aware of all of the details). However, we typically file a mandamus after 12 months for our clients if there are no other potential issues. 14 months is a very long wait. If you have not made inquiries to the asylum office, or a Congressional liaison request, you can try those too. Of course with the advice of your lawyer is best if they believe there is some reason you should not try to push this forward.
If inquiries directly to the asylum office have not led to a result, then other options are trying a USCIS Ombudsman or Congressional Liaison request. The other option is filing a writ of mandamus in federal court due to the egregious delay.

Hi Lindsey.. this is really very informative video about pending decisions. You should also make a video based on my questions also that will help the people to understand the process. Here are some important questions if you could reply that; 1. Whether AO makes an initial positive decision and get supervisor’ approval first and then send the case for background check for making final decision OR 2.If after interview, AO is not satisfied and supervisor not approved the case, in that case they will send the case for background check or not or they just send denial letter to the applicant without processing background check? 3. I applied for my 4th EAD renewal but this time I received a separate letter from USCIC that USCIS created an online account for me. What and why is this change for? Thank You
USCIS often creates accounts and send the letter with instructions on how to activate it and follow your EAD application. It's normal, does not signify anything about the asylum case. It is my understanding that in general, the officer is responsible for completing background checks before finalizing their assessment to refer or grant, and therefore before the supervisor reviews the decision.

Because till 2018, after interview, first they issued recommendation letter and then check the back ground. But this policy was discontinued in 2020. So it means that now if someone’s background check is in process, it means that he is eligible for asylum and his case has been recommended and now on the next step, they are checking his background before make final decision? This is what I want know know .
@@nawaemuwadat6619 the situation for someone with a recommended approval is a little different. They no longer do these, but when they did, it was because all other background checks were complete, except for the FBI Name check. There are steps to take to try get your case moving and you can follow up every 30 days with the asylum office, make a congressional liaison request, and/or file a federal lawsuit for a long delay if it's been more than a year.

There is no way to know if it's a good or bad sign when the judge decides to issue a written opinion, and the length of delay does not indicate anything either

@juanmatabsltran. I’m also I’m the same boat . Had In interview in Chicago office 2 weeks ago . They ask me to come 2 weeks later for decision pick up which is tomorrow. Unfortunately I got a call from my attorney that I don’t have to go to pick up my decision. As the uscis will mail it to me .. Very confused and stressed.
@@imms100 We are waiting for the interview for 9 years. We have already sent a request to USCIS. And at the end of this month I will write to my Senator if he still doesn't give me a USCIS response at the end of this month.
Follow up every 30 days, you can also file a congressional liaison request. After a year or more then seek a consultation about filing a mandamus action in federal court.
Hi, I hope all is well.I have one question .I gave the rsd interview 4month before and now they call me for Rsd on-site complimentary interview so I M confuse what is the mean of rsd on-site complimentary interview .please explain me because normally interview taking online and UNHCR call me to come office for this interview.

Hi, my asylum case status changed from pending for decision to fees waived .what does it mean? I didn’t apply for work permit but it says work authorization fee is waived.
If you have had your interview already, then usually this means that the asylum office approved the asylum application and simultaneously order a new I-765, work permit and waived the fees based on the new category. Your decision will likely arrive soon.

@@Deepsidhu1233 it depends on the office, the reason for rescheduling, and how many interviews are available, but you can usually expect a new date 3 - 6 weeks from the date of rescheduling.
@@asadnawaz7245 a small minority of decisions do take years, for various reasons. But if someone sues after 1 year, then they should not have to wait much longer. The office will figure out how to get a decision out the door.
Greetings, I had my Asylum interview with my wife and 8 month old US born kid on October 6, 2021. But my Decision is still pending since from last 10 months, i inquired couple of times but just a general response. What can i do ? Thank you
You can try a Congressional Liaison request with one of your Senator or Congress Reps based on your residence. Depending on which office, you may be able to do an in person inquiry. If you have an attorney, they should be able to assist and make a few different types of inquiries as well. After decisions have been pending for a year, then we have had success by filing a law suit in federal court for the delay.
