Incompetent persons if occupy the positions in any department, the end result will be like the above case. Here also I strongly feel that the reservation system for employment might have played very crucial role during employment of the GST staff.

GST directorate should be penalised for demanding unethical taxes from a company. Tomorrow they can order a grocery store that your sales in the financial year is 1 crore so we need 28 lakhs GST, no matter after the sales of 1 crore the profit is only 20% that is 20 lakhs. How can someone be so illogical at such a high position. Supreme court should take immediate action towards GST dept for harrassing a gaming company.

Delta corp should have deducted the gst from the price/bet money. If you win a lottery, you have to pay all the taxes and only the winner gets 50 to 60% of price money. DG is fair in demanding the GST dues. However, it will be difficult for delta to recover the gst from the winners who have already collected the price money. Amicable solution would be to waive off old claims and introduce gst on price money from now onwards. Otherwise Delta will sink without any trace.

To my understanding the DG logic for GST is correct. Delta corp was smartly deducting an expenditure from sales to report revenue from operations. When you pay prize to the winner which is actually an expenditure for you how can you deduct it from your sales. Suppose any company runs an advertisement contest where the winner will get Rs 1 crores as prize money then they cannot reduce the prize money while reporting their sales. Or KBC cannot deduct the prize money that it give to the winners while reporting their sales revenue. Delta corp has smartly did tax planning earlier which has now came into the eyes of government.

If the same news would have been published during market hours then we would have picked up Delta corp below Rs 100 but fortunately for the company investors got time to look on the issue thoroughly and this basically saved the company although there would be some downside like 10 to 15% but still it’s not going up anytime soon

The explanation is good but you forget one thing to mention .................. the person who won Rs. 900 as a bet .............. why he wont be taxed by the casino. if the bet winner is to be taxed @28% GST then this issue will be resolved. Now the question is whether the applicable tax laws directs the casino to tax the winner or not may decide the outcome of the case for delta corp. Moreover, delta crop can also argue that the person who wins the bet should be liable to pay the taxes as per the tax laws of the country. Please reply me for the above.

As far as I understand if my sale is of Rs 1000/- I have to charge Rs 1000+GST to my customer and pay the entire amount less GST paid on my cost to my supplier & if anyone has bought goods from a supplier who has not paid nor charged GST, then the entire GST has to be paid by a seller. So by this logic the GST has to be paid on the sale value, which in the example given by you is Rs 1000, & not on the profit of Rs 100, what if the person had only won Rs 500 or less, so unless there is a specific provision in the law about gaming companies or casinos as to the method of GST calculation,it is open to arbitration

When the GST 28% was imposed it is clear this amount should be collected from the customers and in turn remit to GST Department as in the case of hotel industry, restaurants etc being followed at present. Hope that Delta Corp Ltd management has not followed the instructions of the GST department and now they are liable and answerable. 😇😇😇
