Accusing someone to their face, in public, that they killed their wife is certainly designed to invite violence. Those would be "fighting words" and likely slander (assuming that after 10 years the Karen didn't have new evidence of his guilt). I'm aware C- is the next-to-lowest grade, and I agree ATA is remarkably good at being impartial. I just feel that while she deserved a beat down, I'd settle for her getting an F.

That "killed your wife" red-faced response, I initially thought pathetic on the Sheriff's part until made clear that she'd somewhat recently died. That was a horrendous thing to say and it infuriates me when people attack like that, then claim to the be the victim. We're human beings, we all have emotions and can easily act irrationally when those emotions are empowered to dictate our actions. It's simply not feasible to expect anyone to "remain calm and collected" when attacked in such a targeted, personal way. We should "try" to and that should be trained/encouraged etc but exceptions must be made on case-by-case basis should the individual lose control. It baffles me how people can do the "you can't touch me" routine whilst they're stabbing people in the most sensitive parts of their heart. I have found that words have greater potential for harm than sticks or stones, having learned to use them effectively as a child who was physically bullied for ~10 years of school. I'd get beaten up, but I'd get jabs in that cut them right back (which of course perpetuated the cycle, but I'd spent the first few years trying to placate, eventually resorting to "fighting back" in the only way I was capable).

It would be interesting if Audit the Audit examined some family disputes in the home: “Here, Mother is factually correct and is within her authority to tell Little Timothy that he is not allowed to throw food on the floor. However, it is likely a jury would make allowances for the age of Little Timothy and his inability to properly understand the concept of a dirty floor or keeping food on your plate. Therefore, while Mother has the power to issue a 'time out' punishment, a more reasonable response would have been to de-escalate the situation and simply explain that it was the wrong thing to do in a stern but calm voice, thus avoiding the 30 minutes of crying that followed." 😁👍

I'm new to Audit the Audit but I've been watching LOTS of the content because it's so interesting. I always thought the older videos were done by a text to speech program so I was shocked to see it was an actual person talking like that. Great channel, by the way.
@charlesdemeary

Idk, I can’t tell if the C was low enough. She invoked the officer and tried to get him to react. She pushed his buttons on purpose and that itself is very dangerous. And then to go and badger this man on her channel? While she has the right I guess, it’s very close to defamation if not harassment. Her comments on this video clearly shows over 1000 people have a clear misunderstanding of the laws. That’s not good for any auditors.

She got a C- . The only lower grade that ATA gives out is an F. She didn’t break the law so it wouldn’t be correct to give her an F
@charlesdemeary
@charlesdemeary 3 года назад
@@tanvir6267 I get that, but I mean a C- is implying she’s not doing “much” wrong. Yeah, I get it she didn’t break any laws in the video but her behavior following the video with imploring her audience to do foolishness in which we just established she should’ve just left and moved on but because she didn’t know what she was talking about she stayed, caused a scene, which seems disorderly to me, and continued to badger the sheriff. I’ve seen people get arrested for standing around after the police told them to move along and she stayed and continued to try and show her power. I’m all fo a good proper audit but if you’re not going to do it correctly you’re hurting the movement especially with officers who try and at least be amicable with you. That’s not easy to find. Officer should’ve gotten an A because he had his buttons pushed and couldn’t be moved. If anyone told you “you killed your wife too didn’t you?!” you’d be livid especially knowing you didn’t. That’s low idc how much you don’t like the police, now if he had said “that’s why your son got shot” it’d be a huge uproar. Can’t expect them to treat you like a human if you’re acting like a animal.
@tanvir6267
@tanvir6267 3 года назад
@@charlesdemeary did you watch the whole video? ATA literally lists out the reasons why he gave her a C- & to me it seemed like the implication was harsher than what you’re presenting. With the police grading section he even mentions that he commends the police for managing to stay calm from her “vulgar remarks”. Bottom line is if he gave her an F for not breaking the law, but instead for being a garbage human in that moment, it would show that ATA is thinking emotionally, instead of from a legal perspective for his grading of her. So if ATA did what you suggest he would literally be the thing you are currently accusing him of being (that being a non professional audit channel).

IMO, I don't think the sheriff would have hit her regardless of deputies being there or not. Someone putting their hand into a fist can also be a stress-induced habit. It doesn't necessarily have to be an indication that someone is about to become violent. It's like clenching your teeth or using a stress ball. The act of causing pressure as a way to relieve stress is typical behavior. Plus, I have to commend him for his professionalism. How many of us could honestly say we would have taken, "you murdered your wife" well in his situation? That's extremely insensitive and an intentional act to cause emotional distress. He has to live with that accident for the rest of his life. He has to wake up every day without his wife beside him and briefly think was I the cause of that? I cannot imagine the personal torture he has more than likely put himself through every single day.

Accusing someone of killing their wife, and publishing that accusation on the internet would be grounds for a lible case. It wasn't a statement of opinion rather than fact nor a "fair comment and criticism" ... which means she would have to prove it was true. Texas recognises that Allegations or imputations of crimes of moral turpitude are categories of false statements that are so innately harmful that they are considered to be defamatory per se. In the common law tradition, damages for such false statements are presumed and do not have to be proven.

You do a great public service making these videos and I personally appreciate the work you do. Maybe it's just me, but sometimes it seems that some of the people that shoot these videos saying they are just "exercising their rights" are intentionally trying to get a rise out of the police. I understand why it's important for people to exercise their rights and challenge the police's knowledge on law and the constitution to teach others who may not know better what rights they have and how to not let government officials violate those rights. Its just to me some of the people featured in your videos are using "exercising their rights" as an excuse to give the police a hard time while they intentionally antagonize them using profanity and insulting speech. They could get much better results staying calm and trying to do things in a way that could be a benefit to all parties. Its like they intentionally want to anger the police into breaking the law or violating their rights.
