As a criminal defense and constitutional law attorney, people often ask me if they have a good excessive force or 1983 case against the police. Here are my thoughts on when you can hold the police accountable for excessive force. jessjohnsonlaw...

Is it true that if four individuals in their official capacity, is named in a 1983 complaint for violating one's access to the courts and denying one access to legal materials while in custody, at least one of the named dependents have to testify even if by deposition, that such rights was not violated? I had a case thrown out via a summary judgment, even though not a single named dependents came forward to deny my contentions, they have all since retired CARTIER D. TASBY, Plaintiff v DARRYL HEIMLICH, et Al., Defendemts

What rights are violated when police and sheriff uses your property for traffic stops, sitting right in front of No Trespassing/No Parking signs? They have been told not to, verbally and in writing.

Criminal trespassing Unlawful seizure or use, technically a 3rd, 4th, 5th and 6th amendment violation And harassment The 3rd amendment doesn't get passed around much in police work But technically, the *Fraternal Order of Police* FOP or Police, are a military uniform. Hence them forcing themselves to be taken upon your land for municipal/official use. Is Totally a 3rd amendment violation, cuz your land is as much a part of your home as you laundry room is square footage of the home Property is property, and using mine without permission for uniform work. Is illegal

What rights were violated when a police chief ordered all persons leaving a certain bar to be charged with DUI and all persons from 9 other bars that got DUIs to be reported as coming from that certain bar?
@donovanulrich348
@donovanulrich348 9 дней назад
If you can prove it It's technically not a singular violation, unless you get flimsy with the first amendment freedom to travel But is still technically a USC 18 section 241-242 violation, and there you could prove they acted in uniform with bias and acted in a illegitimate manner under color of law If they are bar busting ever bar No violation If they target a establishment without cause, that's a clear bias without public complaints I don't care if the owner pissed you off that one time chief, bar busting the whole city. Then you could argue you could toss a few cases, and just so happens the prosecutor kept the 9 in question You can't sue the prosecutor for deciding to keep cases, unless you could prove the bias again 😂

So what if the officer arrested someone accused them of a crime. But then the case was dismissed. Ex: officer makes arrest accusation, then takes person out of handcuffs (detainment) then puts him back in handcuffs after the person began asking questions. That’s first amendment retaliation. Can the officer claim immunity if the criminal case was dismissed without a trial.

Sir do you work in Texas, or do you know someone out here, I was arrested and they didn't have probable cause, Ithey arrested me I stayed in jail for 18 days, but here is the kicker, I never got a probable cause hearing, I never waived my right to have a probable cause hearing. I want to file federal civil action. I have more to tell you, but can't share on the website.

What rights were violated when 2 local cops arrested a woman because they did not like her hairstyle, arrested her again for refusing to leave work, forcibly evicted the woman and her boyfriend (a Puerto Rican), and arrested her again because they stayed at a local motel?

4th amendment Without the crime of theft, you have no right to "investigate" without court document (warrant or court order) a search of person or property. If the crime is theft, then technically if I'm found with the item in question without proof of ownership. Then you get a free arrest and anything incriminating on me is also evidence in the matter Without theft and possession Any search is illegal before a true legal arrest

False police reports It would be hard tho, cuz they can act on "anonymous tips" and the tipster is the deputy yes manning his Sargent or LT But the first amendment, the 4th, the 8th for sure Possibly 5-6. And even tho they are uniform, they we acting in a official capacity with "cause" so I won't try the 3rd at all

Sounds like a court sanctioned sting Not much you can do if that's true But if you can prove the officers used public funds and equipment for a personal grudge, then yeah

You first need a judgement in your favor. For the best result, it needs to be a directed verdict, which is only warranted when there is no available evidence to imply criminality. Once you obtain that, you'll have no problem finding a lawyer to take your case

If you can show that it’s a policy of a department to deprive people of their rights. Then you can probably sue under section 1983 the actual municipality police department.
