I'm really glad you mentioned Etsy - I've been looking into it as a place to sell stationery/etc through dropshipping because so many other people seem to be doing the same thing. Turns out they have a huge loophole where, if you categorize your items as a "supply", you can resell commercial items! Obviously this doesn't work for the scenario you discussed, but that's how so many people are getting around the handmade restriction and reselling items from Aliexpress, etc.

Some people think that when an article or e-book is posted on the internet, it automatically becomes public domain which it does not, in fact, according to US Copyright law, it automatically becomes copyright protected.

On putting a black background on a black shirt, if you add a white stroke in photoshop to the black background it separates the colors and looks cleaner

Etsy doesn't seem to police the images very closely on trademark or copyright rules. I'm sure, eventually, some get stopped but I see TONS as I purchase digital prints to make repurposed books and run across a lot of such images.

the I "heart" NY logo has been trademarked since the early 1970s. The designer, Milton Glaser, is someone that you end up studying in art school.

A lot of great info on your channel for print on demand. I used to dropship but stopped due to sales slowing to nothing on my eBay but this has me thinking of a lot of new ideas to get back in.

That last point doesn’t make sense. You would just remove the black from the black background. A simple task that takes seconds. If you don’t know how to remove a background around a simple logo, or use auto trace to vectorize, then print on demand isn’t for you.

You can have the black/white background on a black shirt if it has a border outline around it with a different color, just not without the border outline on a different colour and aslong as the colour of the border outline isn't the same as the shirt because that would apply to the same design principle as the black background being on a black shirt.

I've done fan art for Comic Cons in the past and most companies like Marvel, DC etc. wink their eye at Fan art being sold at the Cons for at least a couple of reasons. One it's good P.R. (Public Relations). People at the Cons want to purchase some form of artwork of their favorite movie hero as a memento and/or many,as well, take the Fan art to be signed by the respective actor. Two the art helps leverage and promote the movie star guests that attend the Cons with quite a variety of art styles. That being said, Marvel, DC etc. are NOT ok with us selling said fan art from our websites or print on demand. If they catch you, you'll get smacked down. They're ok with it at the Cons but not as ok with it outside of that, unless of course you've got a license agreement with them.

Assume you create 1000 POD products with non-trademarked phrases. Afterwards, it is possible that someone will come along and trademark a few of your phrases. 1) Would you have to delist your product if the new trademark owner contacts you a year after you launched your product and says "we have a trademark on this phrase, delete your listing now"? 2) If so, would we have to keep watch on our POD phrases and do checks on them periodically to see if someone eventually trademarks them?

Sarah, while I find your videos VERY INFORMATIVE.. I've got a question pertaining to the Paris Hilton "That's Hot" Hallmark Card.. Your video makes sense.. Hallmark was sued based on the Trademark "That's Hot".. and, yeah.. Not her image? I mean, the image was really not altered; it was chopped out in Photoshop, and put onto the card.. Hallmark being a HUGE, and very-well-known company, I would think that they especially, would know most about copyrighting, and fair-usage.. I've been digging, digging, and digging on what's allowed, and what's not.. I'll give you my example of artwork I've been doing.. I'm taking photos of older celebrities, such as Marilyn Monroe, James Dean, Judy Garland, and even musicians (thus far).. I'm editing them artistically into halftone images.. I'm making stencils with my Cricut, and slapping them in a frame with a colored background.. I totally understand all of the rest of your video; the Loot Llama, etc.. Even there, EPIC definitely has ALOT copyrighting going on.. But a human being? A deceased human being?? Please Elaborate on this if you could please.. I've been trying to wrap my head around it for weeks. :)

Hi ! I admire your videos, every time you give so much information and value. You motivated me to take an action and since yesterday I am a new student in your dropshipping club! It's so helpful so far. When it goes about this video, I am very concerned about one specific thing which is trademarked logo of the brand, or rather its FONT. Is font trademarked too or can I re-use it or re-purpose it?

Every font has it's own license, so if you want to check, just google "[FONT NAME] License" but replace [FONT NAME] with the actual font name. I talk about it in this video: ru-vid.com/video/%D0%B2%D0%B8%D0%B4%D0%B5%D0%BE-3yp1TspeVMs.html If you're just planning on using a logo's font, like say, take the Disney logo & use the Disney logo font to write your own slogan, then that is technically illegal. The letters used in the logo text design (that you want to use in your font) protected under trademark laws.

There are many people on upwork and fiver just give the artworks that are not created by them, better go to shutterstocks or creativemarket and find artists there.

I'm a little confused about the coffee t-shirt example. I've watched your video showing that it's ok to use a design from Canva, as long as you check the license. However, you can't use a design that you get from Shutterstock, even if you are licensed to do so? Can you clarify? Is that because the Shutterstock image was a complete design that you are reselling, and the Canva images are combined into a whole new image that you have designed?

Hope you are ok and out of hospital now! Ok some very useful points here. So it begs me to ask the question. Where do we go to find out if what we want to use on mugs / T-Shirts etc. is or is not a ™ ....?
