Welcome to Surviving The Survivor the podcast that brings you the best guests in true crime.
Lyle and Erik Menendez were convicted of the grisly 1989 shotgun murders of their parents, Jose and Mary Louise "Kitty" Menendez, at the family's sprawling Beverly Hills mansion.
They’ve been in prison ever since.
But, do they have a new shot at freedom after a bombshell letter surfaced and the release of a new documentary supporting the brothers’ claims of sexual abuse by their dad Jose Menendez.

Being sexually abused by your parents, and then being convicted for murdering the abusers?! That's sick! Those parents deserved it!! Erik and Lyle need to be let out of prison. They have suffered enough!

The Menéndez brothers were removed from the will one year prior to the murders. The money they received was for a life insurance policy that Jose Menéndez had. Each sibling received $250k. Their aunt Marta was the one who handled their money/expenses. #setthemfree

These comments are usually from someone who doesn’t understand how crippling and trapped those two would’ve felt. Parents held the power, purse strings and they simply didn’t have the tools to cope with what was done to them.

@JODI Ellen if you watch all of the testimony at the trial, the brothers were abused and battered by both parents throughout their childhood. Not to mention the father was a rich and powerful man concerned with reputation who saw his sons as his property even as adults. The brothers actually wanted to move away together for college but the father wanted youngest brother to stay at home so he can continue to abuse and control him. The father wasn’t going to let them walk away so easily especially since they threatened to reveal the abuse they had suffered. Similar to a woman in a domestic violence situation who doesn’t leave her abuser, it is very difficult psychologically for victims to walk away.

The prosecutor needs to be charged for not protecting all the children the father raped and child trafficked 😢, they failed to get a guilty verdict on the OJ case, then failed these two children at the time, sent them to prison. The world's is a better place now that they killed thier parent's, can you imagine how many children these brothers saved by shooting thier child trafficking parents?

I can tell you that being abused as a very young child, and growing up with fear everyday, and back during the time period of the menendez brother's, people knew, but did nothing. I was fortunate to be taken out of the abusive situation much younger than the brother's, but i had a fear of my biological dad into my late 20's. I am now 52, but back then, you could be bruised up from just being beat, and no one would say anything, that's how it was for many kid's in that time period that i know, and many have committed suicide as recent as the last couple year's, because they never faced the abuse. I really don't know what i would have done, if i had been left in that situation until adulthood. I can say, if the brother's went through anything like what i went through, they probably were not mentally right, and when no one will help you, what do you do. I feel they should be evaluated, and let out. Many people who judge them, do not have any idea what growing up from diapers in an abusive home is like, when all you know is fea, and suffering, and not knowing what will set the demon off. My biological dad had many guns, and that is scary. I actually found a gun on his bookshelf, and didn't know it was loaded. I was sitting next to my sister, and i asked her if i should pull the trigger, as i had it pointed at my head, and my finger was on the trigger, so i put light pressure on the trigger, and just had a weird feeling not to do it, and pointed the gun straight and pulled the trigger. The gun was loaded, and it scared me to death, not that it went off, but that my dad was gonna kill me for even touching it. I was 11, and this happened at his parent's house thank G-d, because my grandpa went off on him for leaving a loaded gun where we slept, and could easily get it. My grandpa had guns, but they were very securely locked up. That fear about the wine on the rug, i know that fear those boy's had, and it will leave you shaking. Great show joel, karm, and guest's. Would have loved to have been on this live. G-d bless everyone.

I just can't believe that people will not believe what was going on after witnesses were heard. People should know that when a child is molested and or rape by a family member they are not gonna talk because they are afraid and most time this abuse children will end up dead or will do something harmful on other or a community. I believe the judge and jury were not good and this was wrong. Also they did had to serve sentence for the killing of their parents yes,but no parent should put their children trough this kind of horror. I blame the law and parents who are responsible for the well being of their kids.

A few things that make me question the premeditation of the killings: the brothers initially wanted hand guns but were told they would have to wait a period of a couple of weeks. Instead, they bought shot guns because they were in fear of their parents and needed the firearms right away. There was a sense of urgency and danger. If they really wanted to plan this out they could have waited the two weeks to buy the hand guns. Yes, they hurriedly picked up shells, changed and dumped the guns. However, they also left evidence of the gun purchase and ammunitions in their car. Had the police done a thorough investigation/search that night including a gunshot residue test they would have been caught that night. The alibi also doesn’t seem premeditated, more like put together in a panic afterwards. They said they were at the movies but didn’t try to buy movie tickets until after the killings. That’s why they couldn’t even get a movie ticket to match their story because they had gotten there so late. They then were supposed to meet a friend at two different places but either a) showed up extremely late to the event and missed him b) never showed at the Cheesecake Factory as discussed. They never met their friend so how is that a planned alibi ? They also ran in and out of the house multiple times during the killings, anyone could have seen them doing so. Not to mention they drove away from the scene in their own car as well. This all seems like it was done in a state of panic afterwards and not put together in premeditation.

Exactly. Lyle made plans to meet his friend Perry Berman at 9:30 PM. The parents were not killed until 10 PM and they didn't even contact Perry until 11:15 PM. Erik had also told his tennis coach Mark Heffernan on the Thursday before that he would call Mark on Sunday (day of the killings) to make plans for future tennis lessons because Erik wasn't feeling great (lines up with what was happening in the last week) however Erik never called him. It's another witness who can say "Erik was supposed to contact me on the Sunday but he never did". Why on earth would you tell your coach you're going to call him and never do so if you're planning to kill your parents on that same day. Also lines up with Erik's testimony that he spent the entire day out of the house because he was afraid. He was late getting home which is why they weren't able to meet Perry. When Erik arrived home, the argument with the parents began which preceded the shooting. I'm not saying this is 100% what happened but a lot actually lines up with the brothers version of events. This isn't even getting into all of the other stuff like the boat trip, Erik repeatedly saying on the confession tape "I had no choice", "what I did, I did because I had no choice", "I would have taken any other choice". etc....

Eric claims he was away from home for days before the murders. Why come back if you're so afraid for your life. They were both adults. They were free to come and go as they pleased. Their mother told Eric, he admitted, that their father was deeply disappointed in both sons and were planning to cut them off and cut them out of the will. They had no good reason to blast these people to pieces as they watched TV in their home, bothering no one. These "victims" were out driving cars their parents bought and spending their money. Enjoying tennis lessons and ivy League educations. If they were abused, which I don't believe, they should have reported the perpetrators and move out of their house! Give up the credit cards and get a job and seek counseling. Press charges and move on with your life. They weren't children.

The real problem with the abuse defense is this: even if you choose to believe that Jose abused the boys it only explains why the boys shot Jose, but it doesn’t really explain why the boys shot their mother. At ages 21 and 18, it’s also unclear why the boys could not simply move out. Many people were disturbed by Lyle’s reckless spending following the homicides. If we are led to believe that the parents were killed for being abusive, then why is Lyle frivolously spending off their money. His spending behavior suggests an alternative motive for why he chose to murder the parents rather than simply moving out
@gigiarroyo3939
@gigiarroyo3939 Год назад
If you watch the full first trial and all of the information that came out, the mother was abusive as well and in some occasions worse than Jose. It’s a common misconception that she was just a bystander who did nothing. The brothers suffered childhood of abuse and the most convincing evidence being pornographic photos found of them as children in the home amongst other childhood pictures as well as many,many witnesses testimony from BOTH sides of family as well as teachers/coaches. Mental Health professionals also testified the Erik and Lyle showed signs of having been abused and despite being 18 and 21 were much younger emotionally/mentally. Lyle stopped playing with stuffed animals at age 17 to name one example. Both brothers feared the parents who were extremely controlling and concerned with reputation as they were rich and powerful in Hollywood. The parents often threatened their lives including the mother threatening to poison the family on multiple occasions. The brothers always lived a rich lifestyle and grew up used to a certain kind of way of living. It’s not like they were poor becoming rich. Jose threatened to disinherit them and they actually thought they were disinherited at the time of the killings. It wasn’t until an aunt stepped in as financial advisor that they actually found out they were in the will. This was after the killings actually took place.
@YourEverydaySheep
@YourEverydaySheep Год назад
Kitty Menendez was just as abusive as Jose. Her own nieces said she could be a scary person to them so they couldn't imagine how Lyle and Erik felt about her. Perhaps Lyle's spending was a trauma response or perhaps it was due to being an emotionally stunted young adult. Most immature young guys would spend a lot if they're given free reign to spend money. Also after the parents were killed Lyle turned down becoming the executor. If he wanted control of the money then why did he turn that down?

I do believe they were abused but I think they should pay for what they did.... If this was only 10 years or so into their sentence I would say " Not enough time" but being that it's been 27 years maybe they should at least have a chance at parole... Some murderers get a 25 to life or whatever sentence and do get a chance at parole at some point so maybe they should...

Not sure how I feel about this. The crimes were violent but statistically are they prone to any repeat violent behavior? They are not serial killers really. It was a special set of circumstances. I’m sure they would be willing to give up certain freedoms if they are let out, ankle monitors, probation meetings, therapy. The money could be used to facilitate therapeutic living arrangements, job training etc. Just some thoughts. Before they are let out delving into the brothers’s interest in violence/deviance in other areas or did it just focus on their parents. They had horrible role models.

Imagine how many more children Jose would have abused if he hadn’t been killed? Pragmatically, I am glad he is gone. Murder is what CAN happen when others do NOT step in. These men should have been rescued when they were children. If so, this murder would probably NOT have occurred when they were finally old enough and big enough to take matters into their own hands. People who knew or suspected abuse have blood on their hands, IMHO!

They also knew that they couldn't just dissappear, as they stated;, the fathet had enough money and connections where they would have been found and killed. Also, bare in mind these young men then, were not allowed to be around anyone, and even when they visited with their parents, both the Parents were like Watch Dogs, and many times also Shamed.

Their father was abused as a young child. He came to the USA with nothing and made himself a millionaire. He would rather have seen his two trophy sons dead than spoil his name and what he gained financially in marketing. The father was an abuser. The mother was scared to death of the father and did not/could not defend her children and they resented her for that. He told her he was doing this to his sons to see if he could understand why it was done to him. Had they even had a proper therapist, it would have made a difference. Of course it was their father who selected this horrible therapist. Yes, my opinion is, Jose would kill his sons rather than have them report to anyone his abuse of them, which, in turn, would destroy his finances and business. They wanted perfect children and they wanted trophy children and no love, just validation. The father was cruel and mean to his sons in addition to the sexual abuse. Many in gyms saw what he expected them to do, and if they didn't, he would punish them right there in the gym. He was a monster.

Sorry. No excuse for murder - period. A parsimonious should be reviewed. They have been in jail for what?? Over 30 years. I do not believe they were sexually abused, l do believe they were victims of physical abuse. What has happened to them in prison the good and the bad. Who are these men now?

The Menendez brothers have a case and should probably be released if sane enough to be out in public. The murder of the parents was self-defense. Sane people would just leave, but the damage was already done, and they decided to kill the parents instead of leaving.

I remember the younger brother being the least composed of the two. He looked to me rather immature and unstable. Of course this was a long time ago. I agree the mom must have been an enabler and a weak person. I do think the abuse they suffered should be reason enough for a retrial or to appeal. But we need to be careful they don't show any of their dad's traits.

I definitely think this case should be retried or have their sentences commuted. However, there is an element of the case that has been overlooked, namely, the relationship between the brothers. Lyle was the driving force behind the murders and he pushed Erik to participate. Although, on the surface, his motivation was to protect his little brother I think his anger was also ignited in part by a perverse jealousy that he would never admit that arose when he found out the level of attention Jose was secretly giving Erik. Lyle thought he was the heir apparent in Jose’s kingdom and he suddenly learns how close Jose and Erik really were. Remember, currency in their twisted world was very different than it was outside their family.

Just because others have come forward about alleged abuse by Jose does NOT equate to a new trial for Eric & Lyle, nor does it excuse murdering their parents. HOWEVER, they've served 25+ years so they could possibly be paroled, but personally I doubt it will happen. This is just one true-crime-trial watcher's personal opinion.

Their *recorded confessions which the convicting jury heard* and threats to Dr Oziel’s life were enough. The brothers confessed their mom didn’t deserve to die but she’d be an issue as a witness. These people who once sought fame in the entertainment industry are only just now coming forth?
@gigiarroyo3939
@gigiarroyo3939 Год назад
There was never any evidence that they threatened Dr. Oziel’s life. In fact, there were many tapes of Dr.Oziel played at the trial which showed him joking and laughing about the whole situation. He claimed to be afraid of the brothers yet he wanted his mistress/patient to disguise her voice as Erik’s to threaten his wife so he could control her.He was also very interested in the brother’s money and kept wanting to get into business with them/ give them financial advise after he had been “threatened” . Oziel committed many violations as a therapist and he would even take notes about the sessions days or weeks after he actually had the session, so his notes are not reliable. If you watch the full first trial and all of the information that came out, the mother was abusive as well and in some occasions worse than Jose. It's a common misconception that she was just a bystander who did nothing.
@slk8674

@@gigiarroyo3939 the recording of the confession to the murders exists and was played in court. How’d you take that when you watched the trial? My comment comes from the New York Times, LA Times, and many other publications since 1993 and the subsequent retrial. What you’re referring to is extra marital affairs he had, and many other unlinked and disturbing claims. God forbid I should need to find a perfect human being to corroborate something. I would love to put him on trial for the unlinked things he did. But I would like to know whether or not there’s actually any evidence that he falsified what the brothers confessed to. Everything else is irrelevant. I get that people need to consider the credibility of the witness. What did he gain from declaring these confessions from the brothers? He can’t practice, lost his license. Was humiliated, fully audited, and fully “undressed” in court. So what exactly does he gain or did he gain? What reason(s) do you have for him to lie about this? I don’t consider why he’s a crappy human being. I consider things specific to these claims. Until then, I maintain my stance. The tapes of Lyle included this: “LOS ANGELES, Oct. 13 -- The jury in the Menendez brothers' murder retrial heard an audiotape Friday of a session in which Lyle Menendez told his psychologist he would not have decided to kill his mother without the consent of his younger brother, Erik. On the tape, Lyle tells psychologist Dr. L. Jerome Oziel, 'There was no way I was going to make a decision to kill my mother without Erik's consent. I didn't even want to influence him in that issue.' Lyle also complained that his mother was 'always very, very cold,' and that 'she would tell us all the things she could have been.' In a later portion of the session, Erik is heard telling the psychologist, 'I hate myself for doing this.' “
