Never.... Never.... Never allow police into your home for any reason other than for your benefit. (i.e. they are there at your request.) You can talk to them on the front porch just as easily. They will absolutely turn any other visit into a fishing expedition, and not all law enforcement knows and understands the laws they are enforcing. I'm telling you this from first-hand experience.
Another good reason to buy an electronic deadbolt. If you really want to talk and go outside, close the door and hit LOCK. I've had an electronic deadbolt since 1998. So cheap now!
I doubt it's ever for "your benefit". From what I've seen cops only make bad situations worse. It's best to avoid calling them for anything. They're a curse now. Gone are the days of public service. We're sheep to be fleeced now. I know that's not always possible.. Oh and don't answer the door when they call at all. You aren't obligated to talk to them. If they have an arrest or search warrant they'll be screaming that at the top of their lungs and beating on your door. Would love to hear about your first hand experience if you want to share...
Bad neighbors across street didn't answer the door and actually turned the lights off when police knocked on their door to ask about robbery that happened at our store across the street though my parents helped them fix stuff in their house. Possible reason husband not at home and they previously lived in government housing and witnessed someone being shot and killed in front of their apartment. Maybe don't want to get involved and think it is gang related. Hold up squad though knows who the suspects are have to weigh whether to pursue further given no one killed, under age suspects who might be gang related. Complicated.
I live in Canada and so many people that I know believe, to a fault, you have to talk to the police, answer all of their questions, or let them into your home if they demand it. Thank you so much!
They've been taught that by the media, TV, movies, etc. Cops themselves believe that and their arrogance gives them away. Not all, of course...But if you have a handful of rotten apples in a barrel of apples...what do you end up with eventually? I think we're living in the eventually. :)
@@lisbetsoda4874 A good point. Why not cooperate if you are not a criminal? In fact, why not have cameras placed inside our homes to better keep us safe from criminals? Why not implant tracking devices inside us so that authorities can separate criminals from regular law-abiding citizens? Why not allow authorities to do regular home inspections? It would be okay because we are not criminals and have nothing to hide, right? You make a great argument.
I had them force their way into my house 30 years ago at 3 am saying “there was a 911 call from the house”. Problem was I was the only one in the house and I had been asleep. They looked in every room and every closet.
@@trappenweisseguy27 if they force their way into your home, they are responsible for their actions. I would force them into owning that action. My door would be broken down.
I live in a large southern Ontario city and have stopped answering the door years ago. I will speak through my locked door if needed. My city has had an escalated crime and homeless rate in the past several years. Although I live in a more suburban area, we have had increasing shootings and breakins within several blocks of my home.
They just walked into my parents house at 3am for a false call or something that had nothing to do with them. Scared my stepfather poopless , then instead of apologizing they gave him a lecture for not locking our door.. yet if it was locked they said they would have kicked it in.. he told them they were the only intruders in 40yrs
Have you ever considered doing a comprehensive video to discuss the primary differences between what we always see on US TV versus the Canadian reality? Some people think that Canadian law enforcement must Mirandize you (not a thing in Canada) and I was recently surprised to discover that, in Canada, your lawyer isn't even allowed in the room during an interrogation by police.
Good idea. Too many Canadians brainwashed by US media. More people need to be educated on Canadian law and politics becasue believing everything we see from US media isn't helping anyone.
In Canada, you pretty much do as you’re told or you will pay, one way or another. They prefer asking forgiveness than permission. If you feel your “rights” are violated you can call a number and talk to someone in India.
Yup. There is always a caveat here. There is always the 59% that will gladly throw you under the bus because they support the police. I support the law and rule of law, I don't support slappies with no accountability.
Unfortunately you're right. In the States if they violate your rights and get some evidence of...something, it's thrown out in court. In this messed up country, they can use it in court and the cop gets a "bad cop, no donut" moment. What a joke.
That's ridiculous, the government doesn't use Indian tech support. The person you talk to will be FROM India, arrived 4 years ago and is already full citizen of our great country.
@@dhache1195in this case this answer is true. Exceptions being in fresh pursuit and as an officer you witnessed the guy/gal run into a house, building etc then the door can be breached. I have turned " knowing my rights" from a hobby to a passion. I have read and watched everything I can find about Canadian law to the point that, I will never be tricked or coerced by law enforcement to unknowingly give up my rights. . . . BUT this is what amazes me, I'm 65 years old and if I mention one of my rights to friends and guest when in a social circle, I simply can't believe how many fellow Canadians do not know their basic civil rights. No wonder Canadian cops abuse their authority on a daily basis, 95 % of Canadians do not know their rights are being abused, it's a free for all for Cops in Canada. Even basic rules of the road are not known to my family and friends until I prove it to them...for instance, ONLY in Ontario and Nova Scotia does a driver HAVE to abide by signage and pavement markings in ANY parking lot. You have to treat lane ways, thoroughfares with the same respect as a highway when in a parking lot, drive over painted parking spots to get to the exit quicker and hit someone while on the way, YOUR fault instantly, because you were not in your proper lane. I myself was not aware that in Canada, when I PARK my car, I'm obligated by law to engage my emergency brake every time, AND if on an incline, I am obligated to cut my wheels a proper way of that's another ticket ... incline UP with curb..to the left, incline UP with NO curb, to the right. Incline down with curb...to the right, incline down with NO curb, to the right. Do NOT take your seatbelt off until your car is in PARK, do NOT put your seatbelt on as you are leaving a parking lot, all of these is against the law... I even read EVERYTHING on Canadian Civil Forfeiture Laws in Canada, that is where the cops can stop you when driving, and while doing a " legal" search of your car, find cash, and then TAKE IT, by saying you " MIGHT" be on your way to buy drugs, no other proof, except they said they smelled dope. Your money is gone, LEGALLY. You can hire a lawyer to get it back, but unless that bag of money they took is $100,000 dollars, it will cost you more in lawyer fees than what was in the bag...AND it takes YEARS to get that money back. . . AND, once the Provincial cops realize that you have hired a lawyer, and you're fighting to get your money back, they THEN give it to the Federal Government, minus their small cut, and NOW you have to fight on a FEDERAL LEVEL to get your money back ...years and years before you get it back. I know, I know ...you are saying " why would anybody carry a lot of cash on them" ...well, this one man was travelling from Nova Scotia to New Brunswick to purchase a rare Corvette car from an OLD GUY, who insisted that he be paid in cash for the car, or no sale, so the man had $40,000 dollars in his car, safely stowed in luggage in his trunk ...cops stopped him, ran his name where it revealed he had a record of possession of drugs TWENTY years ago, said that was enough suspicion to take the money because ...the man was on his way to New Brunswick to purchase drugs .. Money Gone. ONLY 3 provinces in Canada do NOT have Civil Forfeiture Laws, Newfoundland, North West Territories and Prince Edward Island. That law was invented to take criminals fortunes and disperse it to honest victims of crime, but in British Columbia ALONE, since it was invented around 2006 ...1.5 million dollars has been given back to citizens ...BUT in 2017 ALONE...JUST THAT ONE YEAR... British Columbia pulled in ....22 MILLION DOLLARS under civil forfeiture laws. It's so bad, how many Police Departments are stealing from roadside tourists, that you CANNOT locate data on how much money the cops took in AFTER 2017 ...The Government legally blocked that data from being available to " the common man". Guess what American Police call their Civil Forfeiture Laws down there? ... " PENNIES FROM HEAVEN" ...think about that for a minute. PS: There is a website that gives a rating from " A " to " F " for each province that abuses their Civil Forfeiture Laws and British Columbia AND Nova Scotia, where I am, both received " F " .
Dude, know your rights. I was in court and the JP told me the Prosecution does not have to provide disclosure AND if I wanted that to get it myself. Now what kind of fucking trial do you think I'm getting? 3rd time in the Court, they still had not provided disclosure and JP refused to throw out case. All I know is that the appeal will COST ME MORE $$$$. Any time a JP is recorded as saying such stupid thigs they should be disbarred.

After what happened in Nova Scotia (Fake RCMP officer), I will not open the door to the police. I will call 911 first and ask them what the problem is.
Do the same even if a police car lights you up just drive calmly and slowly calling 911 asking if police have a car trying to pull you over with your location. Control will radio that info open broadcast and if they get a 10-4 they will tell you yes it’s safe to pull over for them.

Everyone knows the difference between SHALL and MAY? SHALL means you have no choice and must comply. MAY means it’s up to you what you want to do there’s no law making you have to do what they say.
I had to deal with a couple of swatting attempts in recent times. The first time the RCMP came, the claimed they got a phone call about something happening in my home and threatened to kick my door in, but I refused to comply and told them to leave. A week later, a tactical unit arrived and threatened to kick in my door and arrest me for obstruction if I did not comply. I recorded everything and I was led to believe that I had no choice but to comply. They cuffed me and raided my home briefly, but then left my home and released me. According to their explanation, a neighbor was calling in that there was a mass shooting in my apartment. I have a hard time believing this, or how the RCMP would believe this, and from the video of them searching my home they looked in my closets multiple times. They appeared to be recording the inside of my apartment with their own bodycams. They said they would investigate the caller for public mischief charges, and I said I wanted to press those charges, and then later on the RCMP supervisor told me that they would only consider it if the alleged caller did it a third time. I made a ATIP request for all their documents on this, since I don't really believe them, and I have received nothing back. This is actually a scary situation because one of those times, I didn't even hear them hammering on the door. I wear noise-cancelling headphones where I don't even notice fire alarms. It really seems to me that they can make up the emergency situation excuse to cover up any other reason they want access to your home. When they threatened to charge me with obstruction, they refused to show themselves outside of my peephole and I had to call a dispatcher to confirm that they were actually police, and the snarky dispatcher told me "well if police were at my door, I would just answer it". Who knows why they are there. They could be just making that up because they have bogus charges against you and you are now being hauled off to the camps in the middle of the night with no idea what is even happening.
What you need to do is go to their station and claim that you feel unsafe and request a police car in front of your house and keep going back and waste their time just like they did to you. Every time you do , they have to waste their time.

You forgot one other exception, if someone is a legal hand gun owner they are allowed to come in if they want to see something in relation to that hand gun.
Thank you. That's very good to know. But what if they are at your door to serve due in court papers? Say if someone is taking you to court or having you charged with an offence. Should you just not open the door and tell them to leave the papers on your porch or maybe slide it in a window?
People need good old fashioned screen doors for their homes. That way you can lock the screen door and still be able to open your front door. Keeps strangers out while you are still able to converse for them.
Why do you see all the houses in American cities with heavy duty welded steel “screen doors”? They can communicate if someone feels like it and that door can’t be kicked in even by Walker Texas Ranger.
But pay attention to any videos showing cops at a door: 1 of the first things cops do is open the screen! So you open your inner door, expecting a screen dividing you from the knocker, but instead it’s cops- who are trained to step forward and invade your space. Then when you step back, the cop will claim that he considered that an invitation to enter. Only thing you can do is reach for the screen making excuses about the cat getting out (even if you don’t have a cat😂). Pull the screen shut and latch it. Mostly the cops won’t allow you to close the door.
Also, a clarification, you do not have to open the door to police if there is an arrest warrant for you. Contrary to the legal advice provided in this video, you only have to if the arrest warrant is accompanied by a "Feeney Warrant" which is a warrant to enter the property to execute the arrest warrant,

A bunch of years ago I was sitting in my living room with a couple friends when there was a knock on the front door. I answered it and it was 2 cops informing me there was an alarm in my garage that whent off. I calmly informed them there was no alarm in my garage and they had the wrong house. RCMP officer insisted he had that address right and for a few minutes we debated with me staying calm and kept repeating there was no alarm in my garage but there was a 100lb German Shepherd that was no longer sleeping as it was maybe 11pm and I am sure she could hear the voices. So eventually one cop say to the other go check back with dispatch and sure enough the alarm was a few houses down. I am thinking whoever set the alarm off was long gone by then. End of the day calm heads prevailed and no one was hurt and I have no idea if it even was a legitimate garage alarm incident.
Pretty sure if they want in they're not going to make that distinction and if it gets to court they'll testify that you invited them in. Unless you've got video proof to the contrary who do you think will be believed, you or them? Recording them on your phone won't help since they'll just seize your phone as evidence then mysteriously lose it.

I'm not so sure about the "hot pursuit" issue. Many years ago I watched a car race down our street, screech to a halt in front of one house, and then the driver got out and ran into that house. A police car, in "hot pursuit", with sirens blaring, skid to a stop behind the first car. The cop raced to the front door, stopped and KNOCKED!

What about when they say they have to come in under a child protection law “to search and see if said missing kids are hiding there”. They don’t have a warrant or anything.
Remember years ago the fire department thought they could just show up at your house and check fire alarms? Ya, didn’t let them in and no repercussions.
The FD came to my door and asked if I had working smoke detectors. I said "yes" and invited them in to see. They said "No" and wished me a good evening.
You missed a important part. If they come to your door with child protection officer. They can enter. Our son and his ex were in a custody battle. His ex said his daughter and him was at our house so they came and went though not in our home. Don took her to court and was given by a judge 100% custody. So when a person says lies the police can enter in Canada.
Can you open the door to look directly at the police and refuse them entry to your home? or does opening the door automatically give the police the right to enter?
IS opening the door an invitation for them to enter? Or do they need to ask you to come in? Opening the door I have always been told is fine, but do not give them permission to enter the dwelling. Also if you open the door, then decide to close the door is this ok?
no. My mother is the manager of a building. And it’s full of drug addicts who are loud and obnoxious. The police are called at least once a day for a noise complaint. And every time they go up and knock and the people just don’t answer the door. You don’t even have to say anything to them. They knock, you ignore. They go away. If you really want the police to get a neighbour to shut up…you have to tell them you think someone may be in danger in there, which with drug addicts is an easy thing to justify. Then my mom can just give them the apartment key. OOOH, they don’t like that, let me tell ya. They shut up real fast after that.
All true. You are not obligated to answer the door or to talk to the police when they come knocking. However if you are a suspect who is wanted by way of either a warrant or on reasonable and probable grounds, you can be arrested anywhere outside your residence, at anytime. So you might want to consider accompanying the police when they come calling. Otherwise you might find yourself getting arrested in a less than convenient location, like where you work.

In the rural central-interior of our province, a number of us have solid doors without peepholes or windows. I was told that if I opened the door, it was a tacit invitation for the police to enter without cause. Don't know about the truth of that.
If they want in and you open the door at all I fully expect they would jam it so you couldn’t close it and make it very difficult to get the door closed. It would be very easy for them to claim that you opened the door for them as they didn’t have to break it and if they “misinterpreted” your action of cracking the door it probably just gets argued in court. Install a peep hole, camera, ring style door bell or a glass storm door. Anything to not have to crack the door and this goes for anyone at your door.
Same goes for it being a good idea to not let social workers come into our home to do a welfare check if we are experiencing a pattern of being harrassed by someone who is making mischief calls in their set of ever changing D.A.R.V.O. strategies which means deny, attack, and reverse victim & offender.

They wanted to look in a closet behind my Queen Bed. So i explained they would have to move the bed because my 3 spinal-cord injuries prevented me from moving such a heavy piece of furniture. I asked them if they thought this was a wise use of the time of 8 constables? Have they spoken to the complainant? When do her actions constitute malicious mischief? Did they ask the history of how many times this call had been actioned by entering my apartment.? They never came back after that, nor did i receive an apology.

It's been 30 years since my high school days so maybe it changed, but I doubt it.
