I'm less than 3 minutes into it, and I burst out laughing at this one. That was one terrible performance! I've heard a lot of 911 calls by murderers in those shows and they're always like this, although this one was even more dramatic and pathetic than normal!
I am outraged he got only 20 years and an option for parole. They need to take him to the top of that mountain in a car, make sure there are three open gas cans in the front seat next to him, strap him in, and push.
One fact missing from this episode is that Bergna had TWO trials--the first ended in a hung jury. There was not one smoking gun here, there were lots of little things like the gas cans and the ball cap that simply couldn't point to this being an accident. Knowing the area like I do, if the brakes had gone out of the truck and he couldn't have steered it to the left, he would have crashed straight into the railing and have been killed instantly. There's no sloping embankment like where the murder happened and where he could just plant himself there. Lots of people have died on that road, and the blind turn just down where Bergna killed his wife is scary as hell. You can't see who is coming around that bend.

How did he jump out of a moving car and make sure that the car would go through the rail and go over the edge causing his wife to die? It seems like it would be hard to make sure that everything happened perfectly.

The incident was covered on another True Crime show that came out several years ago, and I didn''t spend a lot of time thinking it through.then. But revisiting it here the facts don't fit. The pickup truck punched through the guard rail, so it must have going at a good clip. Bergna would have had to behind the wheel nearly up to the point of impact -- remember, steering wheels are balanced to recenter when the hand is taken away. This leaves a very tiny timespan to open the door and jump out of a moving car, lose his hat, get the asphalt scrapings in his shoes, and then ...what? Did the rest of his 20 mph momentum carry him over the edge? The upshot is that he pulled a stunt that normally requires a Hollywood stuntman and several practice runs. This seems beyond his capabilities. He could easily have been carried along with the vehicle and died too, or rolled the wrong way on contact with pavement and gotten run over by his own truck. If I was on the jury, I would have strongly questioned whether Bergna was physically capable of pulling off that piece of stunt work. Further, he should have had some serious road abrasion from it. The milder abrasion and dirt patterns on clothes seems more consistent with sliding 50 ft or less down a dusty, scrub-covered hillside. I'm not saying he's innocent, just looking at a hard-to-swallow part of the State's timeline.
+LexipMedia I also saw another show in this incident that went into a lot more detail of the re-construction of the accident - they skipped over it here - but there was a lot of testimony and evidence that it was staged. If memory serves me, they determined the bolts holding the guardrail were tampered with, also the angle of impact was virtually impossible to have happened accidentally - posts of either side of the opening had not been touched by the vehicle, which means it approached down the left side of the road and made an abrupt right turn and hit the guardrails at an almost 90 degree angle. Highly implausible to have been accidental. Lack of tire tracks on the road suggest the truck was moving relatively slowly, at speeds well below what the guardrails were designed to protect against.
