Don't Get Arrested for Carrying Your Own Prescription Medicine

It's illegal in Texas to possess a prescription medicine not prescribed to you. The charge is possession of a dangerous drug, and it's a misdemeanor. This can be a problem for people who carry their medicine in a container other than the prescription bottle. If an officer thinks that you aren't the person that medication was prescribed to, he could arrest you. To avoid this, I always recommend taking a picture of the prescription label and, of course, never consent to searches by police.

I just watched a video about a young lady traveling with her mother. They were on a road trip and had just changed out drivers….the daughter was in the passenger seat and mother was driving. The officers were arresting the driver (the mom) because the daughter’s medication was in her purse (the daughter, the passenger) and “within reach” of the driver! The daughter was mind blown and told them “she’s not taking the meds, they are mine, we just swapped out driving” so they took that admission and put the passenger through a dui! Both get arrested! Her meds were in their original bottles in her bag. It’s just incredulous! I take medications that are considered a controlled substance and I have them in my purse all the time! I guess my question is…..does it matter where ur purse is? Should I be driving with my purse in the trunk? That’s what those officers told these people! I’m almost 50 and have never been pulled over but this is scary that I could get a DUI simply for having it in my purse in the seat next to me or behind my seat. That’s insane.
