Everything is negotiable, but only fools negotiate with fools. Remember you are not buying or selling a home.. You are entering into a minimum one year relationship with a foreigner in a foreign country. We are treated very well in the Philippines; however, there are unscrupulous people everywhere and it is smart to know your rights as defined in the Philippine Civil Code.

When you see clauses as unreasonable as the examples provided here (especially several in the same contract) I recommend walking away.

I have been renting a cheap apartment in Mandaue City, in the Cebu metro area, for a year and a half. The only rules are to keep it clean, no pets. and I am responsible for minor repairs. I had a faucet break and I fixed it myself, easily and cheaply. I dont mind minor repairs because the rent is very cheap. I have been looking at other places online. Some of the most egregious rules that I see are places which demand 12 postdated checks to lease, or have curfews or prohibit guests or even prohibit cooking. Many places which would be perfect for me only allow motorcycle parking. Some townhouses also have HOAs, which could be problematic.

Great tips. Agreed, if they try to put one over on you (like trying to make you pay for normal wear and tear), just walk away. Another red flag is them demanding a year's rent upfront. If problems come up, they're not going to be incentivized to fix them if they've already got your money.

Thanks for saying, don't rush, because my goal is to move into IT park, but to stay at a AirB&B first and do my due diligence to find the right Condo/ owner that is right for my needs. Thanks for the info and I'm just subed

google - metro hotel cebu . walking distance to it park for 12k a month or lot 8 condominum 18k and 25k a month , they give back deposits

Always write Without Recourse above your name when you indorse contracts. Study the UCC . Also, write Without Prejudice above your name when you indorse your visa extension paperwork. 👍

Last year I rented a condo in Cebu City didn't realize I agreed in the lease to pay for upkeep of grease trap under sink of course kitchen sink became clogged within 2 months of moving in ,the maintenance man said it hadn't been cleaned in 9 years the smell was beyond putrid , had to evacuate apartment while he cleaned it , it was an extensive expensive job , $80 with a well earned tip 😢

You bring up a great point. Must of us have never seen a grease trap. I had to ask what it was. I pour dish soap in drain and let it sit for a while and then pour boiling water down drain. Don’t know if I’m waisting time doing that, but I feel like it’s a good preventative measure. Thank you for the excellent contribution! Best, Joe.

Interesting hearing the lease clauses. The house/condo owner wants to have their cake and eat it too. They do not want to incur costs that is required to operating a rental unit. They all seem to be using these nonsense clauses. I have heard very often the tenant is required to fix or repair things that break in their unit. Many landlords require post dated checks for every month of rent for the length of the lease. Crazy. Many also require 2 months rent, plus a security deposit. Many have claimed the landlord comes up with reasons not to return the security deposit, and the ones that do it could take 1 to 3 months to get that back. Yes filipinos are accomodating, however often times that is not the case when it comes down to business deals.

@@Joeysgonerogue Yes I do not think that it is the norm, but sadly has occurred to expats. If it happens what is your recourse, not much. Will cost you more time and money to get it back so you can only move forward.

Another very informative PH condo video. We need more of these. Your point about negotiating too much is heard. What's your take on negotiating things like 2 months security/rent upfront down to 1 month? Also, wasn't quite clear at the end. I take it that 1) the crazy contract condition examples were from previous examples, and 2) That when you mentioned the attorney, that his condo contract is a different/separate example of what a good contract (and negotiations) is.

Hi Kim, Thank you. I don’t mind the 2 months deposit if the owner appears to be financially secure. I looked at several condos where I got the impression the owner was unable to or unwilling to maintain them. For those I would definitely not want to pay 2 months deposit. Two months advance is not much of a concern to me. Kind of frees me up to buy all the things you need for a move and not worry about rent. Both of your assumptions are correct. I have leased several places in cubao - Manila - land lords always want to negotiate repair costs - split costs etc - my experience, never rent where owner is in another country and broker has no authority for repairs

Hi Dan, I agree. It’s impossible for most of us to get a Philippine checking account so it’s off the table. Even if possible, as you say, it’s a really bad idea. When they have your money you have zero leverage to get problems resolved. Best, Joe.

Very good info bro! I am currently working on 1000 SQ meters of land with the owner and a lawyer for a 25 year lease at the beach in Cagayan de Oro Mindinao. No stipulations or requirements and paid in full. I plan to just build a cheap traditional Filipino house. Not investing much money and the owner has assured me that it will be my land for 25 years with no requirements and for me to do with the land and build whatever I want with no hidden fees or regulations. I plan to pay for the lease in full after the agreement is completed and build a small house for retirement. Should I be cautious?
