Well the U.S have continually refused to acknowledge the ICJ's jurisdiction, even in the Nicaragua case you mentioned. Safe to say the U.S government wouldn't bat an eye if Cuba tried to sue them there, so he kind of has a point.

It's interesting to watch this now, just after President Trump's speech about Cuba. I see a blending of both ideas in the current attitude to Cuba, but especially Marco's ideas.
Quite simple: one is trying to lecture CUBA how to govern, and the other is trying to get the "best deal possible" whatever the F that supposed to mean?! Now normally I would be more in favor of Rubio because of his roots and obviously he corrected Trump on his false statements regarding the embassy and the reparations, however the point where he lost me was him patronizing Cuba or scolding them like a naughty child! Cuba can use tit for tat counter arguments by stating; "you tried to execute a head of state", which is not only a violation of International Law but also a catalyst for diplomatic relations. I am not seeing either player being "correct" when it comes to Cuba.

The Debate was in Miami which is Marco's home town, the topic of discussion is Cuba, in Miami where the demographics put the white population at about 70% now half of that are Cuban and about 20% of the black population is of Afro-Cubano decent. This is a serious topic that has effected the population. Marco Rubio's response to the question was a serious response that he has been supporting for a long time. On the other hand Trump's response was silly, for lack of other words. Stating Cuba is going to Sue us, or he's going to shut down the embassy and then work up another "Deal". Donald needs to start answering questions rather then going to his hot button words and trying to spin the conversation.
