I don’t think she was lying. I think the realization hit because when you get like CS or something like that, they didn’t have a detailed list or app before to check your deposits but they do now as in 2023! She probably didn’t know, just knew she got extra funds…also she has a WIFE so his crappy reasoning is just that. He could’ve just let the child have the money since he will still be paying anyways but it sounds like he’s the one that’s spiteful since she has a wife now.

Hopefully he has court order in place since he’s paying child support. He could be one of those that don’t actually wanna be a parent so he doesn’t want any custody and only pays child support

Assistance means help ppl don't assume she doesn't work. Minimum wage is not enough to live off of. I make over Minimum wage a lot over and wish I got help bc the cost of living is wayyyyy too high to not live check to check. Don't make judgement because u feel like getting help is beneath u

She thought she could get away with it and because it’s child support she would win. A court order is a court order. He pays what he’s assigned. Nothing more. Nothing less.
That's true, but the state is collecting then dispersing his payments. When they realize that they overpaid the defendant thay can and will withhold the overpayment from future dispersments to recoup the money. She wasn't entitled to it but the plaintiff should have straightened it out with the state that collected the money. If she was honest, she could have prevented what will now be a fight between the states, and her until they're satisfied that this judgment meets all the requirements for repayment. Most states that collect and disperse child support have their own procedures for recouping overpayments.
I worked in family court it happens more than you think...sometimes they take a man income tax and release it to the baby mother who spends it and the father didn't owed at that time. It's almost impossible to get a refund if money spent..it will become a credit to his payments.
Yes, same here. I have never seen anyone GET CAUGHT for accepting overpayment. Almost every person on any kind of public assistance would never pay back an overpayment even when they know it. They think the government owes them millions of dollars, meanwhile there are so many people who barely make ends meet for their household BUT still pay taxers that go towards these people, like it could be her neighbors. Some people used to prefer earning their money even if that pay is LESS than the amount through public support because they had honor and pride. And lived within their means. Now NO ONE has any honor and practically brag about getting government funds when it really means mooching off your neighbor.
Yep we have kids that these low life’s have and we support! I’m not sure why working people can’t claim them on our taxes. I dead serious! I used to work for the state of Florida and these women would come in with gold and new clothes driving a Lexus or BMW and I would listen to them tell each other how they scam the system and cause a huge scene to get what they want. Mean while at the time I made $7 and hour and my husband was injured and didn’t work for almost a year. He didn’t get any kind of assistance just me and my $7. I filled out the information to try to get assistance myself and I’ll tell you exactly what the supervisor of that office told me. She brought me into her office to tell me that I was not disabled, I didn’t have kids and I “ was not of minority “ which meant I was free, white and able! This stuff makes me sick! I feel like anyone on assistance should be mandated to take birth control or even a birth control shot so they can’t get pregnant while on government assistance. I also think they should NOT be allowed to file taxes and claim these kids and get $5,000 or more per kid! THEY SHOULD GET NOTHING BACK. I also feel if you get any kind of assistance if you are not totally disabled then you need to be mandated to give community service! The system is as disgusting as the people on it!

As a caseworker whose WELL VERSED in the TANF (cash) program . What controls the amount of cash benefits you get, is INCOME. It likely decreased, bcus she got out of the program to move back to New York, those child support payments resumed going to her. She is such a liar 😂

Moral of the story; be careful who you have kids with!! I don’t care for neither of them. I understand why she didn’t want to give it back, he probably feels his contribution of child support is enough. He literally said at the end “just to communicate with THE daughter”. Again, adults need to make smarter choices when sleeping together unprotected. Too many single parent homes!

If he wasn’t paying he’d be behind & in trouble. It’s only right that since extra was paid via child support that he gets it back. Who is to say that he doesn’t do extra for the child besides the court ordered support so good for him.
Everyone is overlooking the fact that she left to go to another state on the other side of the country and he’s left without seeing his daughter. Most would stop paying child support but he still did. Good on him and good for him for getting back his money.
You can't just quit paying once a court orders payments. It's going to be taken out of your pay. You can duck and dodge all you like, maybe quit your job to stop paying, but the system always finds you, and you'll be looking at jail time for non payment. The correct thing to do is go to family court for set visitation and custody.
@cindywilliams8188 This is only true if you have a custody agreement in place. If the parents have never been to court and custody hasn't been established, then one parent can absolutely leave the state with the child.

We don't know that he does not do extra for the child. The way the mother went about it is just wrong and there's no denying that. That's not the way to get "extra."

The defendant looked so innocent, meek, honest & believable when telling her story of woe but because this judge has extensive "life experience' in the courtroom & is so thorough in her investigative prowess she is always able to uncover the truth with relative ease. "Beware the face of virtue for none is so dangerous" & the defendant clearly reminded the audience nationwide of this fact today.
So what she is saying is if you get government assistance i.e. welfare. Once the dad is placed on child support. The child support goes towards paying the Welfare back., The state takes the money. Ex.If she received $5000 in welfare, once he starts paying childsupport( garnishments, withholdings etc) the $5000, has to be paid back to the state before she gets any of the child support.

She put him on child support because she went for public assistance! In New York it is REQUIRED to file for child support as well. You don’t know this man to assume he’s a deadbeat father and she also didn’t say he was a deadbeat. She’s the type who would have made that very clear.
