It's been 40 years since supervised release was first introduced into the federal court system by the 1984 Sentencing Reform Act. Supervised release, which replaced federal parole and probation, is a secondary sentence judges can impose that only comes into effect once people have already served their time in prison. The legality of the widespread use of supervised release, not to mention its overall constitutionality, is highly controversial. Jabari Zakiya joins Rattling the Bars to make the case for the abolition of supervised release.

Supervised release is unlawful as it violates the Separation of Powers Doctrine. The US has a triparite system of government which is comprised of the Executive, Legislative, and Judicial branches. Once a person(s) is charged and adjudicated the judiciary has the ability pronounce and determine punishment upon conviction. The court has the lawful authority to transfer jurisdiction of the prisoner to the "Executive Branch" i.e. FBOP for the "EXECUTION" of said sentence. This is where the unlawful slight of hand takes place upon the completion of term of imprisonment the "Executive Branch" FBOP unlawfully transfers jurisdiction back to the "Judicial Branch for the "EXECUTION of term of Supervised Release." Nowhere in the Judicial Branch's constitutional authority does it provide for the court to "EXECUTE" a term of imprisonment nor Supervised Release.

We do need major reform of the fairness to sentencing for crimes that are made for future peace to citizen of our nation👍🙇💞🙏✌️

All actions, from worst to best are just manifestations of our bodily particles due to unfathomably complex conditions i.e. environmental, political, parental etc. Every prisoner should have the right to return to a supportive society once they have been corrected.

They’re never corrected. They’re just bad people who get out of prison and do more bad things to good people.

Looks like my comments vanished. Hmmm. My brothers life meant nothing to the 6x felon who ended him. He was on parole at the time, didn't stop his crime.
