I can understand if the dog has a penchant for getting underfoot, and you just mention to watch out for the dog, he likes to get under people's feet while they are walking around. However, if that's the case, move the dog to another area if you are having company. Or pick up the little rat. (I hate pomeranians, if you couldn't tell haha). But don't take that as me being happy it died, I love animals, and I am saddened that it did pass. Though I bet there were underlying issues that she does not want to admit.

Had she said be careful of my dog then that might be more believable... Do not step on my dog is a stretch.

I would have believed her more had she said "watch out for my dog - it's small so be careful" - I do not believe her "please don't step on my dog" line.

The only way "please don't step on my dog" is an acceptable phrase to use is if the defendant was threatening to step on it. Unless he was angry and threatening to kill her dog, that phrase is out of left field and didn't belong in the conversation

I often say "Be careful don't hurt our dog"... To my 3 months old baby, before picking up when he crawls too close to the dog. I also tell the dog ""Be careful don't hurt my baby" when she gets too close to my son during tummy time, a second before picking him up. It's a short and easy sentence, so a good way to teach dogs and babies to interact very early. I would never ever say this to an adult or an older child though, let alone expect that my responsibility as dog owner ends when I said that!

I think i agree with you. They had known each other for a few years. I think any reasonable person would offer to help with vet bills. I think JJ could have at least said he was partially responsible - even if it was an accident. I guess in JJ’s mind because the dog is so small, it’s very easy to step on them, so the plaintiff should have put the dog out of harm’s way.

If it’s true, why would she have allowed him to drive her to the vet . The dog was 12 is there any proof the accident was what caused the dogs death?

You have the obligation to not allow your dogs to run around when you have guests. Contain them or don't have guests. I've had dogs all my life too and none have ever been stepped on by anyone. He was not negligent.
