Hahaha this is classic Phil. He shows "proof" that he didn't use that guy's logo but that "proof" actually shows the he DID use it. In his photoshop picture the P (which was the only different thing) was edited separately as its own layer vs the rest of the logo. This shows that he literally did take that guys logo and then edit the P to be bigger. Also when you put tm at the end of a logo that means it's an UNREGISTERED trademark. It counts as a trademark without having to go through the trouble of getting it registered. That's the whole point of putting tm there. It doesn't mean it's a registered trademark. So phil going to the trademark database to prove it wasn't a trademark just shows what a goon he is.

If you had never heard of Hulk Hogan in your life and just came up with "Hulkamania" because you're a huge fan of the Incredible Hulk and used a totally different font for your logo, you still wouldn't be allowed to use it. When Enix first wanted to bring their Dragon Quest video games to the US, they had to change the name to Dragon Warrior because there was a tabletop RPG called DragonQuest which already had the name trademarked - they only later changed the name of the video game series back to Dragon Quest when the maker of the tabletop game went out of business and their trademark expired. Same for the video game originally titled Hero's Quest: So You Want To Be A Hero - it had to be renamed Quest for Glory because of a trademark conflict with the HeroQuest board game. The test for trademarks is whether or not the new product could potentially cause confusion among customers, making them think it's associated with the product(s) of the trademark holder, not whether it's a 1-to-1 exact match or whether the logo was stolen vs. being independently developed.
