Article 1 section 2 of the Constitution forbids Congress from giving any of its regulatory power to any outside body or creating any regulatory body. All regulations are to be done by Congress alone. This means the EPA, the FCMSA, the ATF, every single regulatory body created by Congress is unconstitutional and has no authority. The founding Fathers created the Constitution this way because they understood a regulatory body is not elected and regulations carry the exact same force as law. You break a law, you go to jail or you pay a fine. You break a regulation you go to jail or pay a fine. The founding Fathers understood it was unjust for the people to be ruled by a regulatory body of unelected officials who do not answer to anyone and are in effect a second Congress that creates laws however it feels whenever they feel and to whatever degree they feel and are unelected. Our country has been ruled by unconstitutional illegal and unjust regulatory bodies, and everyone has been going along with it even though it is expressly forbidden by the Constitution.

Yeah I get why you are saying that but: These agencies are considered "Federal executive agencies" and operate with a delegation of power from the executive branch. Yes, they have Congressional oversight but they aren't technically a wing of the legislature. And, this is a separate issue not addressed by the decision.

It doesn't matter what they are considered, they are expressly forbidden by the Constitution. The only way Congress can hand out its regulatory power is by amending the Constitution which is very difficult since it takes 2/3 of the states to approve of it. They can call it federal executive agencies if they want, it doesn't change the fact that it is unconstitutional and illegal. We are not to be ruled by unelected bureaucrats who answer to no one. It is pure tyranny and that is why the founding fathers put article 1 section 2 into the Constitution.

@@Steve_Milo They're not just calling them that, they are that. The executive branch has certain duties under the Constitution. And this is not the subject of the video. The video deals with the problem of agencies "making law' by administering vague acts and laws which are passed with language like '"xyzzy agency shall promulgate rules and regulations that require automakers to make efficient vehicles." And then there will be a citation to the part of the Constitution which enables the executive branch to legislate for the general welfare of the public. You are arguing that the agencies shouldn't exist, that delegations of power from the executive branch either don't exist or are not constitutional. Different issues.

@@DavidS94938 My friend you are basically agreeing with 90% of what I've said. The point you have missed is the very existence of the agencies is completely illegal and unconstitutional. They should not exist at all. It is not a function of the executive branch to create regulations, even though Congress said they could, Congress does not have the ability to hand out its regulatory power. It is expressly forbidden. The lawyers who fought against this understood this, they can read article 1 section 2 as well. However, they also understand politics and if we actually followed the Constitution then that would mean 2/3 of the federal government which is illegal and unconstitutional bureaucracy would be immediately wiped out. Politics comes into play here because a lot of people have a lot of money and power from this and they love bureaucracy and they do not care that they are ruling us like tyrants, and they will do everything in order to continue to do so. The lawyers who fought against this understand this completely, they understand the Constitution is just effectively nothing but words on paper because it has been ignored for so long. So they have to deal with the reality of politics and powerful people who do not want to give up their illegal power. This is a war we are fighting to take back our rights from tyrants. While we could stand up and say "article 1 section 2 of the Constitution expressly forbids exactly what you are doing so you must all go away" The reality is they would simply ignore it because they feel like the people will not rise up against them because too many people are ignorant and the media is on their side. Lastly, the role of the executive branch is to enforce the law. Congress creates law, and the judiciary interprets law. These federal agencies in effect create law with their regulations, they also enforce them, and they interpret them as they wish. This has in effect made federal bureaucracies all three branches of government in one, which is expressly forbidden by the Constitution. So yes, for over 40 years we've been ruled by completely illegal and unconstitutional federal bureaucracy. I think people are starting to wake up now, and this is a war we can win with one battle at a time.

@@Steve_Milo Oh, definitely agree that agencies have too much power, this recent decision will help that. And, I know it is popular to say it but things aren't "completely unconstitutional, etc". As with a lot of things learning only a little about the Constitution and caselaw interpreting it leads to some really strained analysis.

I would estimate that 1/3 to 1/2 of diesel pick ups where I live have been deleted. These owners say they have cooler running engines, additional 3 to 5 mpg, and diesels CAN BE TUNED for max power & no soot. I have seen several such trucks

Not sure what took the supreme court so long. No way should the EPA, ATF or any other Government agency autonomously pass what are effectively laws but just call them a "regulation". Congress passes laws, not unelected bureaucrats nobody has ever heard of.

The regulatory agencies went way too far. The case they ruled on made fishermen pay for a government observer ride on their fishing boat and monitor what they did. The taxes we all pay wasn't enough, but they had to pay for it outright! When they got that abusive, any legitimacy for the agencies went out the window.

I try to get this point across as well. Another thing would be capping or getting rid of bank auto loans. If you had to use cash to buy a new car, new cars would be $20k max, not $100k because it’s a new truck

Commiefornia's problem is the wind from the pacific gets "blocked" by the mountains. Can't completely push stuff out. Don't punish the rest of the nation for that. In my neck of the woods on the other side of the country pollen is ten times worse than anything. They make a 400 hp engine that's very fuel efficient but the oil tycoons and politicians that own stock in them want us using more oil and fuel instead of having efficient engines. Proof is out there just gotta dig it up. All about money and control.

Modern cars are super clean by comparison and if they would push e85 availability more they could be even cleaner. No resson to go against moderm gas cars the way they are theyve came so far. Theyre trying to push ev bs if they cared about the environment they would push alternative fuels too. They wont do that because it isnt about the environment its about forcing us into ev for various reasons.

If they want to help the environment, Stop cutting down so many trees too , and plant new trees !! Plus get on these Foreign countries that do pollute !! Us as Americans we just need to, make sure that Other manufacturers are burning Clean Fuels out there chimneys for there Factory's !! And in American we build better Internal combustion engine that can run on a cleaner burning fuel ,for 4cyl, 6CYI and V8 engines too !! And build more gas and hybrid powertrains as well !! Which this means all these solutions are way more practical !!!🇺🇸🇺🇸💪💪

I worked at stellantis in the paint shop the quality is so bad in the paint if you go to a dealership, you can see the paint defects in certain areas of the vehicle, especially in the door jams in the front a post where the windshield is

Absolutely. I bought a new 24 Laramie Diesel. It's the basic white. So no upcharge for special paint or possible prep work for it. Just appliance white. But It's sooo thin.. I can see through it such a dry thin spray. Like they just did 2 tack coats. Terrible. But I may wrap it anyways. Therefor the white.

Brad, you have no idea how relieved I am. I cannot wait until the day the Hemi makes a comeback. I've been getting sick and tired of the Hurricane Inline-6's recalls and seeing the Hornet on EVERY SINGLE TELEVISION AD FROM DODGE. I would love to see the REAL Mopars like a better Charger and Challenger make an appearance on TV ads. It will make my day if that happens. One of the things I’m not seeing folks talk about is HOW ALL THIS CRAP HAS JACKED UP THE PRICE OF CARS!!! Thankfully we can buy our little sport cars and such, imagine the poorer population in our country. This shit is crushing them! (Gas prices, high tech vehicles, hybrid or EV prices, etc.)

The EPCA was a law that passed in 1975 which created the CAFE standards as a part of that law. NHTSA was created because of the law. There might be some changes because of the chevron deference going away, but CAFE is still a law passed by congress.

In fact PHEVs are the best win win situation for everyone. They are more powerful, faster, etc than v8 or any other power train. They allow the dealerships to service more complex engines and they allow manufacturers to meet any EPA cafe requirements. Also, anyone who’s owned a PHEV knows you fill them up far less than standard ICE PTs.

The decision to reverse the Chevron Deference will not vacate rules made prior to the SCOTUS ruling from what I understand... only moving forward.

When it comes to castration, I've got plenty of rusty can lids and work for tips. Remember, the EPA brought us MTBE, which turned into a disaster by polluting ground water across the country, in their zeal to oxygenate gasoline. If government is the answer, it must be a really stupid question.

Did federal agencies need to be reeled in? Sure, but I'm not sure that SCOTUS didn't throw out the baby with the bathwater. For example, one effect will be that the NHTSA's ability to order a recall is now greatly reduced. For years the NHTSA has been ordering safety recalls that were really quality issues that they did not have the authority from Congress to do.

Thank you. One of the first things I thought of when chevron went down was how it would effect things like cafe standards. The main reason we cannot have small pickups anymore are their insane rules. If they could make something like a 2011 ford ranger again, people would by it. I don't need backup cameras, big infotainment systems with backup cameras, or electric windows. A simple 2.3 ltr. engine and a dependable 5 speed transmission is all I need to be happy.

I’ve lived in CA, San Jose, and yes CA people live by a different set of ideas. I would suggest moving to South Carolina, Georgia, Mississippi or Florida. Florida would welcome you with open arms!!!

It's not just V8s. Ultra simple cars like the Geo Metro might get 70 mpg using today's technology. I was honestly waiting for motorcycles to be required to have rollover protection and airbags

keep only the 5.7 hemi and update the the internals , ports, and all that jazz so it can handle alot of boost. Slap a supercharger or twin turbo charge it. Idk if its possible but increase the rpms to 8,500. Its the most cost efficient thing to do cause the 5.7 is readily available

Really? Over the course of our history they have made rulings that defined revenue as personal income so it could be directly taxed. They overturned Roe v Wade and ruled under the Tenth Amendment giving the right to kill unborn children to the states. Go read the Thirteenth Amendment and ask yourself if that should be left up to the states. They ruled on Separation of Church and State...doesn't exist. I'll give you $1000 if you can find it in the US Constitution.

I been wondering this for years! V8 engines been around for more than 100 years!! I agree it's strange! We are focusing more on turbos than the actual engine itself! Yet it still doesn't save fuel

Internal combustion engines are about as efficient as they can get. Dodge could have done what Ford has done and offer hybrid powertrains in their cars, and have a lineup that isn't exclusively gas guzzlers. The technology to meet the CAFE standards is here. Dodge simply refused to use any of it.

@@beastmode3682the V-8 from the 70’s are so much different than todays V-8. The milage from then to today is doubled. From 13 miles to the gallon for the 70 340 Dodge. To todays 345 (5.7) that gets 26 miles to the gallon. Almost double the horsepower. 275 gross hp for the 340. 375 horsepower for the 5.7. Single coil packs per cylinder. Fuel injection to variable valve timing dual phase cams. A computer runs it all. Big difference and much technology goes into todays V-8. Ford 5.0 from the 80s to the 5.0 of 2024 are worlds apart. So yeah the V-8 has advanced a lot from those early V-8s. They also produce only 10% of the emissions that they produced in the 70s.

​@ramonpena6543 , yep the oil drilling industry probably don't want that to happen either. But if they did they would sell 3 times as many cars as they do now and that would cost the owners far less in fuel per year. Add a small 50mpg V8 tax so the oil industry will endorse it.

The chevron doctrine was crap to begin with. Not only did the EPA eat it so did the ATF. Hopefully we’ll be able to buy food from farmers without regulations and fees . Now I hope the ATF will stop unaliving people without warrants

Maybe someone on here could clarify for me….I did hear Ev’s actually pollute more due to the sheer weight? the wear of asbestos from the brakes and rubber and road wear is multiple times higher an actual ice engines (now) have such good particulate filters they create less pollution over all? Guessing stop & go city miles & highway driving can play a big part. Plus all the mining practices, making giant holes in the earth for battery minerals is another factor

EVs generally weigh about the same as comparable ICE vehicles. Brake wear is less because of regenerative breaking they use brakes less.

This is the thing that bothered's me about some people they needed to speak for themselves , because not everybody is going to be into EV'S period !! And you can't force people into EV'S either !! Because they should have knew this from the beginning with this Situation !! So It's about time that Supreme Court stepped up about this matter ,with the EPA and the Cafe standards !! Because as taxes payers we should always have a Choice !! So there is Other ways that are more practical with the Internal combustion engine to make them run cleaner ,for the environment !! Because as real, car and truck lovers we know this and that is important !! And this is Why people need to pay attention to politics !! It's crazy that being a car enthusiast is now political. I drive a V6 Honda Accord. They don't even make that anymore! I used to have a V8 car, and I wouldn't mind having another one brand new, not many years old, in the future. I will not let them tell me, "You will drive this electric SUV and be happy." (Don't get me wrong, I'm all in for EVs as an option. EV sports cars should have a place as the instant torque and regenerative braking can be very useful and fun on tracks/mountain roads. Plus EVs can be great for commuter vehicles. But I want a CHOICE.) Don't even get me started on the killswitch stuff they're doing! I can imagine it being where if you do something THEY don't like, they just disable your car remotely... Not even kidding, every day I drive, I'm stressed because I know that when my car someday breaks down, as of now, there will be nothing good to replace it with!

This decision is going to move regulatory power toward the courts more than towards Congress. Also the past 40 years of having Federal agencies make these decisions isn’t going away overnight. If someone wants to overturn an EPA directive (eg diesel DEF required in diesels) they’ll need to go back to court.

Key Point: Somewhere along the line since Chevron Deference became case law, Politico's, mostly at lead of Democratic Party, decided that these many Alphabet Agencies formed the perfect lever for social change. At that point, Agency Heads became more Political Cronies and Less Industry Expert and Agency Regulations became attempts to legislate social change without requiring elected (vulnerable) Congress Members having to vote on controversial policy... Good that this is now at least brought back into the Light.

Basic things like what cars we should be able to drive should NEVER be politicized. Imagine if we forced the left to only drive trucks and v8’s. They’d lose their mind and say it was un-democratic etc. I hope Trump gets in so he can disband the epa. Enough is enough.

Simple high efficiency models were required to have features that make them unprofitable to manufacture. Most buyers preferred a used Civic over a new Yaris. Same thing happened to Honda Fit.
