Thank you JIM. They recorded my interview on C90 audio cassettes, I also recorded it on my mobile phone although the DWP say they won't accept the mobile phone recording as evidence. BUT they have placed me in the support group. I only found out because my GP said the DWP had told them not to issue any more sick notes. Thanks again. (the no more GP sick notes also happens if you fail the medical ESA65B letter)
You are such a clued up guy and so right as to what is going on. after watching this a few months back i asked the now maximus for audio recording for suffering mental illness and suicidal thoughts for much of my life. also with the help of benifit and work guides u can trust. I nervously await the decision because even though ive worked alot in my life im in no fit state to do so now. Thank you for having decency to help those stitched up by the system.

i've got my medical coming up soon and i'm 99% sure they will stop my benefits.....i've won appeals after medicals before..but this advice about getting the audio recorded is real food for thought...thanks for sharing your advice. :)

hi James I took your advice and asked for an audio recorded interview since doing that maximus have cancelled 3 appointments since asking for an audio I asked why did they cancel and was told they are very short of audio equipment ....lol thanks James for your very informative videos .
Most people can get it recorded now and they don't care. They get paid no matter the decision is wrong. They wait for you to have to go to tribunal before changing the decision and then give you another assessment.
they dont realize how difficult the form is to fill in. you can not just put i am depressed and i dont feel like getting up and i have to be motivated by someone. you have to say how many times this happens to you has a professional seen you and how many times a day you feel like this and how your being treated its a massive job
+James Roberts great video james, one of the best on this topic, for anyone reading this here is another thing to remember, when you go to or have a home visit by atos, be aware of the happy friendly atos employee, their demeanor may give you a false sense of trust, which in turn makes you more open to talk about things that may appear to be benign, never talk or give anymore than they ask for, because everything you say and do is noted, if you do what james says about recorded interviews and you are truly disabled then whatever the outcome fight for what you are rightfully entitled to, finally good luck to all my fellow disabled folk going through a tough time and take care.
I went to an ESA assessment last week with my sister, i requested for the assessment to be recorded like you said but when we arrived they said that they did not know how to work the recording equipment. In the future do you think it is best to bring your own recording equipment ?
Why are people putting up with con artists calling themselves doctors being paid by ATOS, Maximus, Capita, Dependability Limited and others all cashing in bullying the ill with their computerised medical assessments that do not work. They are not Doctors who make the ill well or the disabled walk again. ATOS is from France, Maximus is from the USA with shareholders worldwide making money out of these assessments whilst the ill suffer and it wants stopping before more get hurt. These Ministers in the UK Government have caused suffering to ill people for over 10 years in charge of the DWP (2008 to 2017) now into 2018 and two select committees looking into these deaths in 2013 and around 2016 have achieved nothing except covering up deaths. Has it occurred to any of you reading this that unless people make a stand they will keep walking all over you. Iain Duncan Smith MP sat on his ass from 2010 to 2016 receiving emails from thousands of ill people and did nothing in all this time. Out comes Brexit and he says "It is wrong to treat the ill like this, I will resign and concentrate on Brexit" What does he get out of Brexit and why use that as an excuse, he did not careless about ill people 6 years before this. The UK Government have spent Billions of pounds on ATOS etc.. then they bring out universal credit to give ill people less to offset money being paid to these con artists masquerading as Doctors. Why can't you or anyone else see it.? I have been writing about this since 2012 and nothing has changed
I’ve got my assessment coming up in July my mum was meant to be going with me because of my condition but she’s on holiday now! Not her fault my assessment was meant to be in March but got cancelled!! Was just wondering if you go on your own is it an instant fail or does it not really matter if you don’t go with someone? got one next week, had one booked last month and asked for recording, and what a surprise they waiting till an hour before the assessment and they cancelled, lets see if it happens again.
I had a assessment....Had severe back issues...I failed ....3 days later I was in hospital having emergency surgery on my back. I wrote my appeal from a hospital bed.
Wish u was representing me! I'm waiting for assessment date. I already been to tribunal and got unanimous decision. Then when u.c came in they put my dla on hold and never reinstated it. I was in hospital I had 7 operations in Feb and March, when the change over happend. I have mental health issues and I just wasn't aware they stopped my dla. It's a long story, but now I've got to go through an assessment again. Because of this I became suicidal and had to be put on strong medication from my physciatrist, my c.p.n has to visit me at home once a week to basically check I'm still alive. I have 14 diagnoses. I can't believe I got to do this again. The tablets I'm on sedate me enough to stop me worrying about what I got to go through. I been listening to your advice, thankyou.
thank you for doing these videos. what the goverment is doing is criminal. At least warning people helps people to cope better ive had my esa assesment and they lied on my report saying i said things i did not.Its the only way they could give me nill points
I was not made aware that you could record your PIP assessment I wasn't informed of this and when I did ask at the assessment if I could record it she said no because of her confidential rights, with not knowing any difference I did not questions this, so a bit of advice to anybody who's going for an assessment mention you want it recording before you go to the assessment,
Great video, and really well articulated and informative, but is there not a chance that if you request an audio recording, that you are perceived as being someone who is ''playing the system/know the game etc, as opposed to being a simplistic person who trusts in general, and not well enough to be cynical and possibly calculating as such.?
James. Have you come across a form called ESA WF1-06/16 - its a new form sent to new WRAG folks by JCP - oddly enough form can not be accessed on line :-/ Do you know anything about this form.
James - I'm confused. Since when do ESA claimants get to see a doctor at their assessment. I just had an assessment with Maximus (they are looooooooooovely) and I was interviewed by a clerk (she did not know what ESR test was) - going to appeal when MR finally comes through

Hi James after I was disqualified by the esa doctors, I appealed I had to go to court.. There was a judge and a doctor, wen they saw me and my condition they straight away signed my forms and I was given esa, due to my illness I got pip too till 2019 but today I got a letter from the medical assessment asking me to fill the forms to hv a face to face interview if I don't go they will stop my esa... I don't understand this, they can see clearly that I am getting pip then y ask me to go for a face to face assessment???
Hi James. I went on Thursday n was in there 20 minutes. She asked me about 10 questions re my mental health n didn't ask me about a few aspects of my mental problems n that she needed no further information, completely disregarding my physical health issues. ESA Claimants 1 March 2015 Information about Work Capability Assessments has now moved Atos Healthcare exited our contract with Department for Work and Pensions (DWP) to deliver Work Capability Assessments (WCA) at the end of February 2015. The new provider is known as Centre for Health and Disability Assessments and is delivering the service on behalf of MAXIMUS. Click here to go to the Centre for Health and Disability Assessments website. The changes will not affect your benefit claim or payments and you should continue to attend any appointments as usual. The procedures for claiming any of the benefits that require an assessment have not changed. If you have a form, letter or query that still refers to Atos Healthcare at the time the changes are introduced after 1 March 2015 there is no need to request new documentation. Centre for Health and Disability Assessments will have the details of any appointments that had been booked for you and arrangements are in place to ensure that Centre for Health and Disability Assessments will have all of the necessary information transferred to them. Can anybody tell me if the same right to have an assessment audio recording applies to a PIPS face to face assessment too ?. According to information I have just read online. We do not have a legal right for dwp or atos to arrange for an audio recording. I am now left somewhat confused. Any help and advice would be appreciated. Thanks all.
what will happened if DWP asses a claimant to fit to work , and the claimant make a serious or fatal mistake? in any sort of work/?? who is responsible in such cases?

I was on ESA for nearly a year and had an assesment done 3 months ago by ATOS ( who according to the govenmentare not to be dealing with it any more) i have a spinal bulge i find it hard to walk i can bearly bend down and i get syiatica if im on my feet to long. to pass you need 15 points they scored me 0.
I got my reassessment ESA on Friday another medical why are they making me come do another one, when conditions have not changed? I got award last year for 12 months.
Hi I have an interview coming up. I called and asked for a recording she said sure no problem. 2 days later i received another appointment letter with the interview rescheduled 2 weeks later. Im now having to call again to make sure it gets recorded. I wonder if it gets rescheduled again. This is for an ESA assessment. I suffer from depression anxiety and ocd. My GP suspects bipolar as well. Problem is my intelligence is just fine and i wonder how they will assess me. Very very nervous
+Mirthe S I would certainly insist on it being recorded. I think the main thing to remember is that the purpose of the assessment is to determine the impact of your condition on your ability to find work. While it is impossible to predict what questions you ill get asked, it is possible to get clear in your mind the main points you want to put across ( and make sure are on the recording ) Say for instance , just as one example and if it was actually the case - how your depression makes you so tired that your short term memory is affected and you often become confused and unable to carry out basic tasks safely , such as cooking, driving etc. and therefore you are sometimes a danger to be/ have around. If you have in you mind the points you want to make, it is usually possible to tailor your reply to any question in a way that makes these points, regardless of whether you were actually asked for such information. A bit like how politicians tend to answer the question they would like to have been asked rather than the one they actually got asked. Good luck, let us know how you get on.

I feel that the fact they make me travel for an hour they will use that as an excuse that i can work regardleas of the fact it leaves me extremely anxious and worn out for a week to recover. I believe you need to be awarded a minimum of 15 points to claim ESA and be put in the work related activity group. From what you have mentioned previously, if it was me, I think I would be looking at how the impact of my condition could be explained in a way that would match the criteria used, as shown on that website. Say for instance, if I was asked how I travelled to the interview- I would describe how my fear of social interaction causes so much anxiety that I can not concentrate and function on what I am doing at the time, which escalates in me panicking and getting more confused, this has proven in the past to put me and others in somewhat of a dangerous position and so prevents me from using public transport unless accompanied by a close friend. I do, however, have a regular taxi driver who I know well and I trust,but this is expensive. Matched against the criteria used for assessment, there is the potential for a 15 point award straight off the bat, being a danger to yourself and others in social situations in which you are not control, public transport, work place etc. Maybe also tailor an answer to further questions in a way which support that position ,try point out how you have most of your shopping delivered because you don't like to be surrounded by people you don't know and may get confused and not pay etc. And there's so many terrorists around these days , anything can happen ! Try to think of it like that buzzwords game. you say the right word or phrase and the buzzer goes so you get the points.- you describe the 'IMPACT' of your condition in a certain way ( and on your recording) you have to be awarded those points. But try to make it as clear as possible, not ambiguous , don't beat about the bush, don't leave it open to interpretation,say it direct and get the point across, I 'always' panic and become confused, then have an example ready to tell of how you once ran to the bus driver shouting we're all going to die and almost caused a crash etc. etc. Basically, have it in you mind the points you want to make about the impact of your condition, which gets you the points, then answer their questions in a way in which you can deliver the goods. Then go home , have a cuppa, and watch the lies they tell on TV LOl I don't normally give individual advice, but as it's xmas :) good luck.
+Mirthe S Hi Mirthe. I hope that you haven't had the assessment yet. The reason I say that is NOT because I want to inflict you with an even longer wait with the accompanied stress, anxiety and mental overload you are quite possibly hoing to bed with every night. Instead it is to offer one simple piece of advice which I was given and that is to ALWAYS take someone else with you - as well as asking for the audio recording. My spine is absolutely "bombay ducked". Spinal surgeons, consultants and doctors (GP's) have all said so. I have countless scans and what have you to prove i, but I was rated "Fit for work within 3 months of the assessment date", by a so called nurse. Her extensive knowledge was obviously much greater than those I had previously seen in the medical field. Anyway, when I finally managed to have my day in court, I was in a serious state of panic. Not one sheet of paper (of the 22 pages) regarding my mental health issues had been given to the county court judge and consultant who presided over the hearing. Luckily, I had asked an advocate to come along and help me out with my appeal day in court (they cant speak for you, but they can remind you of things you had wanted to get said when your mind just goes completely blank of everything other than panic) and she had copies of the paperwork (which the DWP also had but didn't supply the court with for some strange reason) and she handed them over. At the end of the day, I won my case had my money increased and back dated. But had that kind lady not of been with me, there are so many things which needed to be said and would not have been said to the right people. She advised me to always make sure you take someone with you. I pointed out that I live alone, one of my kids works 9-5 and the other is (at the time) at school. I had no one else to ask. "Find someone, then!" was her reply. Apparently, if you can make it to the assessment on your own, then you already lose a certain amount of points. Whether this is still true under the new "people", I cant say. But I will never be putting it to the test if I have to have another assessment. So do yourself a huge favour Mirthe. Take a friend or some other adult along who can go with you for support. Finally, good luck and all the best for your interview!
they had cut my interview short startes straight away with mental health section didnt ask anything physical. she asked how i got there, how i feel when im on my high episode and how im on my low episode. if i lay in bed all day and a few questions if im hopeless self esteem about slewp pattern i mentioned my partner has to do everything push me to bath and do my hair and that i really dont go outside bc i get so anxious. she told me shed stop the interview bc she feels she had enough information but to confirm with the doctor. which she did after 5 min she came back and concluded the interview. my other complaints were still notes but didnt need to be discussed as she felt my mental state was too overwhelming and severe enought to not having to do that. she said i wouldnt worry about your esa but you ll get a letter from dwp as they are the decision maker. i had letters from psychaitrist and psychologist stating that they find it unlikely that im returning to work inthe near future and letter gp of possible bipolar diagnosis. what are your thoughts
What can you tell me about Maximus because I have been referred to them? I have met someone from there bu he couldn't sign me up because the job centre and DWP have put too many obstacles in my way.
When the assessments first came out loads of people wanted recordings. When they went to appeal the recording rarely went in favour of the claimant as they were almost always found to support the healthcare professionals report. Since people stopped asking for recordings the number of successful appeals has risen. Also if you want a recorded assessment it can only be done on the recording equipment provided as this cannot be tampered with (2 copies are made in front of the claimant, like police tapes), with a copy provided at the time of the recording. These are then sealed in front of the claimant and submitted with the report. If you do your own recording it can't be used as evidence at appeal because it is an uncontrolled copy and there is no proof that it hasn't been tampered with. Them's the rules folks.
So , I think what you are saying supports the main point I am making . If you are refused your claim after having an assessment that you had recorded , it will almost certainly have been a genuine assessment that was carried out fairly and arrived at a fair conclusion within the rules, most likely as result of them knowing the appeals panel would get to hear it and expose their corrupt practices . So my additional point being that asking for a recording ensures you get a genuine and fair assessment, reducing the need to go to appeal in the first place. But if you still get turned down, at least you can play the recording to the panel just to make sure. Additionally, you point out that the number of claims the panels have over turned has increased since people stopped asking for recordings . This is further evidence that without a recording as back up the assessor simply constructs his report in such a way as to achieve ATOS aims of allowing the claim to be denied, meaning you have to go and appeal, without a recording . Finally, though , I do question why people would ask for recording when assessments first came out and then later stop asking for them ? I think we can conclude that it is definitely important to have your assessment recorded , regardless of who makes it . Though getting them to do it is far easier. No problem. People stopped asking for recordings because many appeals were based on false recollections of the original interview. In other words people genuinely forgot what they said or thought they had said something they didn't. Without a recording it becomes a matter of the claimant just denying that the information contained in this report is what was said and the board have no evidence to the contrary. Tribunal boards often side with the claimant as they want to avoid poor publicity rather than it necessarily being the right thing to do. With a recording there is no ambiguity.
+James Roberts read my post above, they are devious and in my case used the supposedly faulty equipment to prolong the assessment and then used the fact that I'd had to sit there for ninety minutes against me as an indicator of my ability to sit. The only way we can stop these monsters attitude is to complain to the GMC about them and point out the undoubted lies and contradictions that they've written about you.

+TheBudgie29 The time is stated on the recordings and you are given a copy of the actual recording. They can edit their copy, but it will be obvious , and you have yours. The qualifications of the people doing the assessments varies. Depending on the complexity of the condition , they could be doctors , mental health practitioners, etc . But you are right that they may not always be best qualified for that particular interview. Asking the person what their qualifications are is a good way of having it on record how fit the person was to assess your condition.. But what you really need to remember is they are working for Maximus, and the aims of Maximus is to keep the numbers of ESA claimants down. Asking for a recording makes sure you get your condition evaluated fairly.
had 3 of these now one for esa and pip both failed won in a court appeal and second one was pip again a year latta this time passed it they make u feel suicide is only way
got my oppintment it says on their leaflet that don't have to give audio recording if they don't want to?.it says DWP and health assessments advisory service have no legal obligation to provide an audio recording service or equipment,so basicly another kick in the balls at the medical,!!!
But they can't refuse you permission to make your own recording if you want to do that, but you have to tell them you are doing so, and give them a copy. They will do the recording if you ask.
If they can't do an audio recording fir whatever reason, then record it on your mobile phone, I would coz I'm not going this assessment without some sort of recording PERIOD.

And then there was this in my decision letter these are the exact words... Mr XXXXXX completed the UC50 however the Decision Maker has not been able to locate this paperwork. Chris Creaser I think you may have misunderstood , phone the assessment centre before you appointment , preferably a good few days at least, ask for your assessment to be recorded and for you to be given a copy. Good luck.
Hi Jim I have telephoned asking for mine to be recorded and they said to me we will contact the recordings department and you will get a phone call, I have not had a phone call and was told ring a few days before the medical. How do I stand? They told me I have no legal right to have it recorded, is this true? Thanks
You don't have a 'legal' right to get ' them ' to record it, but you do have a legal right to 'record it' - if they won't do the recording , as log as you give them sufficient notice , and the person doing the assessment is aware that you are recording them , you can do it yourself - but you have to also give them a copy. I would just make sure they know that you will have it recorded, one way or the other. They will do it , I would phone and badger them until they confirm. Good luck.
In terms of getting my appointment, the lasts two years I haven't received the appointment and so they stopped my benefits. I received the letter asking why I haven't attended my appointment, but no appointment letter. After 5 weeks, and 3 requests for proof that: 1) the letter has been sent 2) The letter has been delivered to my house ..... i've received nothing, and now they told me a new appointment can take anywhere up to 12 months. So now i'm falling behind my rent, trying to live and pay rent on housing benefit alone.
At what stage (& h-o-w) Do U ask for the interview to be recorded?? Is this your P.I.P Interview Or your P.I.P. Appeal? - Sorry for misunderstanding,I'm VERY,VERY Tired.... :(
Chris Creaser You have to phone the assessment centre before you attend and tell them that is what you want. If you look through all the paperwork they sent you, you should see it written in there somewhere , stating you need to phone before hand , can't just turn up and ask for your assessment to be recorded. my assesser from maximus called myself and my gp a liar. oh and if that's so my mri scans are fakes lol. well maximus have found the assesser did not do the assessment properly and he has been dealt with.hoping I get esa back on because I need surgery and can't have it if I'm being forced to work also making me more sick. mines birth trauma that has caused many problems. I only need time for treatment but their heartless. I'm recording everything from now on :)

It means you have a genuine reason. I was offered the same thing. I was treated very nicely and had no issues, they recognized I had a genuine claim. Not saying others don't have a genuine claim, just maybe some stand out more than others
Can I ask if you passed your medical? As I was treated the same they called me a cab and took me outside and the cab was paid for even though I told them I had my own money x
I should of recorded it. I have all the equipment and I just thought if I did that I would be getting their back up automaticallyif I did show mistrust. But I was failed. Because of lies.

Very interesting a have this medical in a few weeks i have been claiming for 6 months my doctor has signed me unfit for work with depression (wont go into that or what has happend to me), so basically if u suffer with mental illness that isnt catered for in this so called assesment? you will fail ie. i will fail? what are you supposed to do then?
share81 Remember, the assessment is not about the condition you have, its about the ways in which the condition impacts upon your life and affects your ability to function in different types of work environment , not just the ones you usually work in. Good luck.
I think you can pass, as in be found eligible for ESA , but be found capable of doing some types of work and so still have to look for that type of work . Unless, from the answers you give to the different groups of questions, you score sufficient points in a number of categories to deem your ability to sustain any employment as not making it a viable option. They basically want to position you as still being able to function 'enough', whether its physically or mentally , to still be able to carry out some tasks for which there are advertised jobs. And you want to position yourself as left so 'incapacitated' physically or mentally that you would not be any use to anyone. Good luck.
jen kirk thank you for replying, I already get pip, I was wondering if anyone knew if it made a difference in getting ESA, the rules used to be if you got pip (DLA is used to be called) at the higher component you get income support but since they stopped income support the rules are unclear, anyone on got any ideas?

good idea however won't they give you a more challenging interview/assessment with audio recording they will know u don't already like them and part of the anti ATOS crew.

Problem is things have changed the tribunal service have their own agenda and common sense isn't part of it, most only have 2 panel members, one is a HCP (ex /retired out of touch GP) and a judge, i have lost a few appeals and one with audio recording , the whole thing is a stitch up The audio recording only limits the amount of lies they can tell

THE HEALTH CARE PROFESSIONAL DOES NOT DECIDE TO STOP THE BENEFIT. THE DECISION MAKER FROM THE DWP DOES!!! 2. THE HEALTH CARE PROFESSIONAL GETS PAID NO MATTER WHAT DECISION HE MAKES! 3. IF THE CLAIMANT IS UNHAPPY WITH THE DECISION FROM DWP, HE CAN ASK FOR A MANDATORY RECONSIDERATION.... THAT IS A SECOND DECISION MAKER, TOTALLY INDEPENDENT FROM THE FIRST WHO LOOKS AT THE EVIDENCE. THE CLAIMANT CAN PROVIDE FURTHER EVIDENCE (GP LETTER, SPECIALIST LETTERS ETC AS PROOF) 4. THE DECISION MAKER HAS NO TARGETS FOR KEEPING PEOPLE ON ESA OR NOT. IT IS BASED ON EVIDENCE FOR EACH CASE. TO AWARD ESA, THIS IS BASED ON CRITERIA LAID DOWN BY LAW. IF YOU WANT TO CHANGE THE SYSTEM, CHANGE THE LAW! 5. IF THEY IS STILL UNHAPPY, THE CLAIMANT CAN ASK FOR AN APPEAL. THE TRIBUNAL CAN LOOK AT THE CASE KEEPING IN MIND THE BOUNDARIES THAT ESA ALLOWS THEM TO JUDGE.
