If we were to use moral conducts as a benchmark for acquiring positions in the parliament? We can then say, Ramaphosa is not supposed to be a president of South Africa due to Phalaphala gross misconduct. Zizi Kodwa is not supposed to be in parliament due to the corruption case that is above on his head. We should be using the same moral standards for all. So hands off Dr John Hlophe.

His profession is no longer that of judge position and the impeachment was for that portfolio as a judge. Indeed he's a politician and no one can do anything except advocate for change of the constitution. We have people who violated the oath of office, worse they are members of parliament and serve in the executive but no one is making noise about it which clearly tells us about the problem with a disfigured constitution that is foreign to the aborigines of this land!

South Africa’s basic foundation itself is not based on ethics and morality. We absorbed the judges, police officers, soldiers even the president of cruel authoritarian regime into our new democratic government. People literally got away with murder and today we are told about ethics and morality just because the judge was impeached for political reasons. Let Dr Hlope serve his country and his people…our democracy is still maturing. One day both sides will be equal satisfied and equal dissatisfied but for now it’s this side vs that side…let it be… Those who speak on their selective morality know exactly why things are the way they are…

Not long ago before government was announced, they suggested that the outgoing government was too bloated and they advocated to downsize the GNU Government, yet they wanted 12 Portfolios including 12 Deputies to themselves, just because it suits them to partake into cake-sharing, they are now comfortably quiet serving into the most Bloated Government that SA never had since the dawn of Democracy in 1994. Some people keep on saying Hlophe should do the ethical or right thing, if he doesn’t believe in his whole impeachment, certainly the right thing for him would be to avail himself to serve in JSC. What is ethical to one, might not be ethical to another person, it depends on certain groups interests ( think of inequalities and economic differences due to others benefiting from the gains of apartheid and see if ethics are seen by All from the same angle). The constitution is not a book written by Almighty creator of heavens and earth, it might be respected around the globe, but why can it not be legally changed within the parameters of the law? It makes provisions of amendments itself, which means it can be changed following specific processes. The reality is that there are South Africans who believe that the same constitution of their country is not addressing the injustices of the past. The question is, must they not talk about their views of challenging the status-quo? The comments just depend on which side of the table you are, in terms of life you are living. The reality is that some are happy with certain parts of the constitution and some are unhappy and it is not being an unconstitutional individual if you voice your opinion otherwise that is trying to silence people. If the parliament was to agree in constitutionally addressing the “Hlophe issue” to avoid from happening in the future, would that be unconstitutional to add/amend the constitution because our constitution is respected globally? Our constitution should work for us, not us working for it. It needs to address our realities not to please people out of South Africa at the expense of the voters who have not yet gained the freedom which they dream of in their country.
You are confusing content with process. A common mistake. If your laws reflect your particular ideology ( and like the USA, SA 's constitutional laws reflects post enlightenment views) then process will dominate values- because of the supposed autonomy of the individual, this , again, supposedly collectivised , but which is shaky ground.....and if you think a constitution is essentially a law maker in its own right, then that will not get you a passmark.Because constitutions demarcate boundaries. Every socialist state ,for example ,with a constitution shaped to further socialism will not be able to protect basic rights= because the individual has at its base no autonomy.

The principle of legality says "you cannot make law as you go", Meaning you cannot formulate law when one person is before the law on a certain principle. So what Breytebach is saying really falls short. There's no law barring Dr. Hlophe from participating in the JSC, and such law cannot be made now, it becomes unlawful. Perhaps we can debate the "ethics" element on this matter, but not legality. And in my opinion, Hlophe is ethically qualified to seat on JSC by virtue of him being eligible to seat in the high seat of Parliament.

But as I remember this is a man send to influence two judges to vote in favour of Zuma by Zuma which led to him being found guilty of gross misconduct by judicial conduct tribunal and JSc subsequently recommended for impeachment in terms of sec 177 and ANC and DA voted for his removal. So is it ethical for a man who carry a record of dishonesty serve in the same body that declared him dishonest to validate other judges or safe guard the judicial conduct of other judges? 😂

We must be clear here. Hlophe was found guilty by JCT(judicial conduct committee) that committee comprises of judges only. Hlophe is elected to JSC, which conducts interviews for judges. He is there as a politician, deployed by his party. Don't confuse the two
