You guys should sue RU-vid for "adding context" by linking a Wikipedia article to The Sovereign citizen movement, which is basically considered a terrorist organization by the government. Have never seen this before but you obviously are not. This seems like the states way of cracking down on people who both know their rights and film the police while exercising them. Just my two cents. ✌️💯

UPDATE KIND OF: Hello again everyone. I have seen all of your inquiries about an update on my case. Unfortunately there has been nothing to report on since I last updated you. We are still waiting on a rulling from the 11th circuit. Patience is key here as it could take several more years for this case to be resolved. It’s cray that’s it’s taking this long . Too bad we don’t have laws in place stating that any law enforcement that break the laws And have lawsuits pending against them Will be suspended until all lawsuits are cleared. Then I bet the system would work a lot faster.

As many of you know, a federal judge stripped the pasco county sheriffs office of qualified immunity in the case of my illegal arrest in 2018. Rather than accept they were wrong, the sheriffs office exercised a provision of the law that allows law enforcement to immediately appeal the decision on a motion even before the lawsuit has concluded. This has allowed them to delay the lawsuit for yet year. But today is the day. The United States 11th circuit Court of appeals will hear their ridiculous appeal and, if they follow the law, strike it down and let my lawsuit finally continue. It has been 4 years since the pasco county sheriffs office illegally chained me up and threw me in a cage. The despicable way in which they have evaded taking responsibility for their misconduct is indicative of the fundamental problem with policing in America. Law enforcement is tasked with holding citizens accountable for their misdeeds. How can any citizen take law enforcement officers as anything but hypocrites when they (law enforcement) deploy every tactic possible to sidestep accountability for their own crimes. Hopefully today, the court of appeals will send a clear message to officers nation wide. "YOU ARE NOT ABOVE THE LAW. YOU ARE RESPONSIBLE FOR YOUR MISDEED. YOU WILL BE HELD ACCOUNTABLE."

I love that. POLICE are not above the law. POLICE will be held accountable. if that could somehow become the main message from the public to the officers, it would be a beautiful thing. Because you’re right, so often, most often, they are not held accountable. The hypocrisy of the system is maddening. If a citizen makes a “mistake“, they pay for it and arrest, fines, seizure and incarceration. If an officer makes a “mistake“, their consequences aren’t nearly as dire. I have most often seen verbal warnings, extra required sensitivity training and mandatory leave of absence WITH PAY. How is this fair? This forced hero-worship ideology has got to stop.

Thank you for pushing back on this! Most people give up. I was arrested for “obstruction “ because I was video tapping the police and they ended up breaking my knee. No charges were ever filed against me and I now have multiple lawyers wanting to take my case. They must feel good beating up a 50 yr old grandmother. I know it’ll take years but I want justice!

Bending over is the exact reason cops got this bad with everyone (and have been worse to blacks for centuries). Drag their ass through the court system every time until they realize we're not to be trifled with. Civil rights violations make it easier to hit the cop's pockets directly. GET THAT MONEY!!!

@@timblack1983 he did, but it's over a year later and nothing has happened. The police can wreck your life in an instant and it takes years of effort and expenses to get that rectified. It's ridiculous. Edit: the actual arrest was in 2018, so over three years later now

@@TheSupervillain316 In the UK (where I am based) the police don't make the decision, the prosecutors do (the Crown Prosecution Service). I believe it is different in the USA?

Prosecutor was trying to do some damage control for the sake of the county and the lawsuit that would follow. A prosecution would help on the lawsuit but seeing it was dropped (i’m sure for lack of probable cause), the lawsuit will be a slam dunk for the rapper. Plethora of case law from the Supreme Court to strip them of their Qualified Immunity

Yeah. They sound as if they're in high school -- and, frankly, don't look much older than that! Maybe they were out practicing traffic stops that night and thought they'd picked an easy target. The fact that they consulted a senior officer who was there and then threw in a narcotics search on top of a stop for a folded up paper license plate tells me they'd been sent out to get some "real experience" and were practicing on two Black men in a nice car.

Literally in this case - they are facing another lawsuit for the sheriff's "Intelligence Department" which identifies people they believe are likely to commit future crimes based on their police record, and actively harass them _and their relatives,_ admitting their goal is to make their lives miserable.

@@topleftfromtime That's a nice analogy. I believe they are about to find out it isn't legal. They were looking to write citations for anything (grass too high, etc.), surrounding their home and questioning in the middle of the night for any crimes, etc. 4 people are filing suit, but if they're successful, I would expect everyone on the list to follow up with their own suits.

Arrest is the tool they use for forcing compliance with unlawful orders. Most people will hand over their ID and move on. The sad thing is, there are rarely consequences for officers that do this. They arrest people and ask questions later.

Notice how the officer phrased it, "I am going to arrest you for resisting". And not for resisting "Arrest". The resisting the officer is talking about is this "boy" having the nerve to not drop his skivvies, bend over, lube up and do as I say. That is the resisting this highly decorated heroic POS is talking about and not the LAW. Its an everyday occasion in America, especially to those police think that don't know there rights. Oh, that color thing, it always comes into play.

Resisting a superior officer is different than resisting arrest. RSO is when you stop any emergency personnel (police, fire, medical, security, etc) from doing their duties with threats and/or violence.

@@angryhairpeice I'm aware. Except in the very beginning when the cop threatened to arrest him. The response was "for resisting arrest?" And the bit... I mean cop says yes. It wasn't until later where they still lied about him resisting an officer which still was not being done.

You don't get "Resisting arrest" charge bud, he dosent have to be under arrest to resist arrest, lets say you get stopped by police and they TRY to arrest you, and you back away, that's resisting.

This officer should be charged with official oppression! That officer was asked multiple times for his name and badge number and did everything he could to avoid answering this direct question and change the subject! Dismissed charges should be punishable by law with ZERO TOLERANCE to the arresting officer(s). This insane madness must stop! Its getting worse! This is leading to civil disobedience, resulting in the police defunding themselves. A citizens arrest against those officers unlawful threats and containment should be mandatory for all citizens to uphold.

@@TaylerJDust it is, according to the Freedom of Information Act all public Information must be provided immediately, verbally or in writing. There are exceptions if the government employee believes some of the information is protected. If so they should collect contact info and pass the request on to the proper department.

The officer might not get qualified immunity if it clear case of infringement of constitutional rights. Then it comes out of his pocket.. most times the city pays but always nice when cop has to pay. I would be happy with 100k from officer instead of 250k from the city knowing it comes out of his pocket :)

It sounds like they targeted someone with pockets deep enough to fight them tooth and nail for as long as they want to drag the case out. And all of their objections to having to put their money where their mouth is will probably be as fruitless as the prosecutor's objections to the dismissal of the charges that got them sued in the first place.

The father is 100% right. But so is his son. Neither individual was wrong side from the officer. The father just wants to go. Regardless of what's happening with his son. And he's right for doing that. The son wants to not have his rights violated. Regardless of what's happening with his father. The only problem in this entire situation, is the police officer.

Having this recorded clearly reveals how officers are ignorant of the state and federal constitution. It would be expected any officer be well versed with the Stop and Identify law in Florida. This was a waste of time for the judge, state prosecutors office and the taxpayers.

That passenger could easily have an outstanding warrant. The officer can ask a passenger to identify themselves. The driver also can be held responsible for aiding and abetting a fugitive if that person is wanted for any crime. The passenger screwed up not the police. Slapping unconstitutional in it doesn’t really do anything.

The issue is having humans behind the badge. It can’t be helped but humans have flaws to varying degrees. It does need an overhaul but it should start by evaluating their emotional state. The argument I believe is that their job exposes them to legal situations constantly and that it's not unreasonable for someone to occasionally make mistakes in their job. So given an honest mistake it is reasonable that the officer doesn't face personal liability. I don't really agree with it personally. Otherwise honest mistakes should be allowed for citizens as well. The problem is that it's also not just used for honest mistakes, but as a blanket protection for pretty much everything they do.

It was sad for me to hear his father’s instinct to submit to the officers demands while his son was standing up for their rights. Clear demonstration of the difference in their ages and past experiences. His father has grown up with the police’s abuse and having to submit to it where his son has grown up in an era in which we are becoming more knowledgeable about our rights and that we can challenge authority. I too commend his ability to remain calm but assertive and Hope he desecrates that department in his civil suit. This is what needs to be done if we’re ever going to clean up American law enforcement.

It is very sad. The father obviously knew police are likely to abuse power. People should definitely fight for their rights. Police need better education. And better systems for identifying individuals who are in violation of a crime. Honestly asking and demanding ID are 2 different things and asking may be ok for some and not ok for others. Police shouldn't be fishing for violations and people should have privacy. Personally, for me, I think everyone should just say who they are, let the police just document I feel that 5 minute interactions are not always adequate time in some situations to see if other crimes are involved. Who knows if someone in the car was carjacking and planning to murder the driver or vice versa. But, again, not at the risk of violating anyone's ability to maintain privacy.

This is just a mentality that’s been taught to us by our parents and their parents cuz there wasn’t any response that ended well in these situations besides give up and hope they don’t ruin or end your life. The fact that my parents were breathing during the civil rights movement is enough to know that it hasn’t been long enough for that mentality to change and I’m only 20 soon to hit 21. Just being able to arrest someone on the basis of false assertions, or plausibly deniable misconduct (where a cop just wants to arrest a person and therefore pieces together reasons that are weak but pieced together “in good faith”), seems like too much power and too little consequences for wrongdoing. I hate that it has taken me 36 years of ignorance about this stuff, until it happened to me, in order for me to dedicate the rest of my life gathering ammunition against similar cops.

They're supposed to be experts of the "law" otherwise they shouldn't be out there "enforcing" it right? If they make a mistake they should be held to a higher standard than normal people. The consequences should be so high that they would be sure not to violate the law and other people's rights.

What could _possibly_ be the rationale behind ID'ing a _passenger_ of a car in a traffic stop? What's the logic? If these police officers, presumably, don't go to random people on the street asking for their ID, why would they ask it for a _passenger_ of a car, who was not driving? By what logic? Seems to me like a pure power trip by the police officer. He ID's the passenger because he can. Because he loves to exert his authority over people and intimidate them. He gets kicks out of it. His ego gets a boost when he can order people around and show them who's in charge, and what their place in society is. Such police officers shouldn't have a badge.

A passenger is not required to give identification in response to that request. However, refusal to provide identification may allow the officer to expand the stop in order to determine whether that passenger or passengers poses a danger to their safety during the traffic stop.

To be fair, as shown in at least one other Audit the Audit vid, cops DO have the legal right/authority to conduct a random drug/dog search of the exterior of your vehicle pretty much any time they want. If memory serves the only caveat is they can't needlessly or excessively prolong the duration of the stop to do so i.e. cant make you sit there for an hour while they wait on the drug sniffing K-9 to show up. But you are 100% right on target for pointing out the absurdity of the drug seah. It is so blatantly obvious what happened here. The cops got mad that this dude wouldn't comply with their unlawful command and the drug search was a clearcut, undeniable attempt at vengeance.

Its also quite evident that the officers knew they would be making an arrest before they asked Mr Johnson and his father to step out of the vehicle and chose to 1. Escalate a minor stop into a fishing expedition for Narcotics or Weapons, and 2 use that escalation as a smokescreen to order Mr Johnson from the vehicle so they did not have to explain to Mr Johnson he was being placed under arrest before exiting the vehicle. I dont think this tactic would be legally actionable in court it certainly further exacerbates the distrust the community has in policing. Had Mr Johnson not been so calm and professional this could have ended disaster as its a bad idea not to let a person know the expectation of what will happen upon exiting the vehicle.

@@officerfuzz5-050 given how much legal precedent has granted leniency when cops blatantly abuse or misuse their authority, often to the detriment of their victims, there’s a lot of lawyers who’d love to talk to you more about your assertion. I know it’s sad that the era of unchecked police egos and lack of responsibility, oversight, and accountability is swiftly coming to an end, but that’s progress. The police state is crumbling and I’ll make the popcorn.

I have seen a video of this situation, and the passengers got out and walked away. They did it as soon as they pulled in to a car park for the stop. Might have been a audit the audit video, but was a fair while ago, so can't remember the details.

I submitted feedback on it... I'd suggest everyone do the same... the sovereign citizen movement is something else entirely, perhaps a tiny bit of overlap... generally speaking, auditors believe laws apply to them while Sovereign citizens believe themselves exempt from us law (illogically)...

What sucks the most, is i literally just watched a video of yours where the guy did the exact same thing, didnt show id, and the cop physically ripped him out of the vehicle, but in that state the cop was right, so you gave him a C. THE EXACT SAME CONDUCT. This is what is wrong. In another state, this cop would have been right. But in this particular video, that states laws dont require id. In any altercation, neither the cop, NOR the victim know exactly what the laws are. And sadly enough, essentially whatever the cop says, goes. Because look at how long this has still drug out. There is no true justice. We live in a police state.

aeway, I hear you and you have a point. But in this instance, the deputies were well within their authority to identify the passenger as established in the legal guidelines of the 2020-2021 edition of Florida Criminal Law and Motor Vehicle Manual (see section “Automobiles” and subsection “Treatment of Passengers”. Identifying passengers in the State of Florida is also well established by case law (Bratcher vs State, 1999). The subject case could have been dismissed based on ANY technicality, not necessarily procedure. ATA does some things well, but everyone has an agenda. ATA conveniently cite only portions of a statute to fit the narrative they want to convey - that too is also misleading if not wholly disingenuous. For what it’s worth, as a cop I probably wouldn’t have arrested the passenger as a matter of discretion. In fact, I probably wouldn't have asked the passenger for his ID unless he interjected himself into my investigation or I discovered something else that required me to ID him.

@@lc3507 Ummm... Bratcher vs State doesn't exactly fit the same criteria as this traffic stop did... BUT... you go ahead and keep requiring passengers to show ID when they have done nothing more than sat in the passenger seat on a traffic stop and very soon you might be named in a lawsuit.

@@dezzyd1 To your point the legal guidelines are just that…guidelines. But, there is a reason this stuff is taught in the academy and reiterated in FTO. That’s why there is good faith doctrine and qualified immunity that if we make a mistake (after all we are human), but were acting in good faith and can articulate the totality of circumstances, then LEOs should be fine. Not sure if you’re a LEO (or formerly a LEO) or not, but nonetheless take care and Merry Christmas.

Officers enjoy breaking the law because the subject was burdened by a night in jail (even if dismissed the next day). That is worth it for the officers ego when their authority is challenged.

From what I gather, they were considered to be in the commission of, or about to commit a crime, by default. Further evidence by the fact that the cop apologized to the driver when he told them he just moved there. Clearly, the cops were trying to make it be known that certain demographic factors would be immediately considered suspicious activity worthy of probable cause and this requiring the passenger to identify. I’m just curious why they didn’t come out and say what the REAL cause for their reasonable suspicion that would require the passenger to identify was 🤔

In today's day and age and officer who claims to be "ill informed" of ID rules, regs, laws and more importantly Constitutional rights are at worst an outright lie which should require termination or at best true ignorance, which also, should require termination.
