If only it were so. This is not England. Scottish Police are more corrupt and have deeper layers of corrupt supervisors to fall back on. Once ID given, fake charges would be laid and draconian Police bail conditions set enabling them to arrest if any future Auditing takes place. By talking about having a genuine motive you up the level of suspicion in there eyes and potentially in a judges eyes, so watch your language that you use with them. Also buy telling them that they can detain you and search you its almost like you are giving them permission. You need to tell them what you are doing ie photographing and videoing and then walk away from them. If they try to stop you or give you any hassle then you have a clear claim against them and it will increase the number of things you can claim for. If they are going to detain you as they can't decide on an offence then its not a detainment and you can walk off. They have to give you the actual offence you are suspected of. The office saying he is not doing his duty if he lets you go so will arrest you is not doing his duty in detaining you a member of public obeying the law. Needs firing and made an example to the other officers that stood buy like idiots, but we all know he'll get a pat on the back and a promotion, so the only option is a civil claim against him. Big fail handing over your details, turning off the recording and not defending yourself against the officers.

This is not England, where Police can be and are, sued for unlawful arrest. Police on the streets of Scotland are a law unto themselves and together with the PF office, they treat filming cops as terrorism. So they will detain for 24hours or longer if no ID is given and will push for years in jail from the court. There is also very little chance of a cop being held accountable and any civil case will takes years because they have been allowed to become experts at abusing the legal process and stretching out court cases. This is how wide the corruption has spread and how deeply ingrained it has become in Scotland. Do not expect justice here.

This HAS to be pursued legally, they totally violated your rights and not once did they state any laws or legislation that they were detaining you under. Did you give details? How did it go down in the end? Sometimes you may have to concead dependant on circumstance but you would still have a civil case as it was under threat of arrest which is unlawful.

If you are going to come to Scotland, learn the Scottish laws. They are not the same as England. You quote S50 etc but you needed to know about S13 Criminal Procedures (Scotland) Act 1995. If you were familiar with this and quoted it to them, they could not require your details or unreasonably detain you without articulating an offence (not waiting for a phone call from the chain of command to decide what the offence might be!). If you are going to play the game, best learn the rules! If you had known that, quoted it to them and they couldn’t articulate an offence, you could simply walk away. Any further detainment at that point would be unlawful. If the Police on the other hand had played it better, they could have articulated suspicion of hostile reconnaissance, obtained your details under S13, ascertained that you are an auditor and ‘released’ you with minimum inconvenience to both sides.
You should have walked when they said you weren't detained. Then if they grabbed you you have a claim. They can't tell you your not detained and then grab you as you walk off.
