First Amendment audit OakCreek post office . I was just leaving when the police showed up.I thought it was a pass .but i was wrong.yes i did talk to the one cop a bit to much. I was going to give the police a pass but they decided to try and follow me so for that reason i'll give them a fail.

The Supreme Court has repeatedly ruled that police officers at all levels of the government have no duty to protect the citizens of this country. It is the job of police officers to issue traffic citations, investigate crimes and arrest criminals. We are on our own for protection.

Where do people think they can just call the police when they are offended by something, especially if it is a legal action? That is a misuse of a public resource. The dispatchers need to grow a spine and the police officers need to know when they should act, and how to act. Observe, record, and drive on.

When a cop says "Why don't you want to ID?" Ask them to produce their drivers license and see what they say. When the say no, ask them why they don't want to ID.

Good job but you might want to keep asking them questions. How many internal review complaints do you have? How many times did you lie in court last month? 10,20, too many to count? Everytime they ask you a question ask them a question. Have you ever beaten your wife, girlfriend or boyfriend? Are you being treated for PTSD? Do you take steroids, you're aggressive? Did your mom marry her cousin? Are you the product of inbreeding? When they ask you what your plans are respond with you're not my parents, what are your plans? Again good job standing your ground and sticking up for your rights.

MERE SUSPICION PERHAPS REASONABLE SUSPICION NO - HERE'S WHY: They are clearly are not aware of the threshold level of suspicion being that of REASONABLE SUSPICION ... filming in public can be seen as suspicious , yes, but absent any facts or evidence of criminality it remains MERE SUSPICION where policed are taught to engage lightly and observe . Here is material for you to get familiar with the legal concept of suspicion. Have a read and research the concept more and you will see that the totality of circumstances do not lead to REASONABLE SUSPICION. MERE SUSPICION means that the officer has a gut feeling that something is not right, but the officer cannot point to any specific facts; it is something like intuition. Suspicion means that the officer knows a minor fact, or has some larger fact that came from an unknown or unreliable source that suggests that evidence may be located somewhere or someone has committed a crime. For instance, an officer stops a person on the street to ask a question and the person quickly puts a hand in a pocket. Or, the officer may find a piece of paper on the street which says that a particular person is selling drugs.

"Officer, I am a citizen on a sidewalk in public taking photographs. That is neither a felony nor a misdemeanor. However someone may have called 911 for a non-emergency which is an offense that deprives citizens of essential first responders while they are on that call. As a citizen and a taxpayer, I request you investigate that instead of a law abiding person." You see, an audit is a fail if there are no consequences for misconduct.

In my opinion..the cop you said was being respectful...was not being respectful. It was part of their psychological tactics to get you talking and revealing information. You still did a good job at not giving info you were not required to..but the cop still tried to trick you into stuff! That's just my opinion. Great audit though!

The bs tough guy "I'm conducting and investigation" didn't work, so he switches to the "nice guy" approach. Again, talking to police is asking for trouble. Simply ask, "(officer name) (officer badge number) are you lying for the record in and effort to manufacture probable cause for arrest?" When they ask if you are a laywer, "For the record, (officer name) (officer badge number) is not a lawyer." And the best way I have experienced and seen to end an interaction is to simply walk away and say "have a nice day", or "you're dismissed".

One thing that I like is that even though you were willing to talk about general stuff, whenever they asked about specifics you just said nothing. I wish you wouldn't have talked at all, but that was much better than some people who end up getting flustered and accidentally giving away information.

Write down all of the stupid questions and comments you know cops are going to spew, write down what you consider an appropriate response (something witty, vulgar, snarky, whatever), then read everything aloud at least 100 times. The next time you're confronted by a cop you will be amazed how magically your responses flow out of your mouth when they say something stupid. Also learn your state's laws about loitering, disturbing the peace, trespassing, etc. verbatim so you can make fools of the cops who try and make up laws or apply them incorrectly. It's best to not respond to cops questions at all (and SCOTUS Justices will tell you so) but if you are going to respond, answer questions with questions ("Do you have an ID?" "Why is that any of your business?") or learn to magic words, "So what?" as in "it's making them nervous," "So what?" Also print out HQ-1B-012-2010 and tell the next cop who says something about recording federal buildings to wipe his ass with it. When they start to follow you, simply stand near them and extend a middle finger, you might also want to chant "F*#k the police.". They'll either lose their minds and do something illegal about it, or they'll have to sit there and be humiliated in public.

Right to Record - I constantly tell folks to write down and role play the Q&A stuff so they have a good flow and direct precise answers... however the reason to print out the DHS memo is not to recite it to officers or shove it in their nose, its so if they book you for a made up crime related to recording the facilities, they literally have to book that piece of paper as your personal belongings or evidence, and nothing will be more ironic than that listed...

Yep. The first cop was OK. I especially liked the part about not giving up your hobby solely because it makes other people uneasy. That's a great way of putting it. I had to laugh when the younger cop didn't want to be filmed saying he didn't like the new color scheme of the patrol cars. What do you suppose he was afraid of? Reprisal because he liked the older colors? SMH

USPS Poster 7 - you can film ANYWHERE in the post office where you have a legal right to be, including in the retail area. And even if you may not ENTER unauthorized areas, you can still film it if your eyes can see it - so, it's up to them to keep doors closed or windows obscured if they don't want it seen/heard/filmed.

Oak Creek cops are usually pretty cool. Mirror their response. The one cop was pretty cool. If they act rude, then I get it. But you talked to them rudely 1st. I'd get it after the questions kept getting personal. In all, I get nervous when a bunch of cops come up to me and ask stupid questions. That's pretty suspicious! Lol.

I'm curious NN Wisconsin , how far from Rhinelander are you ? I keep hearing how great their police dept. is( my sister is on the city council) but someone last night tossed a brick on to a cruiser from a roof top, so it has me thinking other wise .Maybe you should do an audit over that way . Cops always try and surround you. It's a subtle intimidation tactic. That's what the out of frame cop was doing.
