Possible sentence: If convicted on all 67 counts, Wester could be sentenced to a maximum of more than 200 years in state prison, though he would serve only a fraction of that. Under state sentencing guidelines, his actual term could top out under 20 years. Local legal experts says if convicted on all counts he likely will serve 13 ½ years.
A fired sheriff’s deputy in Jackson County, Florida stands trial for allegedly planting drugs on people during traffic stops. Zachary Wester, 28, is accused of framing 12 people, but prosecutors ultimately dropped charges in almost 120 cases that he was involved in. Opening statements are scheduled to begin Monday, May 10, at 9 a.m. ET. You can watch in the player above.
The defendant faces charges including racketeering, official misconduct, perjury, fabricating physical evidence, possession of controlled substance, possession of drug paraphernalia, false imprisonment, and possession of a controlled substance.
According to authorities, Wester’s M.O. was to pull over people for alleged minor traffic violations, searching their vehicles after claiming to smell marijuana, and planting drugs. Naturally, this caused major harm, and not just incarceration. Alleged victim Benjamin Bowling lost custody of his daughter.
His body cam video shows the February 15, 2018 arrest of Teresa Odom.
Wester began to search her white pickup truck at about 4:30 of the footage. As seen on video, he was about to put a black glove on his left hand, but had some fingers closed. The hand disappeared out of frame, and then he put on the glove.
Authorities suggest that he was holding the drugs he planted in the vehicle.
Wester confronted Odom with the substance at about 9:30.
“That is not mine,” Odom said. “No, sir.”
Wester went to the trunk of his cruiser to test the substance.
“Oh, no, Teresa, you’re going to jail,” said a female deputy.
But based on the allegations, it was all Wester’s fault.
“It did return presumptive positive for methamphetamine, okay,” the defendant told Odom. “I’m just letting you know.”
Wester previously served at the Liberty County Sheriff’s Office but got fired eight months into the job. Former Sheriff Nick Finch told the Tallahassee Democrat he warned then-Jackson County Sheriff Lou Roberts not to hire the defendant. He said there were rumors about Wester having sex on the job, and having affairs with married women. Reported misconduct with the Jackson County Sheriff’s Office included sharing nude photos of an employee with other deputies, and starting an affair with a woman he arrested for shoplifting a Dr. Pepper.

I've seen two of his stops and the fact that he was so overly friendly and jovel during those stops while planting drugs and disrupting their lives the way he did is simply SICKENING!!! I can't imagine what all his victims had to go through to get their lives back in order and clear their names. Blessings to them and I hope their doing okay!!

The victims won a $1M civil law suit against the sheriffs department. I believe there were 30 victims in all. Not sure about the factual amount and victims. Divide that up and it’s still not enough to hold them accountable and to help the victims make up for what they lost. Money, jobs, children and creditability. This was a heinous act. I would sue this man alone as well if I could because 12 years isn’t enough time. I understand the jury did their due diligence and duty. Three guilty verdicts for three victims is better than none. He has been held accountable and now is in prison as a felon. He can’t hurt anyone anymore for a long time.

He was found guilty of the charges that had video. But IMO, he should have been found guilty on all the other charges for turning his camera off in the first place. The fact that he did that says more than anything.

The videos they did have, that showed a major pattern, the same type of drugs and containers as the ones he used in the others, the same drugs and packaging that was found in his car along with the testimony of the witnesses should be suffice. This isn't a TV show where we always get video, dna etc. to prove guilt. It's called REASONABLE doubt not ZERO doubt.

I'm so frustrated that he didn't get punished for each person he set up. Just because you don't have video evidence doesn't mean it didn't happen. The videos they did have, that showed a major pattern, the same type of drugs and containers as the ones he used in the others, the same drugs and packaging that was found in his car along with the testimony of the witnesses should be suffice. They couldn't because this was a case full of circunstantial evidence. He was clearly guilty but in court it has to be proven beyond any doubt.

Thankfully with civil suits the evidence doesn't need to be quite so substantial. I'm so happy and yes so bummed out. Westar put his hands behind his back to be cuffed and the bailiff robbed his back and indicated I'll put the Cuffs in the front. Special treatment already

@@JamesWatheist The problem is, if they convict without clear proof then he may end up getting the charges dropped if his appeal is successful. He should spend many years behind bars for the charges he was found guilty for because he damaged many lives and he clearly planted drugs.

His complete lack of remorse and shock when he was convicted says it all. Has been so used to getting his way in life, probably a spoilt brat of priviledge who was put on a pedestal by his family. I can visual him hunting down people he deems responsible for his current predicament and taking them out. He gives me the creeps, the fact his daddy was so high up in law enforcement is scary too, he'd have plenty of contacts to get any info they want. I'd be watching him like a hawk when he gets out🤢🤢

I think the judge was even upset about the verdict. He knew he planted drugs in people's vehicles. Wester, definitely turned off or moved his camera away, so nobody could see what he was doing. Karma is amazing!! Wester is a monster.

The Fake news says he faces up to 13 years in Prison then other times they say he faces 50 years.. Sentancing next Monday .. He is not a Cop anymore..I saw mention that some of his Co-Workers had to be in on his corruption .. Also it was a new Female Prosecutor who loooked into to his Crimes after his Vitcims came forward and said they never had drugs in their car.. My guess is the Jury found him guilty on chages involving Citizens who did not have criminol and drug use charges..

@@electricpaper269 hahaha yeah right. I agree the jury seems to have worked quite precise here, but both the concept and the outcome of how US decides justice is a complete joke. Any reasonable doubt didn't help in the verdicts for Donald Hartung, Henry Segura, Jack McCullough, and literally hundreds of thousands unnamed others. What a joke to think every amateur jury will follow the instructions to the letter

@@kkmcknight5463 that's not true. There is a different standard of proof in civil court. So, more info will come out in civil. Look at OJ. He was acquitted in criminal court, but then he was crushed financially by a civil verdict that found him guilty.

I read he could face 13 1/2 years in prison on the guilty verdicts, and sentencing is on Monday. I hope he gets those sentences consecutively! The fact he got acquitted on the ones without video evidence is not exactly a bad thing... this sets a precedent for the future; meaning, if you can't convict a cop without video evidence, then you shouldn't be able to convict a citizen without it either either!

Like most here, I watched every second of this trial. It was obvious to me that the defense atty struggled to make his client look "less guilty" and thought the prosecutor did a good job with the evidence. Zoo it's beyond me how this jury arrived at a single "not guilty" in this case. Leaves me wondering if they watched the same evidence we all saw.

@@NavyWife Yeah, I think so too. I definitely think count 1 will be reversed on appeal, that's if the trial judge doesn't dismiss it himself before sentencing. Since there are 3 victims, I'm kind of thinking he will get 4-5 years each, probably consecutive. I think we will be in the ball park of 12-15 years.

@@JamesWatheist Yea, but concurrent sentencing is the presumed standard & the judge can only sentence consecutive if he provides a thorough reasoning of the special factors warranting it. Don’t get me wrong, I hope he gets consecutive! But I fear he won’t.

@@maryb6672 Not in Florida. They don't have to make any special findings to go consecutive. The only way I'd see these all running concurrent is if let's say the Judge gives 10+ years on count 1, and 5 for all other counts. I don't think that would happen because as I've said I don't think count 1 will hold up. All the other counts are 5 year max and running 18 counts concurrent..I just don't see it.

After watching this trial testimony I'm in awe of the jury being able to 'keep it all straight'. I'm no dummy, but I wonder how well I could in a similar trial. Not only '67 counts' but the confusing victim and other players names along with the details of the crimes would keep me on my toes, and probably awake at night, and for months to come. I say 'Well Done' to those silent heroes of this story.

@ 10:10....he starts to look a little defeated here. He even gives his twitchy brow and forehead a little rub. He looks pretty stressed out, right? As bad as he’s feeling at that very moment, I wonder if it crossed his mind that he, illegally and immorally, inflicted that same feeling of hopelessness and misery to all those people he planted drugs on. He should be feeling that way, but I’d bet my paycheck that he doesn’t. His concern at that very moment was all about him. I honestly believe that he is incapable of feeling empathy for those people. Because if he had any empathy, he wouldn’t have done what he did to these people in the first place. I’m looking forward to next week to see what his sentence will be. And I’m glad he’s sitting in a jail cell having to worry about the time he’ll get. I hope he’s consumed with dread and feared. Because that’s what he inflicted on these innocent people.

And watching this case in its entirety Beyond mind-blowing how the jury did not find him guilty on all charges is beyond me. The irony to see he got some of what he gave out. However let this also show how sloppy police work makes a difference. Also if you noticed how Zachary would draw attention away from him and what he was doing by singing or making small talk to distract others so he could plant evidence. Not to mention how his cam never stayed focused on his hands or item being searched until claims of finding drug's. I guess some justice is better than no justice.
