Lazarony's lawyer says this is an example of the exasperating, increasingly standard industry procedure that's costing tax payers millions and millions of dollars.
A friend of mine had an account with Wells Fargo and discovered the bank opened an account in her name without her permission. I don't remember the details but there was fraud involved. My friend closed their account and then reported the bank to the police department. Last I heard there were criminal charges pending.
First up, she did her job right, this was in 2010. Second up, are you guys still electing your judges? If you elect judges like this I can get behind it!
@@davidfitzgerald4683 lmao, you're pretty funny! One paper per person with the associated fee, but not multiple copies served to imaginary people.... If you go through a mcdonalds and order one double cheeseburger but get charged for 8 double cheeseburgers I hope when you say "but I didn't order 8" the person just tells you "pay the god damn money"
@@marywolfe4617 what’s wrong with overdraw charges? Set your account to not allow overdraws. If you don’t have the money, don’t spend it, and then don’t expect the bank to just lend you their money for free. I’m not saying banks can’t be predatory, but Jesus, take SOME responsibility
Wells Fargo did the same crap with me with my car years ago. If you pursue it deeply or threaten legal action, they simply say it was a clerical error and everything magically fixes itself.
I had a tow truck driver steal my truck and claim it was illegally parked in an apartment complex. If I didn't have security camera footage of him taking it out of my driveway, I would have been screwed. Long story short: He business partner was sergeant with the city PD and he blocked GTA charges for the cars they stole and charged fees out the ass to get back. Rather than face the public backlash, the city let him retire and cancelled the business license.
Wells Fargo is a huge mafia. If you have a mortgage with them look at the early payment clause. Most will forclose if you pay early or charge early payment fees
Sad thing is, we are going to relive this type of foreclosure nonsense very soon. This was aired 10yrs ago and displays how we just keep repeating history. Sadly much hasn't changed in this world.
cotton1983 So you noticed. And throw Bank of America in with thieves. They figure you'd be intimidated by the"Big Bank".Surprise, surprise, they act surprised you fight back. When you win they act apoplectic.Hehehe!
I bought my house for cash several years ago. There was a note on the property. Wells Fargo gave us an amount and a date to pay by which was around 20 days. I paid within 7 days. The title company did their thing. I checked the county records about 2 months later and saw a bank listed on my property. Wells Fargo gave us a date, then sold the note to another bank a few days later, and they cashed my check. It's funny when you send a fax with the proper documentation and mention the words fraud and attorney how fast they become attentive and polite.
This is bleeding into every type of law. When you go to get a divorce the 1st thing the lawyer asks you is to list your assets. It's not to divide them, it's to see how much they can get from you. They will do as much unnecessary work as your budget allows.
could say that how you think tax is a fee is greed, or as you say the same, fraud. You live in a country that provide billions in public services like you know, police, fire departments, hospitals, roads, highways, laws, basically your entire life and expect to not have to pay for it, THAT is greed.
1bvr2lmr Being born in the sixties in CANADA since then,Less to citizens more to corporations so that's greed on my part?Notice more for less. That's greed. !immigration is CANADAS way of rebuilding its workforce. That's not greed?NAFTA that's not greed?Belgium will not sign the new deal.Is that greed. You seem to have a twisted world perspective. Peace to you
well cmon, your both right, we should pay for decent roads and infrastructure, for both our home lives and if you start a business, ppl do it all the time, and guess what? trillions of $ spent on a system that will LET you, if you have a good enough idea, become wealthy. Corp. greed, and corp. welfare is rampant here in US and with dickface Trump, itll get worse
@@l8tr597 income tax pays for no infrastructure. It pays solely the interest on a debt to a mostly privately held banking cartel. It was made illegal to pay the principal in '33. Look it up.
It has always been in the USA that banks are crooked, that is why Billy the Kid became an outlaw, they forced him and his family off their property with false statements about them. I think Wells Fargo may have been behind this scam even then.
The bank officials should be fired as well as the process server! The lawyers should be charged with fraud and lose their law licenses. I would then personally sue them for as much money as I could get for committing fraud!
Please do a full job on this story and follow up on it, investigative journalism should not end at a headline grabbing section but also show a conclusion, I think this is what's killing peoples faith in reporter's.
So true. Many of these stories disappear and can't even be found on the web. I'm sure there's court documents scattered about, but I'm not the reporter.
This happened to a guy in Florida from Wells Fargo. His house was paid off and he never had an business with Wells Fargo. He sued and they failed to respond. He won a summary judgment which they failed to pay so he foreclosed on one of their branch buildings. The complete story is here on YT.
We ended up having to file bankruptcy over 10 years ago while working to pay off our debts , the bank kept selling the same debts over and over , each time stacking on more fees, and more fees, we finally had to stop paying because we would send money to one place and then get another bill in the mail for the same thing! Corruption at it's finest!.
My best friend in high school. Lost his dad got a nice life insurance policy. Bought a house that was derelict and needed to be stripped to the studs interior and exterior. I helped him do all the work that we knew how to. 4 years later he gets a notice from Banks that's right multiple banks. So he took legal action and showed proof there was no lean no loan nothing barrowed against his property ever sense he owned it out right. He ended up suing the previous land owners family cause they went behind his back and put loans on that property. His family frauded the bank. At this point it was pretty clear why they wanted the property so when he died they could sell it and make about 1mill split the profit between the three kids and no work. This was discovered by some investigating. Each one of his kids are spending 3-5 years for forgery, theift, property theft, unbegotten loans, and about 5 more things and they have to register as felons. He still lives there and owns his property.
I had a mortgage with Chemical bank when they were around. I always rounded up my mortgage check, having the overpayment applied to the principal. They got caught charging me a late fee on the mortgage when the additional principal was credited before the due date. The service team member argued with me that I must have sent 2 checks. I had to provide proof that it was one check before i got a refund of the fraudulant late charge... I suppose for an additional fee, I could have gotten an apology.
I like when they're trying to stress something mid-shout... "The underwater passage to these uhcave. uhsurvivors. is uhvery. uhvery. uhtreacherous. for these. uhighly. uhskilled. uhteam of. uhdivers. Back to you, Michael..."
Still that is a pretty solid accusation. Serving a person multiple times at a flat rate fee to "unknown" persons and then stick them the bill is fraud.
Because if he doesn't have solid proof of that, HE will be accused of DEFAMATION. Calling a company like that to be fraudulent is a criminal accusation. Just suggesting it publicly can cause serious damage to the company.
Jak Stone I implied there are some good ones with my qualified statement (using the word most). However, since most "laws" are unconstitutional, that means judges are breaking the highest law of the land far more than anyone else. But that's another topic for another day.
It happened 2 me My house is paid off for years in a nice neighborhood guess WhatAfter I rented it out couldn’t kick him out I wound up getting $14,000 for the house and a shit ton of added up taxes thanks to local corrupt politicians
This video has aged in interesting ways. "Fraud" was a big bad thing 10 years ago. Now, all politicians are doing it and we just shrug it off as though it is expected.
Also back then we didn't have as much ease of access of information. It's possible that they've been doing it all along and only now are we starting to notice
They've always been doing it and people have always known about it at some level. I agree the level of information gathering and access does help with awareness, as does the increase in attention due to more flagrant cases of fraud and abuse.
Baloney these firms decided to serve everyone and anyone to cover themselves because the paperwork on these mortgages is so f*^cked up in the first place. These judges need to toss the entire foreclosure because these loans have been passed around so much, sold off at a discount to others, and manipulated so horrendously that even proving they own the mortgage might be difficult if not impossible. But hey they contribute to political campaigns so who cares if they are actually legal in the first place or they can even prove they own them. That question is never asked even by the defense attorneys because they don't want to "rock the boat." Scum!
It's all a big shell game perpetrated by lazy bastards who refuse to process and log mortgages with the proper title company in the county where home exists! Instead they wanted to build a commercial package of these loans that can be traded on the stock market!!! It's coming back to bite them big time!
It is in the interest of banks to foreclose on homeowners, they actually make more money that way. Nothing but a bunch of crooks that have sold their countrymen down the road. There will come a day when things are put in balance once again. The peasants will always rise.
Initially, you would think that they would suffer a loss. But, the banks are the ones that inflated the values of homes to begin with. The government and everyone is profiting and keeping people busy working with all of the paperwork and court crap. Many local governments had an influx of money during the housing bubble, then they got in debt. But, by transferring ownership of properties continually cities, counties, and states get tax revenue and fees and all of the systems connected get monies collected also. Real estate. moving companies, banks, mortgage brokers, etc. also get the profits from this mess. It is not in the best interest of any economy to have people stay put often times. Plus, you have to think, when people move from their homes, either by force or otherwise, they lose or throw away some possessions, redecorate, do home improvement, etc. They support other businesses in this continuous cycle as they move from location to location. It is not just the banks that benefit: but everyone except the homeowner. But, the homeowner can rebuild their credit again in time and just repeat the cycle all over again. I can't tell you how many times I've accumulated some decent money in savings to have a disaster/major life event that eats this money away, then I get through the issue, resave again and start over, to only have it repeat once more. It gets annoying after awhile. So tired of installing new car transmissions, brakes, and crap.. but shit is meant to break so we have to keep buying... It makes it hard to ever get ahead.
Heather Gleason Home buyers share the blame too. Too many took what Joe Blow at the bank said as "this is what you can afford" as if they were looking out for them. Our bank was in awe when they said you can afford $450K and we said NO $300K was where we felt good at after WE ran the numbers. They actually asked "are you sure" a few times. Also being new to the market here we started to look at $150K home quickly upped that to $200K then to $250K and settled on $300K...why start at the top!!! it pissed the Realtor off but who cares they made money for 3 days of work. We never told the Realtor what the bank approved us for...none of their business. If we would have said $450K what would we be looking at $450K homes only...no thank you. So the home buyer needs to be smart too and not just blame the banks. You are an adult use the thing you have called a brain.
Thank goodness we have a judge ready to open a case against the wrong doers. May many more judges follow suit. Keep it alive and exposed is the best way to overturn the corrupt. I have never dealt with this company or their subsidiaries, however, after reading the comments below, I never will. Thank you for your stories. Keep speaking out because when the customers are given the correct information, they make the right choices. That's how businesses fold in the end
Man, and I got all upset when my dental insurance provider sent me a letter with a false claim that my dentist wasn't in their network. That's nothing compared to this.
This happened to me in Indiana. The bank's lawyer would schedule court hearing and cancel them at the last minute. Eventually they scheduled meetings that I couldnt attend and then without me there they could get the judge to approve anything.
They serve me, I'll pay the process server fee. They try to serve me again and its, "I've already been served. You don't want to do this because I will pay only the one fee. I will *NOT* pay twice and if you try to make me pay more than once, I will file a criminal complaint for attempted fraud. Now won't that be fun?"
I'm watching this during COVID-19 and I PRAY no one is harassed this way. Yea, he may lose his house but how can you charge someone for "unknown spouse or tennant"?
@@tikesplace maybe my comment wasn't clear. Im not arguing the foreclosure, im arguing the processing fees. $45 each to serve papers on the husband and wife listed on the deed. Im asking why is it their responsibility to pay for processing fees to an "unknown spouse or tenant". If you wanted to sue me, you need documentation that I received the summons, that's why people use process servers. You could just mail the letter. That doesn't guarantee the letter arrived. Certified mail requires a signature. Unless you specify, anyone can sign for a letter/package. So again, you use a process server to ensure the letter gets to that specific person. You cannot serve an "unknown spouse or tenant". Just send a letter, its cheaper! So either the mortgage company or the processing company tried to fatten their checks. There's no way $500+ was needed to serve a couple for a foreclosure.
@@tikesplace no we don't agree. If I buy a house, then 10 years later get married, that's not the lender's business. The loan, our agreement, is still in my name. If they have to sue my husband for half because its deemed martial property, fine. Thats understandable if the loan company does its homework and finds out im married. I could have a prenuptial agreement 😱. You cannot serve unknown spouse or unknown tenant. For example: If I lived with a friend for 3 months and they failed to pay the mortgage, you think the bank has a legal right to come after me as "unknown tenant"? You cannot be serious... Again, im not arguing the foreclosure, im arguing the excessive processing fees to unknown people. Thats ridiculous. And honestly, if lenders are still giving out loans to people who clearly can't afford it, we learned nothing from the 2007 housing/financial crisis and that's more concerning than your opinion.
yeah, well, it's florida, so really none of this surprises me. i refuse to do business with any florida companies, as i just automatically assume it's a scam of some kind.
Georgie10184 Damn George it's hard trying understand what you are writing, or saying sir. You need to clean up your writing skills, but don't worry sir, I have no desire to move to Florida ever.
If this judge put several of those lawyers that represent those companies in jail for contempt of court I bet it would suddenly become hard to find a lawyer to serve the papers.
Wells Fargo sucks. I had a condo years ago around 2012 and they foreclosed on my condo. I had to file bankruptcy and then they wanted to work with. I realized later under a situation out of my control they should have given me the loan because I couldn’t afford it and the condo fee a month. They are such a horrible company. I will never deal with them again. I hope this man and his wife get satisfaction, they are a dirty company! They will get karma one day!
They were doing the same thing in 2008. When they took my home. The judge told me they knew what they were doing but they couldn't do anything about. It was a way of the courts making money thru the foreclosures. I had proof that they has forged my signature and changed my income.
When it comes to lawyers / solicitors and money, there's no end to the charges for phonecalls and paperwork...... they would probably send you an invoice for saying hello to them on the street.....
Why is it necessary to sue these guys? It should be sufficient to just not pay the bill, with the law firm then having to take action and prove the charges are justified. They would not send out fraudulent invoices in the first place. But the laws are designed to aid the crooks and screw the poor and powerless.
Walter - It's called deregulation and government hands off business! Remember when that was being pushed by the republicans. The same crap they are pushing again, that drove the US to the very brink of total economic collapse!
Seems like the opposite of what you're talking about to me, considering if it was actually deregulated you can just throw away all the paperwork and give them the finger. What you mean is cronyism, and that's ripe with all the big name parties.
funny abc refers to the government as industry standard procedure.... when are us americans gonna wake up and realize dem. vs rep. is the least of your worries
I was called Christmas eve amd ask did I like living in my house by Chace Bank. All.the while I was making extra payments in a program they had for paying your mortgage off early. No one from local bank or by phone would or coulld tell me what was going on. I had a friends wife that was a manager sit down with me at her branch for the better part of three hours and me threatened legal action to straighten it all out they even shut me out of online banking. Needles to say I no longer bank there.
something different about that guy. you can see it in every bit of his demeanor, the way he stands and answers questions, losing his home is having a huge effect on him.
In 1965 my mother and stepfather arranged to buy a house in Hermosa Beach, CA. We moved in and for the next ten months we had to spend a bundle on several calls to a company to have the cesspool drained (the house did not have a sewer connection). We were fed up and moved out. A law firm sent my parents a notice that they intended to open foreclosure proceedings. My parents contacted a lawyer, who spelled out my parents' grievances and said that if they tried to do so we would prepare a cross-complaint in court for damages and fraud. We never heard from the lawyers or the former owners again.
Someone once said "Back in the day, if a man wanted to rob a Bank, he went out and got a shotgun. Nowadays, he buys a suit from Marks and Spencer's and gets a degree in Finances!" If I was the Judge handling the case, I'd tell everyone of those jokers "You want that $515K? Better get off your arse and start learning how to flip burgers because, shortly, you're going to be getting a letter from MacDonalds saying you're being press-ganged!"
So, is the mortgage being regularly paid? If not, you lose the house. It’s the same all over the world. But there should only be one summons per person.
Thank you judge. For doing your job. More than i can say for the hundreds of thousands of self-serving judges out there abating this criminal behavior.
I'm sure they just claimed it was a computer error and walked free. It's a severe legal problem that companies are not held responsible in the same way individuals are.
One lawyer charged a client $10,000 and then had the panicked client (he was facing a criminal charge) sign a waiver that the basic fee was only $2,000 (the state commission forbade fees over $2,000) with $8,000 as a "bonus." Another lawyer milked a client for $6,000, stalling on a case for 18 months. Another lawyer billed a client $3,000 and then refused to go to court with him. Another lawyer, approached a litigant - in court - and asked him to countersign a court order without telling the lay person that his signature ends all future rights to litigate. The lawyer then sent his fellow attorney to coerce the lay person with the same approach five minutes later. The lay person, who refused to sign, then complained to the judge but she did nothing. Horror stories I have heard.
Woii......depending on your wifes mentality after getting an unwarranted foreclosure notice now she wonders if my husband may have a possible wife from before????? You trying to get this man killed????? Craziness....🤣🤣😅🤣
After my mother-in-law died, Wells Fargo sued all her children for possession of the house that was only in my mother-in-law's name. (She had taken out a reverse mortgage or loan using the house as collateral.) They gave us papers _twice._ It didn't even occur to them to _call and ask_ if anyone was going to try and take the house. No courtesy, just "you are being sued so we can own a house you have no claim to."
Actually, you DID have claim. A Reverse Amortization mortgage has a Guaranteed payment and the net asset does diminish, however depending upon local market you might have had a net asset. Also you have the RIGHT in inheritance law to audit the balance and decide if you want to take a new mortgage. Generally speaking there is usually a LOT of money still on the table. Actuarials NEVER allow one to beat the bank or insurance.
How do you serve an unknown person? Wells Fargo, please tell us how your bank serves an unknown person. I have had numerous issues with Wells Fargo Bank. Wells Fargo is a licensed institution and member of the esteemed Federal Reserve Board. Wells Fargo has employees dedicated to dreaming up and inventing new ways of committing fraud and stealing as much money from their customers as they can.
