It makes absolutely no sense because in such cases labels have a mechanism of connecting with the platform. What about platforms such as VK? The biggest SN in Europe, pirating music for a decade & nothing. Because that helped that big labels to get known.

Reference Napster. :P Personally, I think that those web archives.. at least the major ones.. should be afforded the same protections as the Library of Congress. It is an archive for historical purposes and should be protected. In fact, the record labels should be encouraging the archival of their catalog just in case some disaster happens.. there is 'one more potential chance' that the catalog survives the disaster.

The thing is even the government officials use Internet Archive to get coppies of necessary software that is no longer available for purchase from official stores. Record labels are just trying to make money through unethical means instead of just making better music.

This is because the Internet archive is backing up the entire DatPiff catalog. The RIAA basically sued mixtapes into non-existence, but due their cultural impacts we should be able to archive these songs.

Funny this is about WayBack Machine - I just gave them another donation because I use it for a number of reason on a regular basis. I have my own works (websites no longer up, books, etc) on it (even though I have it for sale on Amazon etc) because I want my stuff to be readily available to the masses & use it as a "poor mans copyright" for reasons of not being able to afford said copyright fees. Don't let TSA molest you/violate your Rights without promising to take you out for a seven course meal - there's a reason I have flown FOUR times since TSA was created ... just saying.

Downloading has kinda screwed the music biz. In the day when physical media was king, and radio airplay made hits, the biz (while still not removed from crooked practices) made incredible money for nearly everyone. Now instead of a bazillion record labels there are four major corporations who control everything… and the homogenous product that’s resulted from this is nothing but a yawn. The current music biz is a monopolistic entity that needs to be broken up.

I don't think it has anything to do with money, copyright, or music. It is just an attack vector to attempt to remove Internet Archive. Censored and defunct websites are preserved by Internet Archive, and they want all the information to just disappear. Bankrupting Internet Archive is how that would be accomplished.

Yet another reason to buy from independent artists and record labels. The Copyright Act was developed to reward creative content and the advancement of the arts but time and time again we now see that fall to the wayside so that the rich can get richer. I hope these major labels can survive the reputational damage they are doing to themselves.

I actually really liked this video format - I'll admit, my attention span can be short, and wane quickly, so this was a very nice, easy to digest video. As for the content itself - I am definitely not a lawyer, but it seems to make sense logically. That said, I really dislike it. I get that the Internet Archive and Wayback Machine could be abused, but I think this kind of action can threaten their existence, and that the damage from that would be far greater than the damage to the dinosaur record labels. To me, this is really just subsidizing their inability to adapt to a modern world.

They big image licensors would try to sign up photographers who had tons of photo shoots, but had been granted simple permission to hold shoots on commercial properties. Some of the photographers were only allowed to shoot if they provided final proofs of the end works. Of course the photographers licensed the work afterwards and ignored their initial promises to the people who allowed the shoot to even happen. My point is the big image licensors would try to extort everyone they could think of afterwards.

They employ a floor full of lawyers, like Disney. They have an entire office building floor, full of corporate lawyers with nothing to do unless they file cases. This is also how they crush you, these lawyers are on salary and part of the business model. To defend you need to pay Krystal $200-$300 sometimes $500/hr

Years ago wayback machine was the website we checked to see tunecore's old terms and condition, interestingly we could see the website changes, but somehow they redacted the T&Cs😳, We also used it to read articles from old music magazines 😉

That’s like suing a library for having books 🤦‍♂️ The only way there should _maybe_ a case is if they’re letting people download the songs for free, and people are doing it by the tens-of-thousands. But I’m going out on a limb here and assuming way back machine isn’t trying to be the next Napster.

Some one came through our city 15 years ago and handing out CRI papers for radio play in restaurants , businesses. All business establishments were told they were to pay a musicians ( representative organization ? ) union fees. I don't recall the specifics. However, we told them to F::: off, see you in court. The right to public airplay have been contracted and paid by stations are in the public airway. While not the same issue it seems that double dipping and no verification that the artist they claim t protect would even benefit. Doesnt hurt Miss Krystle is easy on the eyes.

It;s how composers and publishers get paid, not the record companies. MY primary source of income as a composer. You didn't tell anybody to "f off, see you in court." FUN! You're on the case. So here's what I think - which is usually pretty good. We used to have a tape and watch later exception to the big C. People could record on their VCR and watch anything broadcast at their convenience - and I don't recall any limitations to it - requiring erasure after a single viewing - not even for example showing it to an audience just like the original broadcast, I think. The difference is precisely in the broadcast arrangement, vs renting or purchasing a Video tape (going back). Consumer Licensing is not that different now in the case of streaming / on-demand media - it just by-passes the manufacturing. So although I could be missing something, specifically the way-back machine, should be able to function on that basis. PLUS - you have the opportunity to make new precedent on an EQUITY / FAIRNESS BASIS - where the rules for this use can be set to some reasonable standard, and not the same standard as actual infringement. Just maintain that this use is not actual infringement - it's simply sharing and has that precedent. I think. AS A BACKSTOP to this argument, keep in mind that a fundamental element of constitutionally sound law (and established within the U.S.) - is that in order to be guilty of a crime, at all, even an unintentional one - the accused MUST HAVE BEEN GIVEN FAIR WARNING. IOW, this is not the same situation as standard model copyright violation - it's something lesser, something unresolved, and something that could not have been assumed under this "warning doctrine." You can win this case with that. I think. 7:)

In 1999 2000 the record labels were using the RIAA as a central point to bring copyright violation litigation while that organization is the recording industry Association of America they hold no copyrights as record labels hold copyrights through publishing. It appeared as though litigants were not the copyright holders and I explained these details to the congressional rep for this area John McHugh.

No one is signing record deals these days, and music is less profitable than lawsuits, I've been saying this for a while, this is their main income now, they're just exploiting copywrite laws. and internet archives is a resource for smaller companies or artists to fight back against the record labels by pulling up old websites with TOS or statements on it, so this is seems like a move to silence the defense on maybe another case they're also in right now.

The amount of downloads of these archived songs that will be referenced in the lawsuit wont be many, they're niche recordings from old 78s. There's no way they can claim for millions. The legal fees will probably be worth more than the money that's been lost from the downloads.

Hmm, this sounds like a heck of a can of worms to be opened ... if 'X' has the rights to have something and 'Y' takes a copy that includes the copyrighted thing (as an archive, etc., such as the watback machine does) then that really does sound like potential copyright infringement. That'd be sad as those various internet archives can be very useful.

What happens if Internet Archive submits data which shows the music captured was never intentionally played by a user or wasn't played for longer than a few seconds? More specifically that few seconds was due to an autoplay triggered by scrolling past the music/video in question.

0:25 Wayback machine only saves website data as a whole. So they would need to go after the actual developer or owner of the website as they would be the enitity that uploaded the data to their site! Which might be their own websites as well because it would have these record labels websites backed up. This is a funny grey area! Heres an analogy you cant sue a library for having a historical book because the publisher is unhappy that they can't claim the missed profit from reselling the books on loan through the library.

Comparing this to a youtube copyright licensing issue doesn't do it justice - this is straight out of the dystopian playbook. Rights holders are not just looking for a quick and easy payout here - they want to shut down the wayback machine forever. IA are lucky if a settlement can be reached - not that they will be able to pay rights holders anything in 'damages', since there is no profit structure in place (which should have disqualified any claim to begin with, but I digress).

I don’t want to witness nor participate in the global economic r@p3 of the working musician and producer thru streaming, nor do I want to wait for some undiscovered payola scheme orchestrated by music executives priming the pump for some aspiring artists they just signed to lifetime 360 deals in perpetuity. Hmmmm. Indie musicians should start playing livestreams of their own songs occassionally adding a song by rhese labels. When those labels then claim those videos they should sue for copyright infringement for every individual song of theirs in that video that the label claimed. 150k per song. Edit: For clarification, when a company copyright claims a video or livestream they claim the entire video. And thr musician in question would need to follow the guidelines of fair use when using the company song.

Hey krystle, i have a question, I'm a guitarist singer and i play covers, i have a you tube channel and have a bunch of covers on it. They are acoustic guitar with vocals , why am i getting copyright strikes ?? Yes it's as close to the original but it's still very different, if it's a song with a full band but the version I'm doing is only guitar and vocals why am i getting a strike? I'm every single song?? Any pointers? How can i do these covers without getting a strike?? I see hundreds of you tube channels doing the same thing i am and they are getting away with it, at least i think they are... thanks😊

Record Lables are (and have been for some time) what tobacco companies were in the 1950s and 60s. At one time they were cool and innovative but very expliotative of the product and consumer. Record label companies need to go the way of the Dodo.

I love the lo-fi off-the-cuff vibe in this one. :) I want to create a RU-vid channel where I post videos of covers but also original songs. Could I safely monetize my channel by getting a license from a place like We Are the Hits? I'm from Minnesota, but planning to move to Las Vegas in the coming year... I want to find a new network of artists/musicians snd start fresh..

it would be better for artists if people who steal content are prosecuted and if there were no platforms between the artist and the people. Meaning each artist has their own website and they can sue anyone who "shares" their art, including youtube, wayback, spotify....if you build something you can't just give it away. we have destroyed music and propped up platforms with our content. CLASS ACTION

Playing this game is causing the problem. It's time to grow up & change the game. Corporate law only has authority because we acquiesce to it. It's a game!! Don't play it. It's all about CONTROL. And if you dont wake up to this, very soon you wont be able to shit without government or corporate permission.

If they can prove that wayback machine & I archive are making money from this music, then sure have at it. But I think it’s pretty petty. It’s like Nordstrom security kicking a customer out of their store who picked a $100 note off the floor by a clothes rack. Because they believe that money belongs to the store, not the customer.

But the song is only available if you go back to the day the license was good for? ie time travel...You can only access the songs on those available days, so technically they are still using the license for every one of those songs..Its an internet picture..Its like if i have a video of a concert...You cant sue me for having recorded the song the day i was at a concert if I watch the video later..This is literally the same thing...These record companies are going to greedy themselves into poverty 😂...I hope the judge laughs in their face and throws this out bc if allowed, they can start going after concert goers too

They have 13,089,172 audio files on Internet Archive. Many are of copyrighted material, including commercial music.

Cool story bro. It's an archive. They should have thrown me in jail for recording MTV on tivo to watch later back in the day. An internet archive is a problem, but platforms taking the major cut of royalties from artists isn't. Twisted.
