Form FC-6E - Intimation - Change in Original Key Members of the Association

Today I will discuss about Form FC-6E - another important form under FCRA which most of the organizations miss to comply with. Yes, Form FC-6E is all about intimating MHA Department about change in original key members of the association. Even as per the Charter released by the department, for FCRA Registered Organizations, for any change of any functionary or member, the associations were asked to File Form FC-6E and seek approval from Central Government. However, there lies a confusion in this regard. While on one hand, prima facie it seems that this is just an intimation but, in the Charter, its mentioned approval from Central Government. Although in our opinion, this should just be an intimation, but a clarification from ministry itself would have been better. So, today I will handhold you in filling up the said Form FC-6E.

is there any time limit for approval , have come across an instance when FC-3C was filed the earlier submitted FC-6E became infructuous

There is no time limit for approval , there is only time limit for intimating it to the department

This is from sri Acharya patashala, Mandya, Karnataka : we have been asking to submit form 6E by the state bank of India-delhi. Our registration formalities completed, & account is also opened. There is quiry from SBI-Delhi, to submit an approved fcra-FC6E. It seems this form needs to be down loaded from ONLINE in printable format. We have tried several times, & unable to get it down loaded. in parallel we have made a request to helpline which is pending since a week. When we call the concerned case worker, who has no patience to take the note of our clarification required. We are able to down load the form on line in PDF format, which is not printable formatt. Please let me know can we generate a seperate form, fill the required column and send it to the authorities ? please help us.

My heartfelt greetings to Sri Acharya ji. Form FC-6E has to be filled for change in Governing Body members and has to be filled online. No requirement of downloading the same But I think from the message that SBI must have asked to fill Form FC-6C which is for approval of account from FCRA department! Just please recheck once with them Both forms has to be filled online mandatorily. You can contact me at 9038966010 for any assistance

if we are filing Form FC-6E for initimation of change in address of directors, do we need a new affidavit or the affidavit filed at the time of appointment can be used?

For change of address of directors, there is no requirement of filing Form FC-6E

How can we get approval from MHA, as MHA office is not responding to the email .. now SBI is not doing the signatory change process till we produce them approval of MHA. Plz advice

From past few days, the MHA have started looking into Form FC-6E. Also , you can write a letter to SBI stating that Form FC-6E is just an intimation and no where it's mentioned that approval shall be given. So technically, they should accept only the form filed and process the changes

Sir as we had filled fc 6E and fc 6A i got the intimation copy but haven't got approval copy and it been month but can i do without fc 6E i cant do updation in sbi bank

Yes this issue is being faced by everyone ! But SBI need to understand that FC-6E is just an intimation! No approval is mandatory to be received

Sir, firstly thank u very much for posting this vedio...really helpful...i hav 2 question... 1.if we are changing the chief functionaries itself, then in the attachment page we need to attach the old chief funcyionary or new chief functionary signature?. 2. We are about to file renewal and there is change in management, so should we file fc6e first and file renewal or we can file directly renewal. As almost same details is needed in renewal (affidivate, member details)

Most welcome mam. As regards the queries: 1. In the attachment, new chief functionary details should be attached 2. In case of renewal I feel you can directly go ahead with only FC-3C but for safer view, I would suggest filing Form FC-6E too

Hello Sir, We had a change in the board in 2019 for which we have filed form 6E in that year… Now we have changes again in 2022… when logged in the application send in 2019 is still under process … please guide us Sir in this matter

Sir, when we applied for five year registration that time we put 5 executive committee members. Now 3 of them changed and new members taken place. But we did not file 6E bcz we did not know this rule. Now should we file 6E form now..

Yes you should file ! The rule is to file within 45 days of such change

Sir Who can be a chief functionary under FCRA act and rules? An individual need to be a director of an association for becoming Chief functionary?

Hi, Usually chief functionary should be someone from the Board . No where it has been mandated as such but practically most of the organisations are following this only.

Late fee as such its never charged ! But yes, if you are using a bank account for FC funds without approval, you might be penalized

Some mistake is surely there either in the Aadhar or PAN . We have made changes and done it on multiple occasions.

One doubt : if fcra asset is sold are we to deposit the sale proceeds in Fcra main account or fcra utilisation account? Is it required to declare the sale receipts in quarterly filing?

Preferably in the main account which is SBI, or in Another FCRA account but never in utilisation account. Don't think so

Sir kindly guide me in this point: FC 6E form has to be filled by an organisation which already holds fcra registration and has got some change In key functionaries or is this form to be filled for those ngos as well who have applied for fresh registration, and their application is pending with department, and in the mean while, this change in functionary has taken place

It's better to file even during the process of registration because usually at the time of inspection, the officers sometimes express their willingness to meet all the trustees. So, in that case, if it does not match with the list submitted, red flag might be raised.

Sir, Thank you for the video and can I ask one question… what about the signatory change?? As we have to fill the FC -6E regarding this signature change. And I already did it and submitted all the doc and Aadhar number of members but still m not able to do the final submit as " please submit Aadhaar number of members” Is popping up. Can you please guide me

The Aadhaar number is mandatory for all members. So it needs to be given.
